In addition to the attached Weld County USR permit amendment application, a Construction Materials Regular 112 Permit Operation Application was submitted to the Colorado Division of Minerals and Geology (DMG). To respond to the specific requirements of the USR permit application, information is provided in the attached Response to Application Requirements and Questions and additional information is provided in Attachments 1 through 4 (see attached List of Attachments). Attachment 1 is a copy of the DMG 112 Permit Application and is provided for informational purposes. An amendment to the current USR Permit No. 877 is requested to allow the mining of sand and gravel resources on approximately 98.9 acres of leased land adjacent to the Distel Farm Project, currently operated by CAMAS Colorado, Inc., Cooley Gravel Division. The existing operation and proposed expansion area are located in Sections 7, 8, 17 and 18, Township 2 North, Range 68 West, in southern Weld County, as shown on the attached Vicinity Map (see Exhibit B, Attachment 1). The proposed expansion area is located just south of County Road 119, southwest of the convergence of St. Vrain and Boulder Creeks and just north of County Road 20 1/2. The property will be divided into two phases for mining. The Phase 1 area includes the western portion of the property and consists of approximately 44.6 acres of pasture land. The Phase 2 area is located on the eastern portion of the property and is comprised of approximately 47.9 acres of pasture land. The limits of the Phase 1 and 2 mining areas are shown in the drawings in the attached DMG 112 Permit Application (see Exhibits B and C.3, Attachment 1). Based on a recent jurisdictional wetlands delineation, there are no wetlands within the proposed Phase 1 disturbance area. The Phase 2 area includes development within jurisdictional wetlands and Waters of the U.S. An Individual U.S. Army Corps of Engineers (COE) 404 (dredge and fill) permit will be required for the disturbance of these wetlands. No mining will be initiated in the Phase 2 area until a COE permit has been obtained. The mined out pit will be reclaimed as a pond. Peripheral areas and permanent stockpiles will be reseeded with pasture grasses. The requested amendment proposes no changes to the mining rates or methods, work force, equipment or transportation requirements previously permitted under USR 877. Material in the expansion area will be loaded on an existing overland conveyor and transported to the previously permitted area for processing. Access roads required to develop the expansion have previously been constructed to access existing mining areas that lie on the east and south boundaries of the proposed mining area. The proposed use is compatible with current land uses and Weld County planning goals and policies. The proposed mine area may be characterized as having "limiting site factors" due to its location in the 100-yr flood plain of St. Vrain Creek. Post-mining land uses include livestock grazing, wildlife habitat and recreation. These uses are compatible with surrounding land uses and are consistent with minimum density development and other Mixed Use Development Area planning goals and policies. A completed, signed original USR application form, 24 copies and the required application fee of$1,100 are attached. 2. A detailed discussion of the mining plan is contained in Exhibit D, Attachment 1 (copy of Division of Minerals and Geology 112 (DMG)Permit Application). a) The types and numbers of equipment are as described in USR-877. No change in equipment requirements is proposed as part of this amendment. b) No change in employment or working hours is proposed as part of this amendment. c) The mine will be operated as a dry pit. CAMAS Colorado, Inc., Cooley Gravel Division,has a Weld County Road Maintenance and Improvements Agreement for currently permitted operations. Post reclamation land use will be suitable for livestock grazing,wildlife habitat and recreation. i) A letter requesting guidance on reclamation has been sent to the Soil Conservation Service (SCS). The proposed reclamation measures presented in Exhibit E of the 112 Permit Application are based on the current USR-877 and from SCS guidance for properties in the immediate vicinity of the Distel Farm Project. Documents to be submitted by the Applicant a) The reclamation plans as submitted to the Colorado Division of Minerals and Geology are provided in Exhibits E and F, Attachment 1. b) A water augmentation plan for operational and post closure periods will be submitted to the State Engineer. A copy of the augmentation plan is provided as Attachment 4. c) No modification of drainage structures or county or local access roads will be required as part of this amendment. One irrigation tailwater ditch currently passes beneath the existing overland conveyor in a culvert. The ditch will be relocated during the mining operation and a new culvert beneath the overland conveyor alignment will be required. The new culvert will be identical to the existing culvert in diameter, materials, culvert grade and invert elevation relative to the ditch bottom. d) No new haul roads will be required to develop the expansion. Haul and access roads that have been constructed for the existing operations east and south of the proposed amendment area will be adequate for the proposed operation. 