Powars moved adoption of the following Resolution : WHEREAS , C . Entomologist , and J . R. ` P. GILLETTE , State gLane , C.ou. ty Pest Inspector of Weld Court. , Colorado have certi -'ied to this Board , and the Board of County Commis - sioners have duly found : That within Weld County , Colorado , the territory designated as Pest Distriot No . 8 of ,; eld County is infested with a pest , to wit , prairie dogs , and the County Pest In- spector having made investigation of said premises and found the same so infnsted , and the County Pest Inspector having notified in writing the owners or persons in charge or control of the premises hereinafter particularly described , of the nature , extent , and location of the infestation , and having demanded that within a specified time certain specified work be done on the said infested premises for the extermination of such pests ; And the occupants of the land hereinafter particularin described in Exhibit A hav- ing failed to do effective work on t, . e premises in accordance with the instructions of the offiL er in charge , and the County Pest Inspector having tat:en possession of such in- fested premises , and having done the work necessary in 1925 for the extermination of such pest , as provided by statute ; AND WHEREAS , a proper petition , duly verified , has been filed with the Board of County Commissioners at its meeting on the 6 day of June , 1922 , by the requisite number of land owners within Township 8 North f range 61 , ',lest of the 6 P . H. in geld County , Colorado , asking for the formation of said township into a pest district , and no order having been made declaring such district not legally formed ; And the County Pest Inspector having certified that he has completed said work for the year 1925 throughout said district , and having furnished a list , copy of which is hereto attached as 2xhibit A , stating the names of the land owners whose lands are included in said district , their addresses so fur as knnwn , and a description of the lands owned by each , and the lands the owner of which is unknown ; And the said County Pest Inspector having filed with the County Commissioners his certificate showing the necessity for such work , the reasonable costs and expenses thereof , and a description of the land or property upon which the work was done , to wit , the lands hereinafter described inhibit A , and the amount of expenses due from each for such work of extermination of pests from said several lands , exclusive of the amount paid the County Pest Inspector . IT IS THEiiEFORE RESOLVED That the Board of County Commissioners do now approve said expense bill and the assessment of the same against the several lands and owners as set forth in Exhibit A hereto attached , to which reference is made , and the county having paid the said expenses ; IT IS RESOLVED Said list and certificate shall be , and is now certified to the County Treasurer of weld County , Colo . , with direction that , pursuant to statitues in such cases made and provided , he shall Liail a notice of the amount of such expense and assess- ment to each land owner whose name and address is : _no in , and he shall within thirty days after said notices are mailed , enter the amount of such assessments as are not paid at the proper places on his tax rolls , and such amounts shall thereupon become a lien upon said respective lands and shall be collected by the Treasurer in the same manner as taxes levied thereon . No . 50 - Township 6 North of Range 63 , filed with Commissioners 5 - 27 - 1924 . of Neld County is infested with a pest , to wit , prairie dogs , and the County Pest Inspector having made investigation of said premises and found the same so infested , and the County Pest Inspectof having notified in writing the owners or persons iii charge or control of the premises hereinafter particularly described , of the nature , extent , and location of the infestation , and having demanded that within a specified time certain specified work be done on the said infested premises for the extermination of such pests ; and the occupants of the land hereinafter particularly described in hibit A having failed to do effective work on the premises in accordance with the instructions of the officer in charge , and the County Pest Inspector having taken possession of such infested premises , and having done the work necessary in 1925 for the extermination of such pest , as provided by statute ; AND WHEREAS , a proper petition, duly certified , has been filed with the Board of County Commissioners at its meeting on the various dated as designated above , in Weld County , Colorado , asking for the formation of said township into a pest district , and no order having been made declaring such district not legally formed ; And the County Pest Inspector having certified that he has completed said work for the year 1925 throughout said district , and having furnished a list , copy of which is hereto attached as Exhibit A , stating the names of the land owners whose lands are included in said iistrict , their addresses so far as known , and a description of the lands owned by each , and the lands the owner of which is unknown; And the said County Pest Inspector having filed with the County Commissioners his certificate showing the necessity for such work , the