FINDINGS AND RESOLUTION
CONCERNING RETAIL PACKAGE LIQUOR STORE LICENSE
OF JOHN SHOCKLEY, d/b/a SHOCKLEY'S LIQUORS
The application of John Shockley, d/b/a Shockley's Liquors
for a retail package liquor store license came on for hearing
January 19, 1966, at 7:00 P.M., and the Board of County Commissioners
of the County of Weld, having heard the testimony and evidence
adduced upon said hearing and having considered the testimony, evi-
dence, petitions and remonstrances filed with said Board, and
having carefully weighed the same, now makes the following findings:
1. The applicant failed to sustain the burden of proof as to
the reasonable requirements of the neighborhood.
The evidence shows that there is another retail package liquor
store outlet in the area described as neighborhood. The evidence
shows that there has been no substantial increase or change in
population since the last license was issued. The evidence shows
that the expectant patronage of the business would be residents
of other areas, motorists, and other passers-by; and there is evi-
dence that prospective patrons now have the opportunity to patronize
a similar establishment as close as three blocks. There is evidence
that need is based upon a desire for more competition and convenience
in the area rather than inadequate availability.
2. The desires of the inhabitants of the neighborhood of said
proposed location, as evidenced by personal testimony and petitions,
are opposed to the issuance of the license.
3. That each of the preceding findings in and of themselves,
and independent of each other constitutes a separate and individual
ground for denial of the license.
RESOLUTION
WHEREAS, the Board of County Commissioners of the County of Weld
has heard the application of John Shockley for a retail package liquor
store license at a location, described as follows:
Lot 6 of Shupe Subdivision, a subdivision of a part of
Blocks 37 and 38, Clayton Park, a subdivision of land
in and adjoining the City of Greeley in the Southwest
Quarter of the Southwest Quarter of Section 32, Township
6 North, Range 65 West of the 6th P.M., Weld County,
Colorado.
WHEREAS, the said Board has made its findings upon the evi-
dence, testimony, petitions and remonstrances submitted to it,
which findings precede this Resolution and by reference are
incorporated herein and made a part hereof; and,
WHEREAS, the said Board has carefully considered the appli-
cation, evidence, testimony, petitions and remonstrances and given
the same such weight as it in its discretion deemed proper, and is
now fully advised in the premises.
NOW, THEREFORE, BE IT RESOLVED, that the application of John
Shockley for a retail package liquor store license on the premises
indicated above be and it hereby is denied upon each of the grounds
set forth in the Board's findings therein.

WHEREAS, on January 3, 1966, Ruth Barsch requested a
refund of $325.00 for the 1966 Beer, Wine and Spiritous Liquor
License No. G-158 issued to the partnership of F. W. Barsch and
Ruth Barsch dba Farm Fare Restaurant, at Lucerne, Colorado, inas-
much as Ruth Barsch became the sole owner and received license
No. 6613 on January 1, 1966; and
WHEREAS, on January 7, 1966, the Secretary of State
was notified of the request for refund; and
WHEREAS, on January 11, 1966, the Secretary of State
notified the Board of County Commissioners that they had re-
funded $25.00 on January 7, 1966, to F. W. and Ruth Barsch; and,
WHEREAS, on January 12, 1966, the Board of County Com-
missioners requested the State Treasurer to refund the balance of
the license fee charged on State Liquor License No. G-158; and,
WHEREAS, on January 27, 1966, the State Treasurer in-
formed the Board of County Commissioners that they did not make
refunds, but only signs the warrant when issuedesbut recommended

that the County Treasurer take credit for $276.25 on the next
remittance for license fees collected, mentioning the license
No. G-158; and,
WHEREAS, the Board of County Commissioners cannot do any
more than has been shown herein; however, the Board of County Com-
missioners is willing to instruct the County Treasurer to take credit
for $276.25 on the next remittance for license fees to the State
Treasurer and then, at that time, refund said balance of fee to
Ruth Barsch.
NOW, THEREFORE, be it resolved that the Weld County Treasurer
shall take credit for $276.25 on the next remittance for liquor
license fees collected, mentioning the license No. G-158 and, at
that time, refund unto Ruth Barsch the balance of said fee, to -wit:
$300.00, which was collected on said liquor license.
FURTHER, be it resolved that the authority for said
resolution is that certain letter dated January 27, 1966 from Homer
F. Bedford, Treasurer of Colorado.

