Moved by Michael Miller that the following resolution, with the addition of Condition of Apporval #30, the

be recommended favorably to the Board of County Commissioners for the following reasons:
1. The submitted materials are in compliance with the application requirements of Section 24.7 of the
Weld County Zoning Ordinance, as amended.
2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section
24.3, Section 24.8 and Section 32.2.4 of the Weld County Zoning Ordinance, as amended, as follows:
a. Section 24.3.1.1 --This proposal is consistent with the Weld County Comprehensive Plan.
The site is located in the City of Greeley's Urban Growth Boundary Area as defined in the
Weld County Comprehensive Plan. UGB.Goal 2 in the Weld County Comprehensive Plan
states "...concentrate urban development in or adjacent to existing municipalities and
maintain urban growth boundary areas that provide an official designation between future
urban and non-urban uses." Churches, in nature, are considered urban type development.
A.Goal 3 discourages urban scale residential, commercial, and industrial development that
is not located adjacent to existing incorporated municipalities. P.Goal 2 requires adequate
facilities and services to assure the health, safety, and general welfare of the present and
future residents of Weld County.
b. Section 24.3.1.2 --This proposal is consistent with the intent of the R-1 (Low Density
Residential)zone district. Public and quasi Public Buildings including churches are allowed
in the Low Density Residential zone district upon approval of a Special Use Permit, per
Section 32.2.4.4.
c. Section 24.3.1.3 -- The proposal is consistent with Section 24.3.1.3 of the Weld County
Zoning Ordinance, as amended and will be compatible with existing surrounding land uses.
Surrounding properties include vacant lands, agricultural uses and residential development. x
The use of the church does not appear to be incompatible with existing uses of the

d. Section 24.3.1.4 --The proposed uses will be compatible with future development of the ;
surrounding area as permitted by the R-1 (Low Density Residential)zone district and with the (f..,4ilyy
future development as projected by the Comprehensive Plan or Master Plan of the affected s

municipality. As previously stated, the proposed site lies within the City of Greeley's Urban
Growth Boundary Area as defined in the Weld County Comprehensive Plan. The City of
Greeley has reviewed this request and has indicated that the use at this site is acceptable
per their Comprehensive Planning policy. The City has also indicated that religious
institutions are allowed in land use categories designated commercial and in residential areas
with an Use by Special Review Application.
e. Section 24.3.1.5 --The proposal is located within the City of Greeley's Urban Growth
Boundary area as defined in the Weld County Comprehensive Plan. The site is not located
within any Overlay District Areas identified by maps officially adopted by Weld County.
f. Section 24.3.1.6 --The applicant has demonstrated a diligent effort to conserve prime
agricultural land in the locational decision for the proposed Church. The site is not presently
farmed, thus the proposal will not remove farm ground from production.
g. Section 24.3.1.7-The Design Standards(Section 24.5 of the Weld County Zoning Ordinance,
as amended), Operation Standards(Section 24.6 of the Weld County Zoning Ordinance, as
amended), Conditions of Approval, and Development Standards ensure that there are
adequate provisions for the protection of the health, safety and welfare of the inhabitants of
the City of Greeley and the County.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
other relevant information regarding the request, and responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the following:
1. The attached Development Standards for the Special Review Permit shall be adopted and placed on
the Special Review Plat prior to recording the plat. The completed plat shall be delivered to the
Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's
Office within 60 days of approval by the Board of County Commissioners.(Dept.of Planning Services)
2. Planning Staffs approval of this Use by Special Review is based upon satisfying the above conditions.
Should an applicant be unwilling or unable to meet any one of these conditions, within 60 days of
approval, then this case will be forwarded to the Board of County Commissioners with a
recommendation for denial. (Dept. of Planning Services)
3. Prior to recording the plat:
a. A primary and secondary septic system envelope shall be designated for the septic system
that is capable of serving the proposed Family Life Center. The primary envelope shall be
designated for the initial system, while the secondary envelope shall be preserved in the
event the initial septic system should fail. The location of the envelope must be approved by
the Health Department and placed on the plat. Evidence of Health Department approval shall
be submitted to the Department of Planning Services. (Health Department)
b. A secondary septic system envelope shall be designated for the septic system intended to
serve the Sanctuary. This envelope should be preserved in the event the initial septic system
should fail. The location of the envelope must be approved by the Health Department and
be placed on the plat. Evidence of Health Department approval shall be submitted to the
Department of Planning Services.(Health Department)
c. A primary and secondary septic system envelope shall be designated for the septic system
that will serve the Parsonage. The primary building envelope should be designated for the
initial system,while the secondary envelope should be preserved in the event the initial septic
system should fail. The location of the envelopes must be approved. (Health Department)
d. The applicant shall submit a stormwater retention facility plan to the Weld County Public