reasonable costs and expenses thereof , and a description of the land or property upon which the work was done , to wit , the lands hereinafter described in Exhibit A , and the amount of expenses due from each for such work of extermination of pests from said several lands , exclusive of the a :iio:.lnt paid the I County Pest Inspector. The Licensee shall hear the entire cost and expense incurred in connection with the construction , maintenance , repair , renewal and operation of said ditch , including any and all expense e which may be incurred by the Railro act Company in connection therewith . for supervision , inspection or otherwise , and all the work performed upon the same within the limits of the right of way of the Railroad Company shall be done by or under the di - rection of and according to plans and specifications approved by the Railr ,- ad Company , it being unL, erstood that the Railroad Company shall do all work performed in connection with the construction , maintenance , repair and renewal of said ditch when such work requires any alteration of said roadbed or may in any manner involve the Eafety of said track . Wheneverr any material is furnished or labor is performed by the Railroad 3 Company in connection with the construction, maintenance , repair and renewal of said ditch , the Lic ezispe shall reimburse the Railroad Company for all expenditures made by it in fur- nishing such material or performing such work within thirty (.30 ) days after the rendition of •. a bill therefor by the Railroad Company . ( a ) COTJIITY TO BE 1 ENTIRE EXPENSE OF CULV RT . They County shall bear the entire cost and el.pense incurred in connection with the construction , maintenance , repair and renewal of the said thirty-six inch corrugated iron pipe culvert to be installed by the County , including any and all expense which may be incurred by the Railroad Company in connection therewith for supervision , inspection or otherwise , and all the work performed upon the same within the limits of the right of way of the Railroad Company shall be done under the direction of and according to plans and specifications approved by the Railroad Company . ( 6 ) SU; J .CT TO 'LEEDS OF : ILROhD COL PANY . The pa Railroad Company , notwithstanding the aforesaid grants , shall have the right to Railroad Tr^ t T F,7 retain its existing track at and in the vicinity of said ditch' in its present location , and ,nothing shall be done or suffered to be done by the Licensee or the County at any time that would in any manner impair the usefulness or safety of such track or of any other tracks that may hereafter be constructed azr within the limits of the right of way of the Railr ad Company ; and the Company'. Railroad CoM reserves and shall have the right at any and all times to make such changes in its existing track and structures , or in the present standards thereof , and to construct , maintain and operate such additional tracks and structures within the limits of said right of way in the vicinity of said ditch and across the same , as from time to time it: may elect ; and the Licensee shall bear the expense of making such modifications and such chan^: es in the location of said ditch as may be required by the Railroad Company in connection-with such changes in said track and structures , or in the present standards thereof , and such additionaltraacks and structures . The obligations of the Licensee in • ' bed with reference to the maintenance . repair , renewal and operation tnls agreement prescrl of the sa id ditch as constructed in accordance with the provtsions herein contained shall apply to said ditch as relocated , changed , modified or added to within the ,contemplation of this :s ecti o .i . ( 7 ) CO JTROL OF ';iAT ER IN DITCH. 11. of ��'a � '.. The , Licensee shall maintain waste weirs at points outside the right y ' ri such locations and of such capacities that the surface level of • r of the Railroad Company a. said ditch shall at all times remain at an elev . tion at least two feet below the water in • the base of the rails of said track or tracks ; and the Licensee shall not at any time per- mit any `, .�a.ter to overflow from said ditch onto the right of way or premises of the Rail- road z y Company . The surface level of the water in said ditch during the winter shall be kept road o 1 n,, ff i c i entl low to prevent the accumulation of ice at a level higher than the maximum surface u r - ac e sufficiently p level of water herein specified ; and in the event ice shall accumulate at a higher level than 597 that hereinbefore specified the Railroad Company may remove the same , and the Licensee shall pay to the Railroad Company , on demand , the entire actual cost of removing such ice accumu- lation. ( 8 ) DITCH NOT TO I :ITER2L:; .. .'ul H CPE.?..L IO_, OF R1AILROAD. The said ditch and all parts thereof within and outside of the limits of the right of way and premises of the Railr, ad Company shall at all times be constructed , main- teineu , repaired , renewed and operated by the Licensee in such a manner as to cause no inter- ference whatsoever with the constant , continuous and uninterrupted use of the tracks , prop- erty and premises of the Railroad Company , both as regards operation , maintenance , repairs and renewals , or possible new construction by