RESOLUTION
WHEREAS, the Petitions of 222 resident land owners in
the proposed Milliken -LaSalle -Kersey Pest Control District have
been presented to the Weld County Commissioners; and,
WHEREAS, the Petitions request the establishment of a
"Pest Control District" for an area in Weld County known as the
Milliken -LaSalle -Kersey Pest Control District; and,
WHEREAS, the Petitions appear to be in proper order and
an election should now be held to determine whether or not said
district should be established.
NOW, THEREFORE, BE IT RESOLVED that (1)an election shall
be held to determine whether or not a Milliken -LaSalle -Kersey Pest
Control District is to be established; (2) a board of three
judges is hereby appointed, to -wit: George James, Stewart Boulter
and Francis Loustalet, fdli. the purpose of counting ballots; and
(3) the formation of said District shall proceed as by law pro-
vided.

auction held on the 16th day of March 1966, at the hour of 2:00 o'clock P. M.
in the office of the Board of County Commissioners, excepting therefrom the
reservations in favor of the Union Pacific Railroad Company; and excepting
therefrom the reservations in the United States Patent and existing reservoir
sites and irrigation ditches, if any, existing rights -of -way for public highways
and roads, and any and all existing easements of rights -of -way, however evidenced

and other minerals therein or thereunder, together with the right to prospect for
and remove the same; and all county owned structures, if any, on said property,
and all property used for county purposes; and
WHEREAS, at said sale Dean & Bette L. Bivens bid $20.00 as the purchase
price for said property and being the highest and best bidder, said property
was sold.
NOW, THEREFORE, BE IT RESOLVED, that Charles 0. Bursiel, County Treasurer
be and is hereby constituted and appointed as Commissioner for Weld County, Colorado
and is hereby ordered to convey without covenants of warranty to Dean and Bette L.
Bivens the property more particularly described as follows; to -wit:

effect to transfer to said Dean and Bette L. Bivens of Keota, Colorado, all right
title and interest which Weld County has in and to the above described property
subject to the exception and reservations hereinabove mentioned or referred to.

RESOLUTION
WHEREAS, a request by the Mountain States Telephone and Telegraph Company, for a vari-
ance from the requirements of Section 3.13 of the Zoning Resolution of Weld County re-
vised October 1964, which has a maximum height of Buildings cf 40 feet in a residential
district; and
WHEREAS, the Mountain States Telephone and Telegraph Company have shown the Weld Coun-
ty Board of Adjustment a plan cf their proposed building and 100 foot tower; and
WHEREAS, the request for the variance of 60 feet to allow them to put up their 100
foot Type L Self Supporting Micro Waive Tower on their property located in the South
Half (S 1/2) cf the Northeast Quarter (NE 1/4) of Section 23, Township 5 North, Range
66 West of the 6th P. M. in Weld County, Colorado; and
WHEREAS, the opinion of the Board cf Adjustment the strict application of the maximum
height of buildings in Section 3.13 would result in peculiar and exceptional practical
difficulties and undue hardship upon the owners of said property; and
WHEREAS, the granting of such a variance from strict application should be granted so as
to relieve such hardship; and
WHEREAS, the variance does not authcrize any use other than uses enumerated as a use -
by -right in the district; and
WHEREAS, the unnecessary hardship tc the owner is shown to occur in following the pro-
visions of the resolution; and
WHEREAS, the circumstances create a hardship not created by the owner, and not in ex-
istence at the time of the passage of the resolution, and could not reasonably be cor-
rected; and
WHEREAS, the granting of the variance is not out of harmony with the intent and purpose
of the resolution.
NOW, THEREFORE, be it resolved that the Weld County Bcard of Adjustment recommends to
the Board of County Commissioners that a variance frcm the requirements of Section
3.13 of the Zoning Resolution of Weld County be granted to the Mountain States Tele-
phone and Telegraph Company cf the maximum height of 40 feet to 100 feet for the Type
L Self Supporting Micro Waive Tower.

PEST CONTROL DISTRICT (DIST.# 7):
WHEREAS, pursuant to the provisions of Chapter 6, Article 5, Colorado
Revised Statutes, 1963, for the control of Canada Thistle and Bindweed, the Board
of County Commissioners caused a ballot to be mailed to landowners in a given
area requesting the establishment of the Milliken, LaSalle, Kersey Pest Control
District (Pest Control District #7); and
WHEREAS, eighty-eight and five tenths (88.5%) percent of said landowners
representing sixty-six and ninety three hundreds percent (66.93%) of the land,
voted in favor of the proposed district; and
WHEREAS, the Board believes it to be in the best interest of the County
to establish said district.

WHEREAS, Theodore C. Noeller dba Noellers Service Station of Weld
County, Colorado, has presented to the Board of County Commissioners of Weld
County an application for a retail license for the sale of 3.2% beer only, and
WHEREAS, the said applicant having paid to the County Treasurer the
sum of fifty dollars ($50.00) therefor, and having produced a state retail
license J-3443 for sale of 3.2% beer only, outside the corporate limits of any
town or city in the County of Weld, at the location described as follows:
Block 4, Deerfield, Townsite and Settlement, located in
Section 30, Township 4 North, Range 61 West, according
to the amended map or plat, thereof, subject to 20 foot
alley previously reserved as set forth of record.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of
Weld County, Colorado, that having examined said application and the other
qualifications of the applicant, they do hereby grant License #66-6 to said
applicant to sell 3.2% beer only at retail at said place, and do hereby authorize
and direct the issuance of said license by the Chairman of the Board, attested
by the County Clerk, good for one year from the date of issue unless revoked,
according to law, provided, however, that said license shall be issued upon the
express condition and agreement that the place where licensee is authorized to
sell beer under said license will be conducted in strict conformity to all laws
of the State of Colorado and rules and regulations relating thereto heretofore
passed by the Board of County Commissioners of Weld County, Colorado, and any
violations thereof shall be cause for revocation of the license.