6. The proposed use is consistent with the Weld County Comprehensive Plan. The site is currently used for livestock grazing. Soils are suitable for pasture land. The extraction of mineral resources will not result in a significant loss of prime agricultural land. The site is located in the Mixed Use Development (MUD) area. Post-mining conditions will be suitable for urban open space and recreation areas and compatible with surrounding post-mining use. Riparian woodland habitat areas will be undisturbed by the mining operation. Following mining,the area will enhance the quality of the MUD by providing open space for wildlife movement and visual qualities. Weld County encourages industrial development that is appropriately located in relation to surrounding land uses. Mining is currently a major local land use. The operation will extend existing industrial operation and continue to contribute tax revenues and employment opportunities. \\SRKO\COMMON\Kcloutier\CAMAS\aplicationresponses.doc 2 982158 The development is self-supporting and will provide local relief with respect to county road maintenance expenses. 7. The property is located in MUD area that will be developed in response to urban growth pressures. The site is characterized as having"limiting site factors"due to its location in the 100-year flood plain of St. Vrain Creek. As such, lowest density development is required. Reclamation of the site will be as an open pond with restored pasture areas peripheral to the pond. The site will be useful for livestock grazing, wildlife habitat and recreation. These uses are compatible with the Weld County MUD goals. 8. Presently, there is no agricultural production on the proposed mining area. Soils are generally suitable for pasture. 9. The applicant will secure the site during non-working. All mining and processing operations will be carried out in accordance with applicable permits. The project is not anticipated to pose risks to the health and safety of local residents or Weld County. 10. Current local land uses includes agriculture, livestock grazing, gas production, mining and residential. The permitted use will be compatible with existing uses. Reclamation of the site will be compatible with other local reclaimed mine areas. 11. As stated above,the expansion is located in the MUD area. The post-mining uses include livestock grazing,wildlife habitat and recreation. These uses are compatible with MUD goals and the limiting site factors. 12. The site is located within the 100-yr flood plain of St. Vrain Creek. The area is designated as Zone A corresponding to Floodprone Zone FP-1,base flood elevations and other flood hazard factors undefined. The mine pit is not anticipated to have adverse impacts on local flood hazard potential. The post-mining lake will increase local flood storage capacity and reduce downstream flood hazards. The southern 15 acres of the site will be developed as a permanent overburden stockpile in Phase 2. It is anticipated that the area will be raised approximately 3 feet above current ground level. A portion of this area lies inside the southern limit of the 100-year flood plain as shown the FEMA Flood Insurance Rate Map Panel 850. During the intermediate regional flood, this area may be inundated with low velocity flows. A Weld County Flood Hazard Development Permit is required if the overburden stockpile will increase the flood flow elevation by one foot. Because the permanent overburden stockpile is located near the limit of the flood plain and outside the portion of the floodway that will carry high velocity flood flows and debris, the stockpile is not expected to affect flood levels. \\SRKO\COMMOMKcloutier\CAMAS\aplicationresponses.doc 3 ppt1c ) �p The permanent overburden stockpile will be developed during Phase 2. If required by Weld County, a Flood Hazard Development Permit will be obtained before mining activities are commenced in Phase 2. Otherwise,no permanent structures will be created in floodprone areas in the proposed expansion area. The proposed expansion area does not lie in airport overlay or geologic hazard overlay districts. 13. Existing water supplies are adequate for processing operations. No change in the type or rate of processing is proposed as part of this amendment. 14. Required legal instruments are provided in Exhibit N, Attachment 1. 15. No increases in equipment usage or changes to the mining operation are proposed as part of this amendment. The previously submitted noise study from the current USR 877 permit should be applicable for this amendment. 16. The proposed expansion includes development of 98.9 acres of leased land located south of County Road 119, southwest of the convergence of St. Vrain and Boulder Creeks just north of Weld County Road 20 '/2. The property proposed for expansion of mining activities is known as the Bigelow property. This document provides supporting information for application to the State of Colorado, Division of Minerals and Geology (DMG) for amendment of the Construction Material Regular 112 Operation Mining and Reclamation Permit M-89-029. Concurrently, an application to the Weld County Planning Commission and Board of County Commissioners for amendment of Use by Special Review (USR) Permit 877 has been prepared and issued. It is proposed to mine the Bigelow property in two phases. The Phase 1 area is located on the western portion of the property (see map in Exhibit B). The nearest residences are located north of St. Vrain Creek greater than 200 feet from the proposed mining area limits. There is one gas well, located 300 feet southeast of the proposed permit boundary. 