Subject: S-410, ARC Development Minor Subdivision
The Weld County Public Works Department has reviewed this proposal; the following comments
are recommended to be a part of any approval:
1. On Item 4.2.11., Minor Subdivision Section, the subdivision ordinance requires that a
vicinity map be placed on the mylar.
2. On Item 4.2.12.3,the existing topography contours need to be identified at 10 foot intervals.
3. On Item 4.5.15., documentation of an existing easement or dedication of right-of-way to Lot
2 is needed.
4. Weld County Road (WCR)43 (aka Cherry Avenue)has an existing right-of-way of 60 feet.
The Comprehensive Plan is identifying this stretch of highway to be labeled as a Collector,
which needs a right-of-way status of 80 feet. An additional 10 foot length needs to be
dedicated to accomplish this status at this location for future expansion.
5. Under Item 20 in the County questionnaire, B2, Sight Distance, the applicant has addressed
the improvements to the access road entering on to Cherry Avenue. This addresses stopping
at a 90° angle to the road for best visibility to the north.
6. Item 34, in the County questionnaire, the applicant has indicated that a final drainage plan
was prepared by McRae & Short dated January 13, 1995. This was not included in the
packet. Please provide this item.

lots in 1-3 District)ARC Subdivision. The parcel of land is described as Lot B of RE-1536, located in the 8E4
of Section 4, T5N, R65W of the 6th P.M., Weld County, Colorado. The location of the parcel of land for which
this application has been submitted is north of and adjacent to 8th Street; west of and adjacent to Cherry
Street.
The application is submitted to your for review and recommendation. Any comments or recommendation you

Dear Mr. Hodges:
This letter concerns the ARC Subdivision project as shown above, located in Section
4, Township 5 North, Range 65 West, Weld County, Colorado.
Your project has been reviewed in accordance with Section 404 of the Clean Water
Act under which the U.S. Army Corps of Engineers regulates the excavation and discharge
of dredged and fill material into waters of the United States including wetlands.
Reference is made to a November 14, 1996 wetlands determination conducted by Mr.
Terry McKee of this office. During Mr. McKee's site visit, it was found that no wetlands
exist at this site.
This letter is to inform you that the proposed activity, assigned number 199681101,
will not require a Department of the Army (DA) Permit.
Although a DA Permit will not be required for the project, this does not eliminate the
requirement that other applicable federal, state, and local permits be obtained as required.

Subject: S-410 ARC Minor Subdivision
Dear Todd:
On a 5-0 vote, the City of Greeley Planning Commission unanimously recommended approval for
the minor subdivision, with the following conditions:
1. A paved (either asphalt or concrete surface) 20-foot-wide access to Lot 2 shall be
provided, so minimal fire protection requirements can begin to be addressed.
The applicant indicated the access easement would be increased to 30 feet with an
18-foot graveled road, but to adequately fight fires on Lot 2, the Fire Department
requires a 20-foot-wide asphalt or concrete surface. There is currently insufficient
water flow for fire fighting purposes, which makes access all the more critical.
2. The site shall meet the Water and Sewer Department requirements for Lot 2, which
means either annexation or reconfiguring Lot 2 so it is contiguous to the existing
sewer line.
Sewer service is typically not provided to properties located outside the City limits.
This 17-acre site was permitted to have one tap with two connections because the
property was contiguous with an existing sewer line in 8th Street. Lot 2 would not
be adjacent with the sewer line and therefore would not be permitted to receive
sewer service.
3. 60 feet of right-of-way on the west side of the centerline of Cherry Avenue and
300 feet north of the intersection with 8th Street shall be dedicated. Additionally,
15 feet of right-of-way shall be dedicated along the balance of the property adjacent
to Cherry Avenue.

Cherry Avenue is identified as a minor arterial on our recently adopted
Transportation Master Plan. The requested right-of-way is the minimum required
to ensure adequate access to this site and future development in this area.
Additional right-of-way was also requested at the Sketch Plan phase, and the
applicant verbally indicated a willingness to provide the necessary right-of-way.
4. The site shall comply with the Entryway Master Plan guidelines, which entails
installing a landscape plan that has quads of trees every 50 feet, and if the site is
to be fenced, a split-rail fence or its equivalent shall be provided along 8th Street.
Additionally, a perimeter treatment plan shall be put in place for property adjacent
to Cherry Avenue.
The Entryway Master Plan is designed to provide a unified development theme and
attractive entryways into the City. Admittedly, this corridor does not currently
provide the minimum amount of landscaping necessary, but new development, such
as this proposal should meet the minimum standards. As this area develops, these
requirements will be requested on each parcel. Additionally, this has been
mentioned to the County on this property on two different occasions - for the
sketch plan and the site plan review. A perimeter treatment plan is required for
any subdivision which is adjacent to an arterial or collector street and, as noted
earlier, Cherry Avenue is designated as a minor arterial.