Works Department for approval. The facility shall be designed to retain storm water runoff
for the fully developed site. It should be designed to release water at a quantity and rate not
to exceed the quantity and rate of a five-year storm falling on an undeveloped site. The
applicant shall submit evidence of approval by the Public Works Department to the
Department of Planning Services. Upon approval the location of the facility shall be placed

e. The applicant shall pave and stripe all internal streets, parking lots and loading areas.
Additionally, the applicant shall provide curb, gutter and sidewalks. (Dept. of Planning
Services, Public Works)
f. The applicant shall install an adequately sized cross culvert and stop sign at the two
approved access points onto WCR 29(71st Avenue). WCR 29(71st Avenue) is designated
a collector status road with an Average Daily Traffic Count of approximately 800 vehicles in
a 24-hour period. (Public Works)
g. The City of Greeley has identified WCR 29 (71st Avenue) as a minor arterial and has
annexed within one-half mile of this location. The typical cross section reflecting the minor
arterial requires 90 feet of right-of-way between intersections and 120 feet at the intersection.
There is presently 60 feet of right-of-way and an additional 15 feet shall be reserved for future
build out. Attached is the detailed #S5 from the City of Greeley to verify the typical cross
section. Cross section shall be placed on the plat. (Public Works)
h. The south access is identified as US Highway 34 Bypass (Frontage Road). The applicant
is indicating a two-way entrance road into the property. The applicant shall meet or exceed
the design standards set forth by CDOT for ingress and egress into the property
demonstrated via a road improvements plan. Evidence of this activity shall be approved by
Public Works and / or CDOT and submitted to Department Planning Services. (Public

The applicant shall submit evidence to Department of Planning Services of completion of a
Traffic Impact Analysis Study. All analysis information and reports shall be prepared and
certified by a professional engineer competent in traffic engineering. (Public Works)
j. The applicant shall enter into, and receive acceptance of a Road Improvements Agreement
between the applicant and Weld County. (Dept. of Planning Services, Public Works)
k. The applicant is indicating 150-200 people will utilize this site. Weld County Public Works
shall require at least half of the future parking lot be paved and striped to accommodate
adequate parking for Phase 1. (Public Works)
The applicant shall submit evidence of attempts to address the concerns of the City of
Greeley, as listed in the letter dated June 1, 1999, to the Weld County Department of
Planning Services. (Dept. of Planning Services)
m. The applicant shall apply for a Site Specific Development Plan(ReSubdivision)to vacate 70th
Avenue Court, Block 1, and Lots 2, 3, 4, 5, 6, &7 of the Peterson-Alexander Subdivision.

n. The applicant shall enter into an agreement with the parties receiving water from Boomerang
Lateral Ditch,which ensures delivery of irrigation water across the applicant's property is not
indited by the relocation of the ditches or show that reasonable steps have been taken to
ensure continued unimpeded delivery of water in the absence of an agreement.
o. A detailed Landscaping plan identifying the number, size and species of landscaping
buffering materials shall be submitted to the Department of Planning Services for review and
approval. The plan shall also address maintenance of the landscape materials and potential

replacement of dying materials, the approved plan shall be delineated on the plat map.
4. Prior to issuance of building permits:
a. The applicant shall submit to the Weld County Building Inspection, blueprints to determine
the type of construction, occupancy and any other code requirements applicable to the
proposed structures. The foundation, structural and electrical plans shall be certified by a
Colorado State licensed engineer. (Weld County Building Inspector)
5. Prior to release of the Certificate of Occupancy permit:
a. The applicant shall provide documentation to Department of Planning Services
demonstrating the site is in compliance with the Colorado Department of Health and
Environment regarding the septic system. (Health Department)
6. Should the possibility of City of Greeley Sewer become available sometime in the future, the
Department of Public Health and Environment would recommend that Faith Tabernacle consider
constructing the appropriate sewer lines and build in this option prior to constructing the new
structures. (Health Department)

SITE SPECIFIC DEVELOPMENT PLAN
SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS
FAITH TABERNACLE CHURCH - DANNY PERDEW

