to* • RESOLUTION RE: ACTION OF BOARD CONCERNING RECORDED EXEMPTION #2491 - GILLIAN ELIZABETH KELLEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the request for Recorded Exemption #2491 was submitted by Gillian Elizabeth Kelley, 7505 Weld County Road 102, Wellington, Co 80549, for property which is located in part of the N'/2, S'h, S'/2 of Section 19, Township 9 North, Range 67 West of the 6th P.M., Weld County, Colorado, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 46 acres and 34 acres, and WHEREAS, after reviewing the Planning staffs concerns and hearing the testimony presented, the Board determined that said request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that this proposal evades the purpose of the Weld County Subdivision Ordinance as defined in Sections 11.4.2.1 through 11.4.2.6, specifically: a) Section 11.4.2.4 - Consistency with the purpose of efficient and orderly development as expressed in Section 1.3 of the Weld County Subdivision Ordinance. 1) Section 1.3.1 - Assisting orderly and integrated development. Access to the proposed parcels is problematic because there are no county maintained roads to provide access to the proposed lots. Considering that Section 19 currently has an existing recorded exemption south of and adjacent to the proposed recorded exemption, this proposed recorded exemption would create four Recorded Exemption Lots in this section. Considering Sections 17 and 20, which are both east and northeast of and adjacent to Section 19, this application would create eight (8) recorded exemptions, for a total of twenty-five (25) lots in this otherwise rural area. None of these Lots were created through a formal subdivision process. The Board feels this proposal is not consistent with the Weld County Comprehensive Plan. 4. It is the opinion of the Board that any further division of these lots will create additional accesses onto Weld County Roads and will increase the density of the existing linear subdivision. 5. The Board feels this proposal increases the need for more urban-type services in the area which the Board is currently unable to provide. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request for Recorded Exemption #2491, submitted by Gillian Elizabeth Kelley be, and hereby is, denied. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved "out of the way" of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and county roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal for roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to municipal services. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The applicant shall be responsible for paying the recording fees. 4. Planning Staffs approval of this recorded exemption is based upon satisfying the above conditions. For this reason we are requesting the case be reviewed by the Board of County Commissioners. Department of Planning Services' staff has the following concerns: 1. The proposed recorded exemption lots are south of and adjacent to two recorded exemptions (RE-2259 and RE-2260) which were both denied by the Board of County Commissioners on July 27, 1998. The reasons given in the resolution for these denials included but were not limited to the following: "the proposed recorded exemptions would be inconsistent with efficient and orderly development." "The proposed recorded exemptions would not be consistent with the Weld County Comprehensive Plan." "There would be an increased need for urban-type services in the area", and, "the applicant has failed to comply with the Agricultural Zone District intent." 2. The conflict between rural and urban activities is evident in this request.hen an urban growth pattern is established without regard to long range comprehensive planning the outcome lacks the essential elements of long term desirability. Higher costs are incurred by providing many public services to urban sprawl areas. As urban areas develop and expand they inadvertently influence surrounding areas. These areas are either converted to urban uses themselves or are in direct conflict and competition with agricultural areas. 3. The applicant has failed to comply with the A (Agricultural) zone district intent. This parcel is located outside of an Urban Growth Boundary Area. Continued division of this parcel emphatically opposes the intent of the A (Agricultural) zone district. The potential to interfere and encroach upon the agricultural activities of this area is evident. The A (Agricultural) zone district was established to promote and maintain agriculture as a vital support element for Weld County Citizens, and not to be continually decreased for residential development. The Agricultural zone policies discourage the conversion of agricultural land for residential uses within an area located outside of an urban growth boundary. The intent is to eliminate incompatibilities that exist and minimize costs to Weld County tax-payers. The applicant has chosen to subdivide the land without regard to the long term impacts of the division. By doing so, the applicant has not been required to pay for the cost of public services and improvements that their current proposed division are producing. (a) See attached permits No. 215912 and No. 215913 to construct a well on the west and east ends of the property. The permits will allow for both inside use and outside use of up to 1 acre garden/lawn. (b) This land is in established dryland grasses and the uneven terrain consists of extreme undulations, not suited for irrigation. 2. The owners will comply with Weld County Health Department waste disposal requirements and have hired a professional engineer to design a septic system for their proposed four bedroom home. See attached report for proposed Lot B. 3. The land is currently used for pasturing livestock. Most of the 80-acre parcel is still in native grasses and would never be good for intensified agricultural use because of the soil types and slopes. None of the land is considered prime according to the Weld County Comprehensive plan due to the lack of irrigation water, undulating terrain and the erodability of the soils. There are currently no animal confinement facilities on these parcels. There are no oil well structures. 4. The 80-acre parcel is not large enough to be an economical ranching unit, but is too large for the intended use of my single family home with room for several small animals. There is a great demand for small 30 to 40 acre agricultural-zoned acreages. If this request is granted, it will fill this need and not affect prime Weld County agricultural land. The requested exemption removes a parcel that is less than 35 acres from a parcel that is 80 acres in size. Each parcel can function on its own as a mini- ranch of approximately 34 and 46 acres respectively. The larger size of each is required because of the dryland grass, and the number of grazing acres required for each animal unit. It requires about 30 acres of dryland grass to maintain two horses. This request improves the functional use of the land and creates parcels of land that can be effectively utilized as agricultural zoned acreage. Realizing that this land is fragile and is not suited for high density living, the owner is willing to put a deed restriction on the lots created by this request that states that these lots cannot be further subdivided unless theland is part of a county approved subdivision or is annexed into a municipality. The owner will participate in improving WCR 102 from WCR 15 to the Larimer County line Request for Recorded Exemption Page 2 so that good gravel road will be available to access the property from both directions. Access to the proposed Lot A now exists from the west. Access for Lot B will be installed on the east side at the requester's expense. Therefore, there will be no cost burden to the County for approval, however the tax base to help maintain the area will be increased. All the above reasons, I believe,meet all Guidelines for approval and are in keeping with orderly development of Weld County. 5. The property is located west of Nunn approximately eight miles on Larimer/Weld County line. Wellington is three miles southwest of the property. The size of the existing parcel is 80 acres. The surrounding area is either in pasture or dryland agriculture production. The State Game, Fish and Parks Commission owns land in Section 30,just south of this Section 19. There are numerous smaller acreages along WCR 102 with recently built homes. The agricultural production in the area is limited to cattle grazing or dryland wheat production. 6. There is no known adopted municipal plan or intergovernmental agreements that would affect this property. 7. The land to the south of this land is being utilized in the same manner as proposed herein. The land adjacent to the east has a new home on an acreage. The land to the north is pasture grassland, which is what is planned for these parcels (single family homes with enough pasture land to maintain a few animals.) 8. The proposal, to the best of our knowledge, is consistent with Weld County Comprehensive Plan and Weld County Zoning Ordinance in that it will not have an impact on "prime" agricultural land and it fits well into the surrounding area. The area has available telephone and electric service, and well permits are in place..Many of the farms in the area have converted their existing farm yard to rural acreages. There are already several acreages in the area, to the east on WCR 102 and several other small Ag zoned acreages in the immediate three mile radius. 9. Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the future right-of-way line. REQUIREMENTS: The right-of-way or easement shall be a graded and drained road to provide all weather access.
