REQUEST: A Minorsubdivision Final Plat for a two lot subdivision in the I-3 zone district.
LEGAL DESCRIPTION: Lot B of RE-1536 located in Section 4, T5N, R65W of the 6th P.M.,
Weld County, Colorado.
LOCATION: North of and adjacent to 8th Street; west and adjacent to Cherry Avenue.
SIZE OF PARCEL: 17.48 acres, more or less.
THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS
REQUEST BE APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 4.5
of the Weld County Subdivision Ordinance, as amended.
2. The submitted materials are in compliance with Section 4.6.9 of the Weld County
Subdivision Ordinance as follows:
4.6.9.1 A. Compliance with the Weld County Comprehensive Plan and the zone district in
which the proposed use is located.
1. I.Goal 4 states: "Promote industrial development that is appropriately
located in relation to surrounding land uses, and that meets necessary
environment standards. " This proposal for a two (2) lot subdivision in the
I-3 zone district is compatible with surrounding land uses. The site is
adjacent to existing commercial and industrial uses and the specific uses
proposed on site of the new lot will be reviewed under the Site Plan Review

requirements, as listed in the Weld County Zoning Ordinance.
2. C.Goal 3 states: "Ensure that adequate public services and facilities are
available to serve the commercial development or district." The
development will be serviced by the City of Greeley for sewage disposal and
the water supply is supplied by the North Weld Water District. The
development lies within the Greeley Fire Protection District.
4.6.9.2 B. That provisions have been made to preserve prime agricultural land. The site has an
existing industrial business with two large buildings and this proposal is to seperate
the two existing structures onto separate lots.
4.6.9.3 C. That provisions have been made for public water supply that is sufficient in terms of
quantity, dependability, and quality to provide water for the minor subdivision
including fire protection. The water supply is served by the North Weld Water
District. The Greeley Fire Protection District reviewed this proposal and conditions
of approval address any concerns.
4.6.9.4 D. That public sewage disposal system is proposed, provision has been made for the
system and, if other methods of sewage disposal are proposed, evidence that such
systems will comply with state and local laws and regulations which are in effect at
the time of submission of the minor subdivision. The site has an existing sewage tap
to each building.
4.6.9.5 E. That all areas of the minor subdivision which may involve soil or topographical
conditions presenting hazards or requiring special precautions have been identified
by the subdivider and that the proposed uses of these areas are compatible with such
cnditions. The proposed lots have existing structures that have been reviewed
through the Site Plan Review and Flood Hazard Development processes. Any new
construction on either of the proposed lots will be subject to a new Site Plan Review
applicaion submittal.
4.6.9..6 F. That streets within the minor subdivision are adequate in functional classificaton,
width, and structural capacity to meet the traffic requirements of the minor
subdivision. All roads within the minor subdivision shall be a minimum of eighteen
(18) feet in width and shall have a minimum depth of four (4) inches of gravel base.
The access to each proposed lot is directly from Cherry Avenue. There is not
proposed road within the minor subdivision. The Weld County Public Works
Department and the Greeley Fire Protection District reviewed this proposal and their
comments and concerns are addressed in the conditions of approval.

4.6.9.7 G. That off-site street or highway facilities providing access to the proposed minor
subdivision are adequate in functional classification , width, and structural capacity
to meet the traffic requirements of the minor subdivision. The proposed lots each
have existing access onto Cherry Avenue. The Weld County Public Works
Department reviewed this request and their comments are addressed in the conditions
of approval.
4.6.9.8 H. That the construction, maintenance, snow removal, and other matters pertaining to
or affecting the road and rights-of-way for the minor subdivision are the sole
responsibility of the land owners within the minor subdivision. This proposal does
not have a common road or rights-of-way that will be affected by this standard.
4.6.9.9 1. That the minor subdivision is not part of or contiguous with a previously recorded
subdivision or unincorporated townsite.
4.6.9.10 J. That there will be no on-street parking permitted within the minor subdivision.
4.6.9.11 K. That no additional access to a county, state, or federal highway will be created. The
access to the proposed lots are existing and no additional access will be created.
4.6.9.12 L. That the ingress and egress to all lots within the minor subdivision will be to an
internal road circulation system. The access to the proposed lots are have been
reviewed by the Weld County Public Works Department.
4.6.9.13 M. That facilities providing drainage and stormwater management are adequate. The
drainage and stormwater management of the site was reviewed by the Weld County
Public Works Department through the Site Plan Review application process. Any
changes to the site will require further review by the Public Works Department.
4.6.9.14 N. That the maximum number of lots within the minor subdivision will not exceed five
(5) lots. The proposed minor subdivision is for two (2) lots.
4.6.9.15 O. That the minor subdivision will not cause an unreasonable burden on the ability of
local governments or districts to provide fire and police protection or other services.
4.6.9.16 P. The subdivision will not have an undue adverse effect on wildlife and its habitat, the
preservation of agricultural land, and historical sites.
This recommendation is based, on part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.