4.2 Surface Features With the exception of the applicant's conveyor and material handling systems, there are no significant structures located with 200 feet of the proposed expansion area. No electrical, communication lines or easements cross the property. The primary surface water feature within two hundred feet of the proposed expansion area is St. Vrain Creek. An irrigation tailwater ditch, owned by the Coffin and Davis Ditch Company, crosses the eastern portion property. Relocation of this ditch will be required during mining and it will be rerouted through the perimeter setback area. A FEMA Flood Insurance Study was published for St. Vrain Creek. Most of the expansion area is located within the 100-year floodplain area for St. Vrain Creek as shown on Exhibit C.1. Local surface water features are shown on Exhibit C.2 4.3 Topography Topography may be characterized as flat to very gently sloping over the areas proposed for mining. Current site topography is shown on the Mine Plan Map, Exhibit C.3. Surface slopes are generally to the northeast toward St. Vrain Creek. 4.4 Area of Affected Lands The proposed permit area covers 98.9 acres. The total area expected to be disturbed, including the mine pits, permanent and temporary overburden and topsoil stockpiles, and access roads will be approximately 92.5 acres. There are no wetlands or riparian areas within the area that will be disturbed in Phase 1. Riparian woodland areas are found adjacent to St. Vrain Creek outside the proposed mining area. Wetland vegetation (i.e., bullrush and sedge) occurs in the eastern portion of the Phase 2 area. The approximate extent of these vegetation zones is shown on Exhibit C.4. 4.6 Permanent or Man-Made Structures There are no significant permanent or man-made structures located within 200 feet of the affected lands. The only structure on the affected lands is a horse shelter belonging to the owner. One residence is located approximately 250 feet from the northeast corner of the permit area north of St. Vrain Creek. 4.7 Soils The distribution of soils in the expansion area is shown on Exhibit C.1. Surficial soils consist of aquolls and aquepts over the majority of the site, with lesser amounts of Vona sandy loam and Olney fine sandy loam occurring in the southern portion of the Phase 2 mining area. These soils are described in Soils Survey of Weld County, Southern Part [United States Department of Agriculture, Soil Conservation Service (SCS), 1980]. Pertinent excerpts from the soil survey are provided in Exhibit C.1. 4.8 Water Resources Information on the location and ownership of wells located within one-half mile of the proposed mining area is provided in Exhibit C.S. 4.9 Wetlands Delineation A jurisdictional wetland delineation was completed for the project. There were no wetlands identified within the proposed Phase 1 disturbance area. The wetland delineation identified 3.1 acres of jurisdictional wetlands and approximately 1 acre of Waters of the U.S. within the proposed Phase 2 mining area. An Individual 404 (dredge and fill)permit will be required for Phase 2. No mining will be initiated in the Phase 2 area until the COE permit has been obtained. The commodity of interest is commercially saleable sand and gravel. The property will be mined in two phases. Phase 1 includes the western portion of the expansion area and consists of approximately 44.6 acres of pasture land. The Phase 2 area is located on the eastern portion of the property and is comprised of approximately 47.9 acres of pasture land. The limits of the Phase 1 and 2 mining areas are shown in Exhibit C.3. The deposit consists of alluvial sand and gravel overlain by topsoil and overburden. The topsoil layer and overburden layer will range from 0 to 5 feet in thickness, while the sand and gravel deposit is 5 to 18 feet thick. The deposit is underlain by shale. The maximum depth of excavation will be on the order of 20 feet. The groundwater level lies 2 to 5 feet below natural ground level. The deposit is therefore classified as a wet alluvial deposit; however, mining operations will be carried out following dewatering. The sand and gravel deposit is cataloged in the report Sand, Gravel and Quarry Resources, Colorado Front Range Counties (Colorado Geologic Survey, 1974). Initially, a dewatering ditch will be excavated around the perimeter of the active mining area. Groundwater recovered in the dewatering ditch will be discharged in accordance with Colorado/NPDES discharge permit requirements. Sufficient overburden and topsoil will be placed around the perimeter of the mining area to enable regrading to be completed at the end of mining. All other topsoil and overburden will be placed in temporary stockpiles within