the Railroad Company .. ( 9 ) LIC 1;SEE TO PRO VIDE AID/OR LIAINTAIN FENCES . In case the right of way or premises of the Railroad Company at and in the vicinity of said ditch , is fenced either at the date hereof or in the future and the Railroad Company shall request the Licensee so to do , the Licensee shall erect and/or maintain , re- pair and renew to the satisfaction of the Railroad Company and at the exuense of the Licensee , a good and lawful fence with all necessary gates and openings therein across and/or adjacent to said ditch . ( 10 ) SALE OF RIGHT OF WAY. In the event the Railroad Company shall dispose of any portion of its pro- perty on which the said ditch of the Licensee is located under the terms hereof , then and in such event the right or license herein granted with respect to such portion of said ditch as may be located on the property of the Railroad Company so disposed of , shall cease and deter- mine , and thereupon this agreement shall become null and void and be of no further force and effect between the parties hereto with respect to said portion of said ditch located on such property of the Railroad Company so disposed of . ( 11 ) LIABILITY . The Licensee shall indemnify and hold harmless the Railroad Company from and against any and all damages , claims , demands , actions , causes of action , costs and expenses of whatsoever n:: ture which may result from any injury to or the death of any person whomso - ever , orfrom the loss cf or damage to property of any kind or nature , including damage to the roadbed tracks , equipment or other property of the Railroad Company , when such injur:T , death , loss or damage is due to the construction , existence , maintenance , repair , renewal , use and operation of said ditch , or to the water therein or therefrom, PROVIDED , however , that the Licensee shall not be held liable under the provisions of this section , for any injury , death , loss or damage which is directly due to the performance of any of the work contemplated her e- unaer when such work is performed by the Railr }ad Company . The County shall indemnify and hold harmless the Railroad Company from and against any and all damages , claims , demands , actions , causes of action , costs and expenses of whatsoever nature which may result from any injury to or the death of any person whomso- ever , or from the loss of or damage to property of any kind or nature , when such Injury , death , loss or damage is due to the construction , existence , maintenanc: e , repair , renewal . or use of the said thirty- six inch corru{ ted .Iron pipe culvert to be installed by the County as hereinabove provided for , PROVID�iU , however , that the County shall not be held liable under the provisions of this section , for any injury , death , loss or damage which is directly due to the performance of any of the work contemplated hereunder when such work is performed by the Railroad Company . ( 12 ) DISUSE OF DITCH. Disuse of said ditch for the purpose for which it - s n -,jar intended continuing at any tie for a period of one year shall constitute an abandonment thereof by the Licensee and of the grant herein made , and in case of such an abandonment or of the breach by the Licensee of any of the conditions , covenants and agreements herein contained , the Railroad Company shall have the right to terminate this agreement at any time by giving to the Licensee thirty ( 30 ) days ' written notice of its intention so to do , and at the expiration of such thirty ( 30 ) days ' notice the license herein granted shall terminate and be at an end , and the Licensee shall be without recourse or redress of any character a:~ainst the Railroad Company by reason thereof. Within sixty ( 60 ) days after the termination of this agreement howsoever , the Licensee and the County shall remove all property herein provided for , from that portion of the right of way and premises of the Railroad Company not occupied by the said roadbed and track or tracks and shall restore , to the satisfaction of the Railroad Company , said right of way and premises to as good condition as they were in before said ditch w a s oroginally o g i n al ly con- structed ; and if the Licensee and/or the County fails so to do the Railroad Company may do such work of removal and restoration at the cost and expense of the Licensee and/or the • County as the case may be . The Railroad Company may , at its option , upon such termination , at the entire cost and expense of the Licensee , remove that portion of the said ditch located underneath said roadbed and track or tracks , from the premises of the Railroad Company and restore said roadbed to its original condition . In the event of the removal by the Railroad Company of the property of the Licensee and/or the County as herein provided , and the premises of the of the restoration 0 Railroad Company to their former condition, the Railroad Company shall in no manner be liable . to the Licensee and/or the County for any damage sustained by the Licensee and/or the County • for or on account thereof , and such removal and restoration shall in no manner pro judice or impair any right of action , for damages or otherwise , that the Railroad Company may have aainst the Licensee and/or the County . 598 ( 14 ) AG E.& TOE. �, ��a,_�:Y _ _ti 1 TO 2iSS I :.N .
