Box 758 CLEF;: Greeley, Colorado 80632 TO THT '- Ref: Ramsay-Shockey Open Space Dear Commissioners: This letter is to confirm the concepts agreed to at our meeting of Oct. 28, 1996. Please let me know if there are any differences in perceptions. I will deed to Weld County the land (approx. 29 acres), irrigation water rights, water tap, if transferable, and any existing mineral rights. Weld County will develop this land for use as open space according to the plans that were presented to me at that meeting. 1997 was to be the year of development. Weld County will agree contractually to items on my agenda: 1. Ownership and Use, 2. the property named "Ramsay-Shockey Open Space", 3. Boulder and Plaque. Copy of that agenda inclosed. Weld County will send a release of liability per agenda. Weld county will send to me the necessary legal requirements for transfer. I have since talked to my lawyer. It is his opinion that the county has its own forms for transfer and the standard residential forms will not be used. I have contacted Saundra McAviney of the American Council of the Blind of Colorado informing her that I have included her letter in the agenda. She may want to contact you at a later date. The concept of this property is to be "nature area" and not playground or ball fields. Human involvement will be pedestrian, horseback riding and biking. Ownership and Use Assets will revert to Robert Ramsay or his heirs if Weld County fails to adhere to the following conditions: Assets cannot be sold or transferred in any manner, Assets are used only as "Open Space", No mining or oil drilling on the land, royalties will go to Weld County if drilling occurs on other property that draws oil from this property. 2. Property is to be named "Ramsay-Shockey Open Space". 3. Boulder and Plaque Boulder and three stones have been placed on property, plaque ordered but not mounted on boulder. Plaque has the names of Kay Ramsay (wife), Florence Shockey (mother in law) and Philip Shockey (brother in law), and a poem written by Kay Ramsay (see other page). Cost of boulder, stones and plaque paid by Robert Ramsay. Weld County is to maintain a line of sight view from the boulder/plaque to Mt. Audubon, sight of Phil's crashed airplane, and Longs Peak. Both views exist at this time. Boulder/plaque cannot be removed from or relocated on the property. Access must be available from Weld County for the maintenance of the boulder/plaque. 4. Emphasis of the open space will be on "nature area", not playground, ballfields or park. 5. Human Involvement Pedestrian activities and horseback riding are permissible. Bikes, skateboarding, and motorized vehicles are not permissible. Hunting, fishing and boating are not permissible. 6. Weld County will release any liability resulting from this property from Robert Ramsay or his heirs. 7. Enhancement of this property for blind persons should be considered. (see letter) 8 I will need from Weld County their legal considerations for the transfer of this property. Hello