the mining area limits, or in a permanent stockpile located in the southern portion of the Phase 2 area. Topsoil and overburden will be salvaged and stockpiled separately. Topsoil and overburden stockpile areas are shown on the Mine Plan Map in Exhibit C.3. During Phase 2, wetland area soils will be separately salvaged and stockpiled for wetland mitigation purposes. The deposit will be mined using scrappers and front-end loaders. Mined material will be loaded on an existing conveyor system for transport to the previously permitted processing area. Additional conveyors may be constructed inside the mine areas to facilitate transport of the resource. All processing of mined material will be accomplished in the previously permitted processing area located east of the Bigelow property. Access and haulage roads required for the proposed operations have already been constructed for access to the previously permitted mining areas. These areas are located immediately to the south of the Phase 1 and 2 expansion areas (the Sherwood property). An access road bounds the southern limit of the Phase 1 and 2 mining areas and the existing conveyor will not require extension. Less than 1 to 2 acres of land may be disturbed to extend the existing roads into the new mine and stockpile areas. 5.3 Mining Schedule Mining is currently projected to occur at the rate of approximately 55,000 tons per month (660,000 tons/year). Based on an estimated reserve of 1.4 million tons in Phase 1, mining will be completed in approximately 2.1 years from the start of operations. Phase 2 mining will be completed in 4.4 years. Mining is currently projected to commence in the summer of 1998. The property is located within Weld County's Mixed-Use Development area along I-25, which will be developed in response to urban growth pressure. Because the majority of the site is within the 100-year flood plain of St. Vrain Creek, Weld County classifies the area as having "limiting site factors" due to flood hazard potential. Weld County Department of Planning Services considers land with limiting site factors to be suitable for agriculture, recreation and wildlife uses. The post-mining land uses as proposed in this reclamation plan include livestock grazing, recreation and wildlife habitat. These uses are compatible with the surrounding land uses and with the Weld County planning goals. Reclamation will commence at the end of Phase 2 mining; however, the applicant may elect to progressively or concurrently reclaim pit wall areas in locations where mining has been completed. Reclamation, including regrading, seeding and wetlands mitigation activities, will be completed in 2 to 5 years following the completion of mining operations. 6.2 Reclamation Measures-Materials Handling Site reclamation measures are illustrated on Exhibit F. Reclamation of the expansion area will include creation of a 60.7-acre pit lake. All pit walls will be regraded with stockpiled overburden. Slopes within 5 feet above to 10 feet below the post-mine water level will be no steeper that 3H:1V. Elsewhere in the mine area, slopes will be no steeper than 2H:1 V. Topsoil will be spread over the surface of the regraded slopes in all areas above the post-mining lake level, and the topsoil-covered surfaces will be revegetated. The southern portion of the Phase 2 pit will be backfilled with overburden to near current ground level. This will be done concurrently with Phase 2 mining. This area will be covered with topsoil and revegetated. A permanent overburden stockpile will be developed for excess overburden in the southern portion of the Phase 2 area as shown on Exhibit F. Topsoil will be spread over the stockpile and the surface will be revegetated. The elevation of the permanent stockpile is anticipated to be on the order of 3 feet above current ground level; however, the volume of excess overburden may necessitate an increase or decrease in the final elevation of the permanent stockpile. The eastern irrigation tailwater ditch will be rerouted through the overburden stockpile area. Reclamation will include reconstruction of approximately 3.1 acres of wetlands that will be disturbed during Phase 2 mining. These wetlands will be constructed, revegetated and monitored in accordance with the Individual 404 permit conditions. Most of the disturbance areas associated with site access and the existing conveyor alignment were bonded as part of previous permit requirements. Approximately 2 acres of new access road will be required within the permit limits to gain access to the Phase 1 and 2 pits and the permanent overburden stockpile. Access roads will be scarified to a depth of 12 inches, covered with topsoil and revegetated. Site grading will be performed to create stable topography that will be consistent with post-closure land uses. Reclamation quantities and costs are summarized in Exhibit L. 6.3 Water Overburden and mine materials will be inert and impacts to local surface water or groundwater quality are not anticipated to occur as a result of the development or reclamation of the proposed expansion area. The applicant will comply with all applicable State water quality laws and regulations. The applicant's Colorado/NPDES discharge permit will be updated