1. The Site Specific Development Plan and Special Use Permit is for a Church in the R-1 (Residential) zone
district, as indicated in the application materials on file in the Department of Planning Services and subject
to the Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning
Ordinance, as amended.
3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against
surface and groundwater contamination. (WCHD)
4. Unless approved in accordance with the Regulations promulgated pursuant to the Solid Waste Act, 30-20-
100.5, C.R.S., as amended, no permanent disposal of wastes shall be permitted at this site. (WCHD)
5. Waste materials shall be handled,stored, and disposed in a manner that controls fugitive dust, blowing debris,
and other potential nuisance conditions. (WCHD)
6. Fugitive dust shall be controlled on this site. (WCHD)
7. The maximum permissible noise level shall not exceed the commercial limit of 60 db(A), as measured
according to 25-12-102, Colorado Revised Statutes. (WCHD)
8. The applicant shall provide adequate toilet facilities (porta-potty)during construction of the facility.

9. The septic system for the sanctuary is designed for 300 persons per day. In the event the congregation or
visitors to the sanctuary exceed 300 persons on any given day, the facility shall appropriately increase the
design capacity of the septic system that serves that structure. The capacity shall be increased in accordance
with the Weld County I.S.D.S. Regulations. (WCHD)
10. An engineer designed septic system shall be installed in the future for the Family Life Center Building
according to the Weld County I.S.D.S. Regulations. (WCHD)
11. Any structure that will serve a septic system and have have a design hydraulic flow of greater than 3,000
gallons(according to the Weld County ISDS Regulations),must receive approval of the Colorado Department
of Public Health and Environment in accordance with the Regulations for the Site Application Process(5 CCR
1002-11.) (WCHD)
12. The property owner shall obtain and utilize City of Greeley water for potable and irrigation uses. (Department
of Planning Services)
13. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5
of the Weld County Zoning Ordinance, as amended or the City of Greeley Standards, whichever is more
stringent.
14. The property owner or operator shall be responsible for complying with the Operation Standards of Section
24.6 of the Weld County Zoning Ordinance, as amended.
15. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall
be granted access onto the property at any reasonable time in order to ensure the activities carried out on the
property comply with the Development Standards stated hereon and all applicable Weld County regulations.
16. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards
and all applicable Weld County regulations. Substantial changes from the plans or Development Standards
as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning
Commission before such changes from the plans or Development Standards are permitted. Any other

changes shall be filed in the office of the Department of Planning Services.
17. The property owner or operator shall be responsible for complying with all of the foregoing Development
Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation
of the Permit by the Board of County Commissioners.
18. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the
property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and
Recorder.

Kim Ogle, Department of Planning Services, presented Case USR-1217. The Department of Planning
Services is recommending approval of this application along with the Conditions of Approval and Development
Standards. Kim then read the recommendation into the record.
Danny Perdew, applicant,said that he was the pastor of Faith Tabernacle. He addressed concerns that the
surrounding property owners had regarding the irrigation ditch. He explained that they would be able to
provide adequate water to the surrounding property owners. Mr. Perdew added that they have hired a
registered engineer to help design a grade and drainage plan.
Fred Walker asked if Mr.Perdew had talked with the neighbors. Mr. Perdew stated that he has spoken to a
few of the surrounding property owners to see if they had water rights to the ditch. The surrounding property
owners then provided proof that they are to receive adequate water from this ditch.
Kim clarified that the Boomerang Lateral Ditch comes up from the south and goes underneath the Highway
34 bypass and enters the corner of the property. From the right-of-way of the property to the south it extends
up for about one hundred feet and is concrete lined, there after it is soil. Fred Walker asked Kim if the
Boomerang Lateral Ditch enters the property on the south west comer. Kim said that it did and pointed out
on the map where the ditch lies.

