This amount is provided for maintenance over and above normal maintenance on transportor-erector routes and is limited to spot replacement of gravel, correction of base failures, and repair or replacement of culverts, when such work is requested by an officially designated representative of the Air Force. It is our understanding that similar funds will be available in fiscal years 1970 and 1971. In order to make these funds available to Weld County, the existing agreement between the County and the Bureau of Public Roads for extra- ordinary snow removal is being sunolemented. Enclosed are the original and seven copies of a(supplemental agreement to supplement the modified agreement for extraordinary snow removal dated October 22, 1965) Please review this supplemental agreement and, if satisfactory, sign all enclosed copies in the spaces provided, including the Attest statement. You may keep the copy marked "Weld County" for your files. Please sign and return all other copies (original plus six copies) to this office for our further distribution. Abelard Division Engineer Enclosures WELD COUNTY MODIFIED AGREEMENT WITH WELD COUNTY, COLORADO FOR EXTRAORDINARY SNOW REMOVAL ON DEFENSE ACCESS ROADS SERVING WARREN AIR FORCE BASE MINUTEMAN MISSILE SITES IN COLORADO PROJECT R -AD 300(1) October 22, 1965 SUPPLEMENTAL AGREEMENT FOR EXTRAORDINARY MAINTENANCE February 13, 1969 This SUPPLEMENTAL AGREEMENT is made and entered into by and between Weld County, State of Colorado, hereinafter referred to as "Weld County," and the United States Department of Transportation, Bureau of Public Roads, hereinafter referred to as "Public Roads." This Agreement supplements the modified agreement approved effective October 22, 1965, covering extraordinary snow removal. WHEREAS, pursuant to the provisions of Section 210 of Title 23, United States Code and authority delegated by the Secretary of Transportation, Public Roads is authorised to provide for the maintenance of defense access roads. WHEREAS, the Department of the Army, acting pursuant to authority delegated by the Secretary of Defense and the Secretary of the Army, has certified that it is important to the national defense to provide for extraordinary maintenance under the conditions herein set forth on the defense access roads hereinafter described and has requested that Public Roads take appropriate action to provide for such extraordinary maintenance out of funds transferred to Public Roads by the Department of the Air Force, and WHEREAS, Weld County is willing to cooperate in the interests of national defense by performing the extraordinary maintenance work herein specified under conditions that will result in neither a profit nor a loss to Weld County. NOW, THEREFORE, the parties hereby agree as follows: 1. The term "defense access roads" means those public highways as defined in the modified agreement dated effective October 22, 1965. 2. Weld County agrees to perform the extraordinary maintenance on the defense access roads hereinafter described in the modified agreement. Such maintenance, over and above normal maintenance, shall consist of and be limited to the following as required for transporter -erector operations or as a result of extraordinary snow removal operations: a. Spot replacement of gravel. b. Correction of base failures. e. Repair or replacement of culverts. 3. Weld County will be reimbursed for actual costs of operators, equipment, labor and material costs incurred in the performance of extraordinary maintenance on the herein described defense roads. The term "actual cost" means the cost incurred by Weld County fort 2 a. The cost of operators and labor, including overtime and those fringe benefits normally paid by Weld County, such as contributions to retirement system, insurance programs, annual and sick leave benefits. b. The invoice costs of all materials incorporated into the aforementioned maintenance tasks. c. An hourly rental for equipment based on the rates established in the latest edition of the "Construction Equipment Rental Rate Manual" published by the Department of Highways, State of Colorado. As outlined in paragraph 9, page 2 of the Foreward to the Rental Manual, 75 percent of the standard base rates shall be used for all publicly -owned equipment. 4. Weld County, when bi3ltng Public Roads, shall submit annually a certified statement of the actual costa of operators, labor, equipment and materials incurred for extraordinary maintenance. Records of the actual costa shall be recorded and maintained by Weld County and such records shall be retained and made available for inspection and audit by Public Roads until Weld County is notified in writing that such records are no longer required. Such actual costs shall not exceed the sum of $2,500.00 for the fiscal years ending dune 30, 1969, 1970 and 1971 subject to the availability of funds therefor. 5. The agreements contained in Items 7, 9, 10 and 11 of the modified agreement dated October 22, 1965, will apply to extraordinary maintenance as hereinbefore defined, 6. Weld County agrees to perform the extraordinary maintenance on the defense access roads hereinbefore described in this supplemental agreement when notified by any one of the named authorized agents representing the Civil Engineer of Warren Air force Base, Cheyenne, Wyoming, listed in Item 2 of the Modified Agreement dated October 22, 1965. The maintenance agreement entered into between Cooper Communications, Inc., and your County to maintain all radio equipment at an agreed unit price per month is not eligible for reimbursement, as outlined in paragraph 5 of the extraordinary maintenance agreement with your County. The modified agreement, dated October 22, 1965, states on page 4, paragraph 7 that Weld County agrees to provide extraordinary snow removal for fiscal years 1966, 1967, 1968, 1969, 1970, and 1971. Based on this agreement, costs incurred for rentals from July 1, 1971 until November 1, 1971, are not eligible for reimbursement. Payment to Weld County in the amount of $2,198.33 is being sent under separate cover from our Accounts Section this date.