to incorporate discharges from the proposed expansion area. Creation of a pit lake at the end of mining will result in an increase in surface evaporation. A water augmentation plan has been developed for submission to the State Engineer's Office, Colorado Division of Water Resources, to address post- mining consumptive use of water. Any temporary facilities for surface water management that are constructed during the mining operation will be removed, stabilized and revegetated during site reclamation. Following reclamation, it is anticipated that the native species will be reestablished. Existing riparian habitat areas will be undisturbed by the operation. Submittals to the Colorado Division of Wildlife (DOW) are contained in Exhibit H. 6.5 Topsoiling Topsoils in the proposed expansion area are predominantly aquolls, aquents and sandy loam. These soils will be stripped and stockpiled during overburden removal, and retained for replacement during site reclamation. At reclamation, topsoil will be spread over prepared areas in a 6-to 12-inch thick layer. Topsoil stockpiles will be protected from erosion and other damage by best management practices. Soil amendments are not expected to be required due to the nature of the soils, however, topsoil samples will be subjected to agricultural testing prior to reclamation to assess fertilizer requirements. SCS soil fertilizer recommendations, if any, will be followed. 6.6 Revegetation Following topsoil replacement, reseeding will be performed according to SCS recommended practices. Based on SCS guidance for other local projects having similar surficial soils, the following revegetation procedures are anticipated: • Grass seed will generally be planted in unfrozen soil between November 1 and April 30; • Grass seed will be planted approximately 1/2 to % inch deep with a grass drill equipped with depth bands, packer wheels and agitator; Steffen Robertson and Kirsten(U.$),Inc. 05/07/98 N:\Kcloutier\CAMAS\I 12_Bigelow_Rpt.doc SRK Project No.54202 992158 CAMAS/Cooley Page 6-4 Distel Farm Expansion Project Permit Application Package • The anticipated seed mix and application rates in pounds of pure live seed per acre are as follows: 30% Blackwell Switchgrass 1.35 10% Asalado Alkali Sacaton 0.10 30%Vaughn Side Oats Grama 2.7 20% Rosana Western Wheat 3.2 10% Reed Canarygrass 0.40 • Critical areas will be covered with straw or hay mulch to control erosion during germination; and • Weed control practices will be implemented as required. These procedures may be modified based on SCS recommendations. The majority of the local soils are not suited to the establishment of trees or shrubs. Proposed setbacks will enable preservation of tree- and shrub-covered areas adjacent to St. Vrain Creek. Restored wetland areas in Phase 2 will be revegetated in accordance with the Individual 404 permit conditions. In areas that are peripheral to the post-mining lake, marsh and aquatic plants will establish themselves. The species of plants anticipated to naturally occur along the lake shoreline include cattails, sago pondweed, widgeongrass, wildmillet and bullrushes. These plants should minimize shore erosion potential. 6.7 Buildings and Structures No significant structures exist in the proposed mining expansion area. No buildings will be constructed during the operation, as processing and administrative functions will be carried out in existing structures located in previously permitted areas. Only mobile equipment will be used in the mine area. The overland conveyor system required for transport of sand and gravel to the process area is in place. Deeper bedrock aquifers that underlie the site will be unaffected by the mining operation because of the shallow depth of excavation. Upon completion of mining, the pit will be refilled utilizing senior and junior water rights and thereafter, the post-mining water level will be maintained by groundwater inflow to the mined-out pit. The resulting lake will cover an area of 60.7 acres. Local surface water ponds, ditches, water courses and tributaries are shown on Exhibit C.2. The nearest water course is St. Vrain Creek. An irrigation tailwater ditch crosses the eastern portion of the Phase 2 mining area. Dry Creek discharges into St. Vrain Creek approximately 2,000 feet west of the proposed mining area. No impacts to Dry Creek or St. Vrain Creek are expected as a result of mining due to the large size of their catchments. Local ponds include the wash ponds and pit lakes in the currently permitted area operated by the applicant, and an abandoned gravel pit-lake located adjacent to St. Vrain Creek approximately 3,000 feet west of the proposed mining area. Boulder Creek and several surface water ponds are located approximately 1 mile east of the proposed mining area. These surface waters are not expected to be influenced by dewatering activities in the proposed mining area. Existing mining operations, which are in closer proximity to Boulder Creek, have not impacted pond levels. Approximately 3.1 acres of jurisdictional wetlands will be disturbed as a result of the proposed expansion. Wetland areas will be mitigated in accordance with the Individual 404 permit conditions. 