Fort Lupton Power Plant 1996 Valuation
MEMORANDUM
The Division of Property Taxation (DPT) had an appeal filed
with the Board of Assessment Appeals (BAA) , for the 1996
valuation of the referenced company. Thermo Cogeneration
and the Division have settled the appeal.
A copy of the BAA' s Order is enclosed. Please adjust your
records accordingly. The BAA' s order may be used in lieu of
an abatement petition, 39-8-109, C. R. S .
The company' s 1996 value was reduced from $116, 059, 900, to
$100, 940, 000, and the assessed value was reduced from
$33, 657, 371, to $29, 272, 600 . The primary reason for the
reduction in value was inaccurate forecasts originally
submitted by the company in the 1996 valuation season. As
you are aware, the BAA hearing is de novo, and each party
can submit new information. If the information is valid and
accurate, it will influence the value of the property.
The company has also protested the 1997 valuation related to
the power plant in Fort Lupton and the power plant located
in the Monfort facility. The DPT is currently reviewing the
information provided for the 1997 appeals to determine if a
value can be derived prior to a BAA hearing.

Property Tax Administrator hereby stipulate that the actual value assigned to the
property that is the subject of this appeal for tax year 1996 is $100,940,000 with
an assessed value of $29,272,600.
The parties agree that these values apply to tax year 1996 only. The
parties request that the Board enter an Order reducing the actual value and
assessed values assigned to this property for tax year 1996 to the values shown
above.
Each party will bear its own costs in connection with this appeal.
