HomeMy WebLinkAbout981167.tiff HEARING CERTIFICATION DOCKET NO. 98-33 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT#1185 FOR A MECHANIC'S REPAIR SHOP FOR AGRICULTURAL TRUCKS AND TRACTORS, SEMI- TRUCKS AND OTHER AGRICULTURAL IMPLEMENTS IN THE A (AGRICULTURAL) ZONE DISTRICT - DANA AND DEEANN PATTEN A public hearing was conducted on July 1, 1998, at 10:00 a.m., with the following present: Commissioner Constance L. Harbert, Chair Commissioner W. H. Webster, Pro-Tem Commissioner George E. Baxter Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Julie Chester Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated June 10, 1998, and duly published June 17, 1998, in the Platteville Herald, a public hearing was conducted to consider the request of Dana and DeeAnn Patten for a mechanics repair shop for agricultural trucks and tractors, semi-trucks and other agricultural implements in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Julie Chester, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Chester gave a brief description of the property location and stated this application complies with Section 24.3 of the Weld County Zoning Ordinance. She explained the applicant requested a separate access to the business and residence north of the existing circle drive with the south access being closed. Ms. Chester stated the Planning Commissioner agreed with this request and the change will be shown on the plat. In response to Commissioner Kirkmeyer, Mr. Morrison suggested placing the word "former" before "circle" in Development Standard #17. Responding to Commissioner Kirkmeyer, Ms. Chester stated the applicant wishes to have two or three employees in the future as indicated in Development Standard#18 and the number of customers is an anticipated amount. She further stated Development Standard #18 is intended to prevent an overflow of customers which could result in parking on Weld County Road 29. Commissioner Kirkmeyer stated this Standard may be hard to enforce. Mr. Morrison stated a violation will occur if the business exceeds three employees or fifteen customers per day or if customers begin parking in the road. Commissioner Kirkmeyer suggested additional wording be added to#18 to prevent parking on the road. 981167 PL1252 6C: Pt, Dana Patten, applicant, stated they own 3.5 acres which will be enough room for people to park and stay off the road. DeeAnn Patten, co-applicant, stated vehicles will be coming and going at various times of the day so there should not be an overflow of vehicles. Following discussion regarding the need for Development Standard #18, Chair Harbert stated the number of employees will determine the amount of work that can be done. Commissioner Hall suggested deleting Development Standard#18. Commissioner Kirkmeyer stated #18 is not necessary because if the business expands the applicants will be required to amend the Special Review Permit and government should not be involved in limiting the size of a business. Mr. Morrison explained the limitations in#18 are necessary to determine whether an expansion has occurred; however, if#18 is deleted these numbers are also part of the application and will be referred to if an expansion occurs. Ms. Chester suggested the wording in Development Standard #18 be replaced with, "No overflow parking or staging shall be allowed on Weld County Road 19." No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of Dana and DeeAnn Patten for a Site Specific Development Plan and Special Review Permit #1185 for a mechanics repair shop for agricultural trucks and tractors, semi-trucks and other agricultural implements in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record with Development #18 replaced to state, "No overflow parking or staging shall be allowed on Weld County Road 29.", and the addition of the word "former" before "circle" in Development Standard #17. The motion was seconded by Commissioner Webster, and it carried unanimously. This Certification was approved on the 6th day of July, 1998.