The Minor Subdivision Final Plat is conditional upon the following:
1. The Minor Subdivison Final plat map shall be submitted to the Department of Planning
Services for recording within 30 days of approval by the Board of County Commissioners.
2. Prior to recording the Change of Zone plat:
a. The Final plat shall meet all requirements of Sections 4.5.21 of the Weld County
Subdivision Ordinance.
b. Written evidence shall be submitted to the Department of Planning Services that the
applicant has attempted to comply with the conditions listed in the letter from Greg
Thompson with the City of Greeley, dated November 27.
c. The applicant shall submit written evidence to the Department of Planning that the
items listed in the memo from Don Carroll of the Weld County Public Works
Department dated November 12, 1996 have been addressed.
d. The plat shall be amended to meet the requirements of the Weld County Utility
Advisory Committee.
3. The Minor Subdivison Final Plat is conditional upon the following and that each be placed
on the Final plat as notes prior to recording:
a. Foundations within the ARC Minor Subdivison shall be engineered per the 1994
building code requirements.
b. The site shall maintain compliance, at all times, with the Flood Hazard Overlay
District.
c. The site shall maintain compliance at all times with the requirements of Weld County
Public Works, Greeley Fire Protection District, Weld County Health Department,
Colorado Department of Transportation,Department of the Army Corps of Engineers
and North Weld Water District.
d. The site shall maintain compliance at all times with the Airport Overlay District.
e. Installation of utilities shall comply with Section 12 of the Weld County Subdivision
Ordinance.
f. The lots within the ARC Minor Subdivision shall maintain compliance, at all times,
with Sections 23 and 40 of the Weld County Zoning Ordinance.

Subject: S-410 - Request for a Minor Subdivision Final Plat(2 lots in 1-3 District)ARC Subdivision on
a parcel of land described as Lot B of RE-1536, located in the SE4 of Section 4, TSN, R65W
of the 6th P.M., Weld County, Colorado.
Dear Mr. Coleman:
Your application and related materials for the request described above are complete and in order at the
present time. I have scheduled a meeting with the Weld County Planning Commission for Tuesday,
December 17, 1996, at 1:30 p.m. This meeting will take place in the Weld County Centennial Center, 915
Tenth Street, Greeley, Colorado. In addition, I have scheduled a meeting with the Weld County Utilities
Advisory Committee for Thursday, November 14, 1996, at 10:00 a.m. This meeting will take place in the
Weld County Administrative Offices, 1400 N. 17th Avenue, Greeley, Colorado.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within
three miles of the property in question or if the property under consideration is located within the
comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the
submitted materials to the City of Greeley Planning Commission for its review and comments. Please call
Community Development Department, in Greeley, at(970) 350-9780 for information regarding the date,
time.and place of the meeting and the review process. It is recommended that you and/or a
representative be in attendance at each of the meetings described above in order to answer any questions
that might arise with respect to your application.
A representative from the Department of Planning Services will be out to the property a minimum of ten
days prior to the hearing to post a sign adjacent to and visible from a publicly maintained road right-of-way
which identifies the hearing time, date, and location. In the event the property is not adjacent to a publicly
maintained road right-of-way, one sign will be posted in the most prominent place on the property and a
second sign posted at the point at which the driveway (access drive) intersects a publicly maintained road
right-of-way.
The Department of Planning Services' staff will make a recommendation concerning this application to the
Weld County Planning Commission. It is the responsibility of the applicant to contact the Department of
Planning Services office a few days before the date of the hearing to obtain that recommendation.