8.2 Potential Water Resource Impacts An estimation of the water resource impacts associated with pit dewatering was performed. The analysis was based on the following assumptions and simplifications: Steffen Robertson and Kirsten(U.S.),Inc. 05/07/98 N:VCcloutier\CAMAS\I12_Bigelow_Rpt.doc SRK Project No.54202 982159 CAMAS/Cooley Page 8-2 Distel Farm Expansion Project8 PPermit Application Package • The mine pit is assumed to behave as a well that completely penetrates the upper, unconfined aquifer; • The well was assigned an equivalent diameter of 1,800 feet based on the area of the pit; • The surficial aquifer was assumed to be a uniform 15 feet in thickness; and • The surficial aquifer was assumed to be sand and gravel with a hydraulic conductivity of 1 x 10' cm/sec. These assumptions were used to develop a simplified groundwater model for a MODFLOW simulation of potential drawdown effects for steady state conditions (i.e., for dewatering over an indefinite and extended time period). The simulation indicated a drawdown on the order of three feet at a distance of 50 feet from the mine pit, with a drawdown of approximately 0.2 feet at a distance of 300 feet. It should be noted that the MODFLOW simulation was performed for the purposes of general predictions and is not intended to be a definitive estimation of drawdown. However, the model is based on conservative assumptions that would result in exaggeration of predicted drawdown. The results suggest very low potential for impacts to local wells and surface water bodies because they typically lie greater than 2,000 feet from the proposed mine area. The only wells within 2,000 feet of the mine area limits are located north of St. Vrain Creek. Because the creek will act as a hydraulic barrier, no impacts to these wells are anticipated to occur. 8.3 Discharge Permits The applicant maintains Colorado/NPDES stormwater and discharge permits for current operations. The proposed mine will be dewatered and operated as a dry mine. Alluvial groundwater from pit dewatering will be discharged into St. Vrain Creek. The applicant will update existing Colorado/NPDES discharge permits for the expansion area and will discharge in accordance with permit conditions. Process wash water will be recycled and will not be discharged. The plan will be updated to incorporate the expansion area. 8.5 Consumptive Water Use The anticipated consumptive uses for water associated with the proposed expansion operations are discussed in the following subsections. 8.5.1 Moisture Loss in Materials The proposed expansion operation is anticipated to process approximately 660,000 tons of sand and gravel per year. Based on data for similar materials compiled by the City and County of Denver, the average moisture content of these materials at the time of shipment is expected to be four (4) percent. Based on this moisture content, the moisture loss in the materials is calculated to be approximately 19.4 acre-feet per year. 8.5.2 Dust Control Dust suppression will be performed by water truck application to roadways. The amount of water used for dust control will vary based on the time of year and weather conditions. Only minor new road development will be required to access proposed mining and overburden stockpile areas. Assuming 100,000 gallons per month for dust suppression, annual consumptive use associated with the expansion will be approximately 3.6 acre-feet per year. 8.5.3 Processing Water Consumption Wash water and sediment collection pond facilities in the existing process area cover approximately 2.1 acres. Site precipitation averages 13 inches per year while local free water surface evaporation is approximately 40 inches per year. Therefore, net evaporation will be approximately 2.25 feet per year. Consumptive use in the wash water pond used to process the materials from the expansion area will be approximately 4.7 acre-feet per year. As a result of pit lake formation and based on an analysis similar to that presented in Section 8.2, annual post-mining consumptive water use will be approximately 136.6 acre-feet per year. 8.6 Total Annual Water Consumption Based on the calculations presented above, total annual consumptive use associated with the Bigelow property expansion during operations will be on the order 27.7 acre- feet per year. Post-mining consumptive use will be approximately 136.6 acre-feet per year. 8.7 Augmentation Plan A water augmentation plan will be submitted to the State Engineer's Office, Colorado Division of Water Resources. 