HomeMy WebLinkAbout982028.tiff RESOLUTION RE: APPROVE REESTABLISHMENT OF THE WELD COUNTY DRUG TASK FORCE COMMITTEE ON DISPOSITION OF FORFEITED PROPERTY, PURSUANT TO SECTION 16-13-702, C.R.S., AND RESCIND RESOLUTION APPROVING CREATION OF WELD COUNTY SHERIFF'S DEPARTMENT COMMITTEE ON DISPOSITION OF FORFEITED PROPERTY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado Statutes and the Weld County Home Rule Charter, it is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Section 16-13-702, C.R.S., as amended, mandates the creation of a committee for the disposition of forfeited property, and WHEREAS, by Resolution #930086, dated January 20, 1993, the Board established the Weld County Drug Task Force Committee on Disposition of Forfeited Property to comply with the requirements of Section 16-13-702, C.R.S., as amended, and WHEREAS, by Resolution #971045, dated June 2, 1997, the Board erroneously rescinded said Resolution #930086, with the understanding that the function of disposing of forfeited property for the Weld County Drug Task Force would come under the jurisdiction and authority of the newly created Weld County Criminal Justice Advisory Committee, and WHEREAS, it is now clear that said Resolution #971045, should have rescinded Resolution #930128, dated February 3, 1993, which established the Weld County Sheriff's Department Committee on Disposition of Forfeited Property, and made said forfeiture disposition duties come under the jurisdiction and authority of said Weld County Criminal Justice Advisory Committee, and WHEREAS, it is now the desire of the Board of County Commissioners to reestablish the Weld County Drug Task Force Committee on Disposition of Forfeited Property, in order to comply with the requirements of Section 16-13-702, C.R.S., as amended, rescind Resolution #930128, dated February 3, 1993, which established the Weld County Sheriffs Department Committee on Disposition of Forfeited Property, and make said forfeiture disposition duties come under the jurisdiction and authority of said Weld County Criminal Justice Advisory Committee. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County that: 1. The Weld County Drug Task Force Committee on the Disposition of Forfeited Property ("Task Force Committee") be, and hereby is, reestablished. 2. Said Task Force Committee shall consist of three members, as follows: A. The District Attorney of the 19th Judicial District, or a designee thereof. B. The Chairperson of the Weld County Drug Task Force, or a designee thereof. 982028 SD S00016 C. One representative selected from the local governmental entities participating in the Weld County Drug Task Force. 2. The local government member of the Task Force Committee shall be changed every two years. Selection of a new Task Force Committee member shall be made from nominees submitted by the participating local governmental entities which do not currently have representation on the Task Force Committee. For the purposes of this Resolution, "local government" shall be defined as local governmental entities which are funding agencies for law enforcement offices and/or departments that are members of the Weld County Drug Task Force. 3. Any local government that is a funding agency for law enforcement offices and/or departments which is a member of the Weld County Drug Task Force may recommend to the Task Force Committee any individual for service on said Committee. Said recommendation shall be made no later than 60 days prior to the termination of each two year term. BE IT FURTHER RESOLVED by the Board of County Commissioners that Resolution #930128, dated February 3, 1993, be, and hereby is, rescinded. BE IT FURTHER RESOLVED by the Board of County Commissioners that the Weld County Sheriffs Department Committee on Disposition of Forfeited Property be, and hereby is, eliminated, and the duties of ensuring compliance with the requirements of Section 16-13-702, C.R.S., as amended, be, and hereby are,transferred to the Weld County Criminal Justice Advisory Committee. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 21st day of October, A.D., 1998. You may recall that when we set up the Weld County Criminal Justice Advisory Committee in June, 1997, it was intended that the old"Weld County Sheriffs Department Committee on Disposition of Forfeited Property"was to be eliminated,with the SO forfeiture duties to then be performed by the new Criminal Justice Advisory Committee. The June 2, 1997, Board Resolution recinded what we thought was the right Resolution that created the old SO Forfeiture Committee. Unfortunately, it referred instead to the Resolution which created the Weld County Drug Task Force Committee on Disposition of Forfeited Property. Wrong. So,to correct the mixup,the attached Resolution is proposed. Please read and let me know if it is OK to you.
