HomeMy WebLinkAbout980413.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST DENNIS AND CAROLYN SEEWALD FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Dennis and Carolyn Seewald, VI #9600266, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 10th day of March, 1998, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Dennis and Carolyn Seewald, subject property owners, were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals as hereinabove named to correct said violation. As you recall,permit MP 04199 had all inspections completed with the exception of the electrical. For safety reasons the National Electrical Code requires a four wire feeder for a manufactured home. All four wires must be insulated. Although a ground rod is driven at the house,without this fourth wire a very hazardous situation is present. The last time I was out, we met with John Docheff and talked about a way to install the missing fourth wire (equipment grornding conductor). In speaking to John recently, I asked him if he had made the correction that we had discussed. He said he had not. I/' It is the intention of this office to assist and cooperate with you without imposing undue hardship; however,we have no discretion in this matter. Failure to correct this matter by January 30, 1998, will result in this office scheduling the violation before the Board of County Commissioners to consider whether to refer the violation to the County Attorney's office for legal action.
