REQUEST: A Site Specific Development Plan and a Special Review Permit for a public church
with an associated grass playground area and ball field in the A (Agricultural) Zone
District.
LEGAL DESCRIPTION: Lot A of RE-1850 being located in part of the SE4 of Section 8, T2N,
R67W of the 6th P.M., Weld County, CO.
LOCATION: East of& adj. to WCR 15 ''A , approx. 1/4 mile north of WCR 22
SIZE OF PARCEL: 5 +/- acres
PARCEL NUMBER: 1311 08 400001
THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 24.7
of the Weld County Zoning Ordinance, as amended.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 24.3 of the Weld County Zoning Ordinance, as amended, as
follows:
a. Section 24.3.1.1 --This proposal is consistent with the Weld County Comprehensive
Plan, as amended. The site is located in the Town of Firestone's Urban Growth
Boundary Area as delineated in the Intergovernmental Agreement signed between
Weld County, Firestone, Frederick and Dacono. UGB.Goal 2 in the Weld County
Comprehensive Plan states to concentrate urban development in or adjacent to
existing municipalities and maintain urban growth boundary areas that provide an
official designation between future urban and non-urban uses. Churches, in nature,
972286
are considered urban-type development. A.Goal 3 discourages residential,
commercial, and industrial development which is not located adjacent to existing
municipalities. The Town of Firestone has annexed property approximately %miles
to the west of the proposed site.
b. Section 24.3.1.2-- This proposal is consistent with the intent of the A (Agricultural)
zone district. Public and quasi Public Buildings including churches are allowed in
the Agricultural zone district upon approval of a Special Use Permit.
c. Section 24.3.1.3 -- The proposal is consistent with Section 24.3.1.3 of the Weld
County Zoning Ordinance, as amended and will be compatible with existing
surrounding land uses. The proposed site is located adjacent to the east of
Enchanted Hills Subdivision. Agricultural activities are located to the north and
south of the site. The use of the church does not appear to be incompatible with
existing uses of the surrounding area. Weld County Road 15 '% is undeveloped at
this time, however, conditions of approval will adequately address the upgrading of
this road to maintain the proposed vehicular traffic.
d. Section 24.3.1.4-- The proposed uses will be compatible with future development
of the surrounding area as permitted by the A (Agricultural) zone districts and with
the future development as projected by the Comprehensive Plan or Master Plan of
affected municipalities. As previously stated, the proposed site lies within the Town
of Firestone's Urban Growth Boundary Area as defined in the Intergovernmental
Agreement. The Town of Firestone has reviewed this request and has indicated
that the site is designated as Low Density Residential in their Comprehensive Plan.
The Town has also indicated that religious institutions are allowed in all land use
categories within a Planned Unit Development and within R-1 provided that there
is a one acre minimum lot size and a 50-foot setback.
e. Section 24.3.1.5--The proposal is located within Town of Firestone's Urban Growth
Boundary area as delineated in the Intergovernmental Agreement Area. The site
is not located within any other Overlay District Areas identified by maps officially
adopted by Weld County.
f. Section 24.3.1.6 -- The applicant has demonstrated a diligent effort to conserve
productive agricultural land. The site is categorized as non-prime irrigated soils by
the USDA Soil Conservation Service. A large portion of the site is identified on the
submitted map as a grassland play area.
g. Section 24.3.1.7--The Design Standards (Section 24.5 of the Weld County Zoning
Ordinance, as amended), Operation Standards (Section 24.6 of the Weld County
Zoning Ordinance, as amended), Conditions of Approval, and Development
Standards ensure that there are adequate provisions for the protection of health,
safety, and welfare of the inhabitants of the neighborhood and county.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.

Unsafe Conditions: There are no apparent unsafe conditions on the site.
Comments:
1 . Access: the access to the site is proposed as via WCR 151/2. This is an
unimproved one-lane road (not graded) and will need substantial improvement.
Elm and Maple Street also could be utilized as access to the site. Both roads are
in Enchanted Hills Subdivision and are gravel. There appears to be some dust
control on these roads. WCR 22, which runs perpendicular to WCR 15 '/ , is
paved until approximately 20 feet before the intersection of WCR 15 '/z.
2. On site: the site is currently vacant farm ground. There appears to be some

landscaping being attempted along WCR 15 'h (trees and shrubs just planted).
This landscaping appears to be in the right-of-way.
3. Location: the site is located adjacent to Enchanted Hills Subdivision, an
agricultural subdivision approved in 1968.