be done with the ditch. Mr. Perdew stated that the engineer said that it would be completed in about three
weeks.
Stephan Mokray asked Mr. Perdew if he has provided plans as to where they will place the septic system.
Mr. Perdew replied that they have found an alternative place to put the septic system. Stephan then asked
if they had enough space for the septic system. Mr. Perdew said that they did have enough.
The Chairman asked if there was anyone in the audience who wished to speak for or against this application.
David Uranno, surrounding property owner, addressed his concerns about having enough water for the
neighbors and how septic system will affect flow of the ditch.
Stephan Mokray asked Trevor if they considered the effects of the flow of the ditch when they approved Mr.
Perdew's plans. Trevor stated that the plans will need to be approved through the Conditions of Approval.
Fred Walker pointed out that Mr. Uranno's concerns are addressed through the Development Standards.
Michael Miller asked Km if the hundred-foot setback requirement for the leach field comply with the site plan
that has been submitted. Kim replied that it will be close, but possible for the leach field to comply with the
100-foot setback.
Trevor stated that they will have to rework some of the envelopes shown on the maps based on the location
of that ditch.
Lee Morrison said they can also reach a variance on the location of the leach field. If the ditch will be piped
then some of the issues will be different, but either way they will have to go through a variance.
Trevor added that it has been the Board of Health's policy that they don't particularly like variances placed on
new structures.
Gary Wiederspon said that he had concerns with the septic and leach field. He also stated his concerns
regarding the maintenance of the residential look and the landscaping.
Cristie Nickles verified with Trevor that the septic system that the applicants will use has to be designed by
an engineer. Trevor said that the engineer design will have to comply with both the State and County
regulations.
Mike Miller asked Mr.VViederspon if the septic system was an evaporative system or if it was a leach field with
trenches. Mr.Wiederspon answered that when the house was built a septic system was originally used, but
they will now put in a leach field.
Kim stated that the Church has to meet several conditions that the City of Greeley has set forth.
Suzanne Miller questioned the intensity of the Church and what type of activity would be taking place.
Greg Thompson,City of Greeley, Clarified the storm water criteria and gave an overview of each. Conditions
of Approval#3F, G, & I, deal with similar issues on the traffic analysis. Condition of Approval#31 requires a
letter written to the City of Greeley in an attempt to address the City of Greeley's Concerns. Mr. Thompson
said that he would ike to add Condition of Approval#30 to read,'The applicant will demonstrate to the City
of Greeley that the proposed structure is at least five hundred feet from all the oil and gas wells.' He also
Indicated he would like Condition of Approval#3P added to require the applicant to submit a site plan to the
City of Greeley. He concluded that he would like to add language to Condition of Approval#4 to indicate that
this is a city of Greeley standard that the septic and water Issues have been taken care of prior to granting any
building permit.

Bryant asked Mr.Thompson why the City of Greeley didn't annex this proposal. Mr.Thompson explained that
they would have to create a flag pole and the State had several issues.
Mike asked Mr. Thompson if the development to north of this proposal were In the City limits. Mr.Thompson
said that there are two developments out there, one to the west of 71 st Street and one to the east side,and
both are in the City of Greeley.
Mike then asked if either of the two developments were going to bring in the sewer line. Mr. Thompson said
that if a sewer line were to be brought in, it would be within a'/mile of the site. He added that the developers
are ones who bring in a sewer line.
Teresa Wiederspon spoke about her concems with the irrigation ditch and their ditch rights. She said that
according to Mr. Perdew,she was told that she needed a contract by the ditch company with Faith Tabernacle
Church. Ms.Wiederspon also stated concerns with the two lane access into the property,noise and pollution.
She felt that possible screening could help this situation.
Danny Perdew addressed the several issues concerning his proposal. He stated that he has had a soils test
done and they will have an adequate engineered designed septic system. They will make themselves
responsible for the septic system to work properly. Mr. Perdew said that the ditch could be moved further to
the north to meet the 100' setback. They will have three services per week that will last two hours. He
concluded that he has a landscape plan and is willing to comply with any changes made to that.
Mike addressed his concerns with the access off of Highway 34 and the impact that will cause. He asked Mr.
Perdew is it would be a big inconvenience to have their main entrance on the west side and abandon the
access off of 28th Street. Mr. Perdew replied that he is expecting the majority of the traffic to enter on the
west side because that is where the parking is; however, the entrance off of 28th Street will be the front of the
church. He added that at any given time there are only about fifty cars In the parking lot. Mike asked Mr.
Perdew if they are building this church in hopes to expand their congregation. Mr. Perdew answered yes.
Stephan asked if Mr. Perdew has had any quotes on he cost of septic system. Mr. Perdew said he had not,
he just has what the engineer has quoted.
Stephan then questioned the possibility of the City of Greeley annexing this property. Mr. Perdew replied that
they had tried to do a flagpole annexation but the State would not sign off on that.
Bryant asked if the ditch would be open or underground piped. Mr. Perdew answered that the engineer
originally said they could go underground or open trench. He is willing to work with the surrounding property
owners to do what will benefit everyone.
The Chairman asked Mr. Perdew if he was in agreement with the Conditions of Approval and Development
Standards. Mr. Perdew stated he was in agreement.
Cristie Nickles moved to add Condition of Approval#3o to read, "A detailed Landscaping plan identifying the
number, size and species of landscaping buffering materials shall be submitted to the Department of Planning
Services for review and approval. The plan shall also address maintenance of the landscape materials and
potential replacement of dying materials, the approved plan shall be delineated on the plat map.^ Stephan
