Approved with Conditions
The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed steel warehouse on Lot A. The septic system shall be
installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. The applicant shall adhere to the original Site Plan Review for the existing steel fabrication business or
submit an application and pay the appropriate fees to amend Site Plan Review 225. Recording the plat for
2nd AMRE-151 will be contingent on the applicant submitting a complete Site Plan Review.
B. Access to proposed Lot B shall be determined through the Site Plan Review Process. Lot A shall utilize the
existing Agricultural /oil and gas/ditch road access points. No circle drives or additional accesses shall
be granted. The accesses will be placed in such a location to have adequate sight distance in both
directions and not below the crest of a hill or where physical obstructions are present. These roads will be

graded and drained to provide all weather access.
C. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County
Public Works Department to determine if a culvert is necessary at any approved access point. If a drainage
culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger
culvert, please contact the Public Works Department to adequately size the culvert.
D. WCR 39.5 is designated on the Transportation Plan Map as a local paved road, which requires 60 feet of
right-of-way at full build out. There is presently 60 feet of right-of-way. A total of 30 feet from the centerline
of Weld County Road 39.5 shall be delineated on the plat as right-of-way.
E. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located. Pursuant to the definition of SETBACK in the Weld
County Zoning Ordinance (Ordinance 89, as amended),the required setback is measured from the
future right-of-way line.
2) Any future structures or uses on site must obtain the appropriate zoning and building permits.
3) A Site Plan Review shall be required in accordance with Section 34.4.5 of the Weld County Zoning
Ordinance as follows: No land, BUILDING OR STRUCTURE shall be USED, changed in USE or
type of occupancy, DEVELOPED, erected,constructed, reconstructed, moved or structurally altered
or operated in the 1-3 District until a Site Plan Review has been approved by the Department of
Planning Services. It shall be necessary that the applicant for a building permit in the 1-3 District
certify and state that the performance standards and district requirements that are applicable to the
DEVELOPMENT and USE of property zoned 1-3 have been or shall be complied with according to
the intent of Section 23, Site Plan Review. This shall be accomplished through the Site Plan Review
application process.
4) F.A.A. approval will be required for any structures occurring in the Greeley-Weld County Airport
Overlay Zone district as indicated on the Airport Overlay Map recorded on January 22, 1996,
reception number 2472884, B-1528, P-643.
5) Prior to the release of building permits on Lot A, B or C, the applicant will be required to submit a
recorded deed describing the lot upon which the building permit is requested with the building permit
application. The legal description on such deed shall include the lot and recorded exemption
number.
6) Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Ordinance 169A.
3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7
of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of
approval by the Department of Planning Services. The applicant shall be responsible for paying the recording
fees.
4. Planning Staffs approval of this recorded exemption is based upon satisfying the above conditions. Should an
applicant be unwilling or unable to meet any one of these conditions,within 60 days of approval, then this case
will be forwarded to the B Board of County Commissioners with a recommendation for denial.

This letter is in response to your letter dated September 22, 1999. The amendment to the
Site Plan Review will require a new application form to be completed and a $400 fee to be
paid at the time of submission. If any information from SPR-225 would be helpful you can
request copies be made by our office staff at $1.25 per page. However, all the information
will need to be included for our staff to process the case.
The trailer used for storage and training meetings can easily be permitted through the Site
Plan Review Process. However, building permits need to be obtained each time the trailer is
moved onto the property. According to Dave Sprague, Lead Building Inspector, if electricity
is the only utility an electrical permit would also be required.
Your letter also questioned the requirement of screening storage areas. This is a
requirement in the 1-3 (Industrial) zone district. Section 34.5.1.8 of the Weld County Zoning
Ordinance reads as follows:
Areas USED for storage or trash collection shall be SCREENED from ADJACENT
PUBLIC rights-of-way and ADJACENT properties. These areas shall be designed and
USED in a manner that will prevent wind or animal scattered trash.
Section 10.1 of the Weld County Zoning Ordinance defines screened as follows:
SCREENED: Construction and maintenance of fences, earth berms or the USE of
landscaping materials or other materials used with the approval of the Department of
Planning Services to lessen the noise, light, heat or visual impacts of a USE on
surrounding USES.

We have been provided a copy of the Weld County Planning Department Administrative
Review report on the application of Norfolk Iron &Metal Company to amend the recorded
exemption plat. We have the following comments concerning the conditions in the county report.
We have enclosed a revised site plan of our existing property—Legal Description—
E2SW4 Pt SEC. 20,T D6 N,A 65 W. This site plan also indicates the proposed new property
lines to the south.
The house trailer you have referred to is a construction office trailer used only for storage
and an occasional training meeting.
Our outside yard space is used to store raw materials and fabricated structural steel. This
use of our yard space is typical for the structural steel fabrication industry throughout the world.
Our outside storage yards are not visible from US 85 or"0"Street(WCR 64). If screening from
view from a public thoroughfare is required,we contend it should only be along the east(WCR
39 %a)property line.

