The site is approximately 700 feet south of the Greeley city limits, and is located within the Mid-Range Expected Service Area, where annexation and development is likely to occur sometime in the next five years. The City of Greeley Planning Commission met earlier today, reviewed this proposal, and recommended approval of the proposal with three conditions; 1. There should be one 16-square foot freestanding sign rather than the two proposed. The sign could have sign faces back to back. 2. The hours of operation should be limited to 10:00 a.m. to 6:00 p.m., Tuesday through Sunday, without additional unspecified hours. 3. The use by special review permit should either be limited to 5 years and reviewed again, or the use should not be transferable. Additionally, in conversations with Mrs. Mueller, she indicated the "coffee house" and "home shops" mentioned in the application were not proposed with this use by special review. The City reviewed this request without considering either of these uses. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. 3. The maximum permissible noise level shall not exceed the residential limit of 55 db(A) as measured according to 25-12-102, Colorado Revised Statutes. 4. Adequate toilet facilities shall be provided for the public. 5. The Weld County Health Department was unable to locate a permit for the existing septic system. This system must be permitted. The system must be reviewed by a Colorado Registered Professional Engineer and a copy of that review submitted to this Division, before apermit can be issued. I have reviewed the application, spoke with the applicant and visited the site. I have the following comments: The access is off of East 16th Street, which is a graveled easement road. The placement of the signs need to be the proper setback from East 16th Street to provide a good site distance for the traffic entering the County Road. The applicant should maintain the weed height on both sides of the easement approaching the proposed art gallery. The off-street parking appears to be adequate for the facility with turnaround capability.
