The Department of Planning Services staff reviewed your request to change the Road Maintenance and Improvement Agreement between Al Challenger and the Weld County Public Works Department. The new agreement proposes to amend the original agreement to allow hauling onto Weld County Road 151/2. Currently the permit only allows for hauling onto Weld County Road 54. The resolution for USR-672 was approved by the Board of County Commissioners on May 15, 1985. In the resolution, Operation Standard #3 states the following: All trucks directly involved with extraction of sand and gravel shall ingress and egress onto Weld County Road 54 as shown on the submitted Use by Special Review plat unless coordinated with the adjacent land owners. The haul route shall be primarily from the point of ingress and egress west to I-25. In order to amend the special use permit administratively the applicant shall submit written evidence to the Department of Planning Services for review and approval that all adjacent property owners are agreeable with the proposed change to the haul route. This Agreement amends the original Agreement done in 1985 to allow hauling on Weld County Road 151/2. The hauling on this road will allow material removal and facilitate the correction of a Section 404 violation in this area. Coulson Excavating wishes to begin removal of stockpiled material prior to the spring flows in the Big Thompson River. We request this change in the haul route be considered as minor for the following reasons: • Use of Weld County Road 15/ is temporary and will be only for the transport of materials for the southern part of Phase 2. • The terms of the Agreement are worked out with the Public Works Department to insure safety, road capacity, and dust control. We ask that you not require any approval by the Planning Commission or the Board of County Commissioners because of the minor nature of this change. With this letter I have enclosed a copy of the Colorado Wastewater Discharge Permit. You will note that Western Mobile originally received the permit and it has been transferred to Coulson Excavating. Also your letter noted a need for a Floodplain Development Permit. Previously we requested this permit be delayed until we hear back from the.Corps of Engineers office in Omaha. Their recommendations may result in a reconfiguration of some aspects of the mining plan. Identification, Classification, and Numeric Standards 1. Identification: Segment 4, Big Thompson River Sub-basin, South Platte River Basin 2. Classification: Recreation, Class 2 Aquatic Life, Class 2, (Warm) Agriculture. 3. Numeric Standards: The standards which have been assigned in accordance with the above classifications can be found in 3.8.0 Classification and Numeric Standards for the South Platte River Basin, Laramie River Basin, Republican Basin, Smoky Hill River Basin (5 CCR 1002-8) , as amended March 1, 1992. It should be noted that this facility does not discharge pollutants which are limited by water quality standards with the exception of pH. IV. FACILITY INFORMATION: The facility did not report, in 'the permit application, any modifications to the facility since the issuance of the last permit. A description of the facility, wastewater sources, discharge point(s) and treatment received by the wastewater is identified in a previous certification. ANTIDEGRADATION: These are not reviewable waters pursuant to Section 3.1.8(3)(a) of the Basic Standards and Methodologies for Surface Water (5 CCR 1002-2) , based on a finding of no increased water quality impact. VI. DISCUSSION: Applicable effluent limitations and monitoring requirements regarding active mining outfalls are addressed in Part I.B. (1-4) of the general permit. Total dissolved solids monitoring of the discharge shall not be required. Total phosphorus monitoring shall not be required. See Part I.B.3. of the general permit and Part V.A. of the rationale for more information. The permittee will be required to develop and implement a Storm Water Management Plan (SWMP) . The plan shall identify potential sources of pollution (including sediment) which may reasonably be expected to affect the quality of stormwater discharges associated with the mining activity. In addition, the plan shall describe and ensure the implementation of best management practices (BMPs) which will be used to reduce the pollutants in stormwater discharges associated with mining activity. Although some activities may already be in place, the SWMP will require the ,permittee to coordinate best management practices so the result is the reduction or elimination of pollutants reaching state waters from areas not limited by effluent limitations. Significant changes in the permittee's mining or stormwater management practices may require coordination with the Colorado Division of Minerals and Geology (CDMG) (formerly CMLRD) regarding the facility's mining permit. For specifics of the Plan and additional requirements, see Part I.C. of the general permit. VII. SPECIFIC INFORMATION OF CONCERN TO THE PERMITTEE: The Permittee is encouraged to read the general rationale for an understanding of how the general permit was developed and to read the permit itself to see what requirements exist. Effluent limitations and monitoring requirements are specified in Part I.B. , and special notification requirements for effluent violations are addressed in Part II .A.3.