Lot B (Platte River Steel Co. ) has an existing steel fabrication plant at this
site. The septic system was built and approved by the Weld County Health
Department.
Lot A (Norfolk Iron 8 Metal Co. ) plan on constructing a new 100,000 SF build-
ing for a Warehouse and Distribution Terminal for raw steel products. A new
septic system will be designed and installed in accordance with the Weld County
Health Department requirements.
3. USEAGE:
Both lots are zoned County Industrial - Z3, and will be used in accordance to
this zone.
4. REQUEST FOR PROPOSAL:
The owners of each lot are jointly making this proposal to adjust their common
lot line to Improve their industrial needs. Platte River Steel needs more
yard space for storage of raw materials and products. They can only expand
Southerly into platted Parcel A.
Winograds have extra land, but need land on the Westerly edge of Parcel B for
access for a Railroad Spur to serve their lot.
The "exchange" of land provided by the Amended Recorded Exemption is mutually
beneficial and will have a minimal impact on the present and proposed uses of
each owner.

The Weld County Public Works Department has reviewed this proposal; the following requirements are

COMMENTS:
WCR 39.5 is designated on the Transportation Plan Map as a local paved road which requires 60 feet of right-of-
way at full build out. There is presently 60 feet of right-of-way. Thsi road is maintained by Weld County. Pursuant
tot he definition of SETBACK in the Weld County Zoning (Ordinance 89, as amended), the required setback is
measured from the future right-of-way line.
REQUIREMENTS:
Weld County Public Works shall work with the applicant on commercial access points during the Site Plan Review
(Lot B, 25.5-acre parcel).
The access shall be placed in such a location to have adequate sight distance in both directions and not below the
crest of a hill or where physical obstructions are present.
If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a
larger culvert, please contact the Public Works Department to adequately size your culvert.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation. No
additional accesses shall be granted. (Lot A, 43.7-acre parcel)
Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds.

Thanks for the opportunity to review this recorded exemption. The City of Greeley Planning
staff has reviewed the application for a recorded exemption from Norfolk Iron& Metal
Company, located northwest of the intersection of Weld County Road 64 and Weld County Road
39.5 and wish to forward the following comments.
Resolution 7, 1985 by the City of Greeley Planning Commission gave administrative review
authority to the Greeley Planning staff for review of recorded exemptions (RE). We have
reviewed the request for the amended recorded exemption and find no conflicts with our
interests. The Greeley Public Works Department has noted that a reservation of a minimum of
50' of right-of-way from Weld County Road 64 and the reservation of a minimum of 40' of right-
of-way from the centerline of Weld County Road 39.5 would be appropriate to facilitate future
development of this area. We would also like to reserve the right to review the plans for the new
100,000 square foot building that is being proposed on Lot A.

31—Kim loam, 0 to 1 percent slopes. This is a deep,
well drained soil on smooth plains and alluvial fans at
elevations of 4,900 to 5,250 feet. It formed in mixed eolian
deposits and parent sediment from a wide variety of j
bedrock. Included in mapping are small areas of soils that
have loamy sand underlying materiaL
Typically the surface layer is brown and pale brown
about 12 inches thick. The upper 30 inches of the underly-
ing material is pale brown loam. The lower part to a
depth of 60 inches is pale brown fine sandy loam.
Permeability is moderate. Available water capacity is
high. The effective rooting depth is 60 inches or more.
Surface runoff is slow,and the erosion hazard is low.
This soil is used almost entirely for irrigated crops. It
is suited to all crops commonly grown in the area, includ-
ing corn, sugar beets, beans, alfalfa, small grain, potatoes,
and onions. An example of a suitable cropping system is 3
to 4 years of alfalfa followed by corn, corn for silage,
sugar beets, small grain, or beans. Very few conservation
practices are needed to maintain top yields.
All methods of irrigation are suitable, but furrow ir-
rigation is the most common. Barnyard manure and com-
mercial fertilizer are needed for top yields.
Windbreaks and environmental plantings of trees and
shrubs commonly grown in the area are generally well
suited to this soil. Cultivation to control competing
vegetation should be continued for as many years as
possible following planting. Trees that are best suited and
have good survival are Rocky Mountain juniper, eastern
redcedar, ponderosa pine, Siberian elm, Russian-olive, and
hackberry. The shrubs best suited are skunkbush sumac,
Siberian peashrub, lilac, and American plum.
Wildlife is an important secondary use of this soiL The
cropland areas provide favorable habitat for ring-necked
pheasant and mourning dove. Many nongame species can
be attracted by establishing areas for nesting and escape
cover. For pheasants, undisturbed nesting cover is essen-
tial and should be included in plans for habitat develop-
ment, especially in areas of intensive agriculture.
This soil has good potential for urban and recreational
development. Increased population growth in the survey
area has resulted in increased homesite construction. The
chief limiting feature for urban development and road
construction is the limited capacity of the Boil to support
a load. Septic tank absorption fields function properly, but
community sewage systems should be provided if the
population density increases. Because of the permeability
of the substratum, sewage lagoons must be sealed.
