RESOLUTION
RE: APPROVE RELEASE OF PORTION OF COLLATERAL IN THE AMOUNT OF
$104,693.00 FOR LIND LAND COMPANY(S #326)
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated April 14, 1993, the Board did approve an Off-Site and On-
Site Improvements Agreements According to Policy Regarding Collateral for Improvements with
Lind Land Company concerning property described as a tract of land situated in part of the NE%
of Section 8, Township 5 North, Range 67 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, pursuant to said agreement, Surety Bond No. 19SB100762034BCA,
underwritten by The Aetna Casualty and Surety Company, Hartford, Connecticut 06115, in the
amount of$106,693.00, was submitted to Weld County, and
WHEREAS, Martin Lind, Lind Land Company, has presented the Board with a request for
release of a portion of warranty collateral for completion of improvements, in the amount of
$104,693.00, and
WHEREAS, after study and review, and based upon the recommendations from the
Departments of Planning Services and Public Works, the Board deems it advisable to approve said
request for release of said portion of collateral in the amount of $104,693.00 to Lind Land
Company.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that a portion of collateral, in the amount of$104,693.00, held by Surety Bond
No. 19SB100762034BCA, underwritten by The Aetna Casualty and Surety Company, Hartford,
Connecticut 06115, in the total amount of$106,693.00, be, and hereby is, released.

Subject: Release of collateral for on site and off site improvements for Lind Land Company,
case number S-326 located in part of the Northeast '/4, of Section 8 Township 5 North,
Range 67 West of the 6th P.M., Weld County, Colorado
Dear Commissioners:
The improvements for Windsong Ranch Subdivision have been completed except for storm
water detention and the replacement of some landscaping that did not thrive. Martin Lind is
requesting that the collateral and warranty collateral be released on all improvements except for
the storm water improvements. All improvements except for storm water were inspected March
3, 1994 and again May 25, 1995.
Department of Planning Services staff recommend that the Board of County Commissioners
release $104,693.00 of the $106,693.00 collateral that is being held. This would retain
$2,000.00 for the installation of the storm water improvements that are required and insure the
replacement of the landscaping that did not thrive.

Windsong Ranch; Request for Bond Release for
subject: Public Improvements S-326
At the request of the applicant, I did a follow-up inspection of Windsong Ranch on WCR 17. This
inspection was formerly done on March 3, 1994. Keith Schuett,Planning Department, and I visited
the site and inspected the stormwater facilities and retention pond areas that were not completed in
the last inspection. We met with Mr. Lind on site and discussed the retention area adjacent to
WCR 17. The outlet structure in tube was not in place at that facility. We agreed to place the outlet
tube through the existing dike riprap at the bottom of the tube to form a grassline swale to the north
with ditch checks to slow any released water. Mr. Lind will contact with Keith Schuett when this
is complete to arrange a follow-up inspection.
I have no conflict with releasing all the items in Exhibit A that the Weld County Public Works
Department would be responsible for except the retention pond section. At such time this is
completed, I will re-inspect the area and act accordingly.

Dear Keith:
As per our conversation of May 24, 1995, on site at Windsong Ranch, I am formally
requesting release of my Public Improvement Collateral, except for the Storm Water
Detention amount. I will install the culvert that we discussed immediately, weather
permitting, and I will call for your inspection at completion. Also, since all other
improvements were inspected and approved by our staff over one year ago, I would suggest
and request that the one year, 10% warranty period would not be applicable to this Release
of Collateral.