8.8 404 Dredge and Fill Permit A jurisdictional wetlands delineation was completed for the expansion area. There were no wetlands identified within the proposed Phase 1 disturbance area. Approximately 3.1 acres of jurisdictional wetlands are located on the eastern part of the Phase 2 area. An Individual 404 permit will be obtained from COE before mining activities are commenced in the Phase 2 area. A 50-foot setback is proposed adjacent to St. Vrain Creek to serve as a buffer zone for the riparian habitat and wetland areas adjacent to the creek and these areas will not be disturbed. These setbacks will be increased as necessary to maintain a 50-foot buffer zone between the pit limit and riparian habitat areas. Based on previous wildlife assessments prepared by the DOW for the currently permitted areas, species that are commonly found in the area include dear, pheasant, rabbits, muskrat, beaver, opossum, waterfowl, raptors, rodents, magpies and songbirds. While bald eagles have recently been observed in the area, no local bald eagle nesting sites have been identified on or adjacent to the proposed mining area. A habitat survey was conducted for the proposed endangered mammalian subspecies Preble's meadow jumping mouse. The survey indicated that portions of the proposed mining area may be suitable habitat for the Preble's meadow jumping mouse. The results of the survey were submitted to the U.S. Fish and Wildlife Service (USFWS). Because no federal permits are required for the Phase 1 area, species sampling is not planned for the Phase 1 area. Setbacks of 50 feet from riparian areas should minimize potential disturbances to mouse habitat areas. As part of the requirements for the Individual 404 permit process for the Phase 2 area, species sampling for this mouse is planned for June 1998. The USFWS requires that mouse sampling (trapping) be performed between June 1 and September 15. Local wildlife species may be displaced from the area during operations; however, they are expected to reestablish themselves when mining and reclamation have been completed. The proposed mining and reclamation will not hinder local movement of wildlife. The proposed lake is anticipated to provide valuable habitat to water fowl and migratory bird species. Reclamation of the site will include formation of a 60.7-acre post-mining pit lake, revegetation of pit slopes and stockpile areas with a mixture of grasses, and reconstruction of wetland areas. These reclamation measures are anticipated to create an area that will be consistent with Weld County land use goals. 9. Lowland riparian habitat areas and some wetlands occur adjacent to St. Vrain Creek and these areas have plant cover typical of riparian habitats, including cottonwood trees, cattails, bullrushes and associated plants. Setbacks will be maintained around the riparian areas to protect these areas from disturbance. There are no wetlands in the Phase 1 disturbance areas. Some wetland vegetation occurs adjacent to the tailwater ditch in the Phase 2 mining area. Wetland areas disturbed during Phase 2 will be mitigated in accordance with the Individual 404 permit requirements. No mining will occur in the Phase 2 area until an Individual 404 permit has been obtained from the COE. A habitat survey was conducted for the threatened plant species, Ute ladies'- tresses orchid. The survey indicated that suitable habitat areas for the orchid might exist within the mining areas. Because no federal permits are required for the Phase 1 area, species sampling is not planned for the Phase 1 area. Setbacks of 50 feet from riparian areas should minimize potential disturbances to orchid habitat areas. As part of the Individual 404 permit requirements, a species survey for this orchid will be completed before mining is initiated in the Phase 2 area. The species survey for this plant will be conducted between July 20 and.August 31 as required by USFWS. I. A. is adequate in terms of improvements and maintenance. The proposed amendment will not impact the adjacent roads in number and types of vehicles anticipated beyond that anticipated for the two separate gravel operations permits, USR-877 and USR-1046, now held by the applicant. However, the applicant is hereby requesting a change in the agreement to allow traffic to move both east and west from the access point at WCR 20 1/2. At that point, 50% of the traffic would proceed each direction from the access. At WCR 7, one-half of the traffic will proceed each way, north and south. At WCR 1, one-half of the traffic will proceed each way, north and south. Some material is imported to the site for processing and mixing to make specification products. This material is generally backhauled to the site with the same trucks that haul from the site. This is not a major part of the production operation and does not affect traffic patterns. • 982159 COUNTY OF WELD, STATE OF COLORADO ROAD MAINTENANCE AND IMPROVEMENTS AGREEMENT THIS AGREEMENT, made and entered into this day of sraLL, 19cr2-, by and between the County of Weld, State of Colorado, hereinafter called "County" and Western Mobile Inc., hereinafter called "WMI" and C & M Ready Mix Concrete Company of Boulder, Inc., hereinafter called "C & M," WHEREAS, WMI and C & M have acquired land use permits from Weld County for gravel pits in the area of Rinn, Colorado, and WHEREAS, WMI and C & M have entered into Road Maintenance and Improvements Agreements with Weld County to repair and overlay County roads impacted by heavy truck traffic generated from WMI and C & M's mining and plant operation and, WHEREAS, the County has inventoried the County roads in the Rinn area and found repairs are necessary. NOW, THEREFORE, in consideration of the mutual covenants and conditions hereinafter set forth, the County, WMI, and C & M mutually agree as follows: 1. The County roads to be repaired are Weld County Road 20.5 between Weld County Road 7 and the entrance to C & M's gravel pit, and Weld County Road 7 from Weld County Road 20.5 south to state Highway 52. 