RESOLUTION
THAT, WHEREAS, the Board of County Commissioners of Weld County, a political
subdivision of the State of Colorado, at a meeting duly called and held on
the 18th day of May, 1966, adopted a resolution authorizing the said Board
of County Commissioners to execute a Unitization Agreement for the Develop-
ment and Operation of the D Sand Reservoir Unit Area, Buckingham Field, Weld
County, Colorado, covering certain Town Lots in the Towmsite of Buckingham,
Township 8 North, Range 59 West, 6th P. M., Weld County, Colorado, described
as follows; to -wit:
Block 2: Lots 10, 17, 21
Block 1: Lot 1, N Lot 2, Lots 3, 5, 6, 11
Block 4: Lots 13, 14, 19, 22
Block 5: Lots 3, 4, 9, 11

WHEREAS, it is proposed by Vaughey and Vaughey, a copartnership, composed
of E. A. Vaughey, W. M. Vaughey and W. T. Blackburn, 1640 Denver Club
Building, Denver, Colorado 80202, to unitize for secondary recovery program
the following described land in Weld County, Colorado, to -wit:

containing 480.00 acres, more or less.
WHEREAS, in the opinion of this Board of County Commissioners, it will be
to the best interest of this Weld County Board of County Commissioners to
enter into said Unitization Agreement for the conservation and the increase
in the ultimate recovery of oil, gas and associated minerals from the D sand
reservoir, Buckingham Field, Weld County, Colorado, and to prevent waste.
NOW, THEREFORE, BE IT RESOLVED, that the said Board of County Commissioners
be and they are hereby authorized to execute said Unitization Agreement.

18.37 cents per gallon, including state tax, for furnishing approximately 100,000
gallons of Ethyl gasoline beginning May 18, 1966; and
WHEREAS, the Board of County Commissioners believes it to be in the
best interests of the County to accept said bid.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of Ae'd County, Colorado that the bid of the Sinclair Refining Company for approxi-
mately 100,000 gallons of Ethyl gasoline to be delivered to the Weld County Shop
at 18.37 cents per gallon, be and the same is hereby accepted.

WHEREAS, a petition has been presented to the Board of County Commissioners
signed by two-thirds or more of the freeholders adjoining County road #290 lyina
between sections 20 and 21, sections 17 and 16, sections 8 and 9 in Township 8 North,
Range 60 West of the 6th P. M., and adjoining a wagon trail lying between sections
9 and 16 in Township 8 North and Range 60 West of the 6th P. M. in Weld County,
requesting that said road be vacated, abandoned and closed, and
WHEREAS, it appears that the necessities of the public no longer requires
said road.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of

WHEREAS, a public hearing was held on Wednesday, May 18, 1966,
at 3:30 P.M. in the office of the County Commissioners of Weld
County, Weld County Courthouse, Greeley, Colorado, pursuant to legal
notice, pertaining to a petition for change of zone as requested by
Dr. Earl Drake; and,
WHEREAS, a number of persons were present who opposed the change
of zone, as it would permit a veterinary hospital in the area, and,
WHEREAS, there was no onepresent who favored the change of
zone, and,
WHEREAS, those persons opposed the change because said area
is now developing as a residential area, and that a veterinary
hoopital might change this trend of development, and,
WHEREAS, in the opinion of the County Commissioners of Weld
County this request does not conform to the present "land use" and
further, having heard no logical reasons for change of zone,
NOW THEREFORE, BE IT RESOLVED that the petition of Dr. Earl
Drake for change of zone is hereby denied for the reasons that it
would be spot zoning; that it is a residential area and to change
the'preaent zone would change the present trend of development.

RESOLUTION
WHEREAS, a public hearing was held on Wednesday, May 18, 1966
at 1:30 P.M. in the office of the County Commissioners of Weld
County, Weld County Courthouse, Greeley, Colorado, pursuant to legal
notice pertaining to a petition for change of zone as requested by
Celeste Rumney; and,
WHEREAS, a number of persons were present who favored the change
of zone, and,
WHEREAS, there was no one present at the hearing who objected
to the change of zone and said change of zone follows the recommenda-
tion of The Weld County Planning Commission, and,
WHEREAS, it was determined that the "land use" was a logical
expansion of the already existing use for a salvage yard, and,
WHEREAS, the owner of the adjacent salvage yard agrees to keep
the channel of the river clear of car bodies and other items; and,
WHEREAS, Tom Roach, owner of Riverside Salvage Yard is the
prospective buyer of the Rumney property,
NOW, THEREFORE, BE IT RESOLVED that subject to the owner of
the Riverside Salvage Yard, who is the prospective buyer of the
Rumney property, removing and keeping removed from the area of the
Platte River all car bodies and any other items which may create
a hazard to the road bridge down channel, the County Commissioners of
Weld County hereby change the zone of the property described in the
Celeste Rumney petition from "E" Estate to "I" Industrial Zone.