2. Repair will consist of excavating potholes and distorted areas of pavement, along with unsuitable subgrade materials, and repairing with four inches of hot bituminous pavement and aggregate base as required to replace unsuitable subgrade. 3. All construction and materials shall be in accordance with the State Department of Highways, Division of Highways, State of Colorado, Standard Specifications for Road and Bridge Construction, 1991. The addition of lime to the hot bituminous pavement will not be required. 4. WMI will furnish the necessary hot bituminous pavement, equipment, and labor to repair damaged areas. 5. NOW, THEREFORE, in consideration of the mutual covenants and conditions hereinafter set forth, the County, WMI, and C & M mutually agree as follows: 1. The County roads considered in this agreement are haul routes that were 982159 established by land use permits previously granted by the County and are as follows: Weld County Road 7 between Colorado State Highway 119 and Colorado State Highway 52; Weld County Road 20.5 between Weld County Road 7 and the entrance to C & M's gravel mine, which is a distance of approximately 7,700 feet; Weld County Road 18 between Weld County Roads 7 and 5; and Weld County Road 5 between Weld County Road 18 to County Road 7. 2. WMI and C&M are restricted to hauling on the road identified in Paragraph 1 above. Previous haul route restrictions shall not apply and the establishment of the new haul routes does not constitute a substantial change from the restrictions contained in land use permits previously granted by the County, provided WMI and C & M are not in breach of this Agreement. 3. The County will, to the best of its ability within the restrictions of the law, require future gravel operators that use the haul routes described in Paragraph 1 above, to participate in Road Maintenance and Improvements Agreements as outlined herein. 4. WMI, C & M, or future gravel operators are required to share in reasonable future maintenance and improvements when such maintenance is related to their hauling impacts. 5. Upon notification by the County, all gravel operators and the County will examine the roads and determine a plan for the maintenance and improvements that are required. 6. Upon determining what maintenance and improvements are required, a separate agreement shall be drawn detailing the work to be done and how the costs are to be shared. 7. It is anticipated WMI, C & M, or future gravel operators will perform the work and share in the equipment, labor, and materials required. Any sharing done between the gravel operators shall be in separate agreements. 8. If Weld County does not require a future gravel operator to share a reasonable portion of maintenance and improvements, the County will be responsible for that portion. 9. The exposed water surface will be increased from 2.1 acres to 2.4 acres by the addition of a.'. 0.3 acre collection basin. Table 1 and Table 2 illustrate the proposed evaporative and operational losses associated with the enlarged surface area and increased production. A total depletion of29.21 acre-ft was calculated and includes water retained in product, dust suppression, and evaporation from exposed water surfaces.' The source of the replacement water for the substitute supply plan will remain the same. as the original plan. Consumptive Use credit from the Coffin&Davis Ditch_will be used for replacement during the historic irrigation season(April—October) and a lease from the City of Boulder for effluent has been renewed for non-irrigation season(November March)replacement. The operator obtained 30.9%ownership of the Coffin&Davis Ditch with the Distel Farm property. The ditch was historically used on the Distel property for irrigation of.` • 104 acres of corn,alfalfa, and pasture,grasses. It was determined in the original plan that the consumptive use associated with the Coffin&Davis Ditch water was 0.99 acre-feet per acre. The original substitute supply plan (January 25, 1991)had provisions for drying up 12 acres to offset depletions from the mining operation. The mining operation was expanded in 1993 and the renewal dated April 9, 1993 increased the dry up acreage to 52 acres to offset the increased depletions: The operator has continued to mine the Distel Farm property and currently the permitted area, which contained the 104 acres irrigated by the Coffin& Davis Ditch, has been mined in its entirety. As stated previously it was determined that the consumptive use associated with the Coffm& Davis Ditch was 0.99 acre-ft per acre. The dry up of 104 acres will therefore - . provide 102.96 acre-ft. Monthly quantities of replacement water are shown in Table:3. The increased dry up is sufficient in quantity to meet depletions during the irrigation. season: Non-irrigation season replacements will be met by leased water frond,the City of Boulder. The lease water from the City of Boulder will enter Boulder Creek at the 75h Street outfall point from Boulder's Wastewater Treatment Plant. A carriage,loss of • 0.25%u per mile has been accounted for in the determination of the required replacement water. The wastewater treatment plants outfall point is located 16 stream miles upstream of the Distel Farm Pit.
