Re: Joint Resolution with the Town of Erie
Dear Mayor Berens:
The Board of County Commissioners of Weld County, Colorado, has received your letter of
July 14, 1998, and a copy of the Joint Resolution Concerning Annexations Involving Certain
Properties in Weld County Between the Town of Erie and the City of Broomfield, Colorado.
The agreement in the Joint Resolution to an annexation boundary line and the joint pursuit of
an intergovernmental agreement("IGA") covering the various topics in the Resolution
appears to obviate Broomfield's request set forth in your July 14, 1998, letter, for Weld
County to object to the annexation of Weld County Road 7. The Board of County
Commissioners appreciates the municipalities' spirit of cooperation evident in the Joint
Resolution and looks forward to working with you and Erie on the IGA.
Please feel free to call either Commissioner Barbara Kirkmeyer, at (970) 356-4000, ext.
4200, or Bruce T. Barker, Weld County Attorney, at (970) 356-4000, ext. 4390, when the
municipalities are ready to begin the IGA discussion with Weld County.

Dear Commissioners:
As you know, Weld County, Broomfield, and Erie had discussed the possibility of
working on an intergovernmental agreement. Broomfield proposed to Erie a
moratorium on municipal annexations in the involved area pending completion of
the IGA.
The Erie town board has decided to proceed with certain annexations as shown
on the attached map, marked Enclosure #1. These proposed annexations seem
to be defensive annexations and do not seem to be based on sound planning.
Rather than engaging in an "annexation war," Broomfield would prefer to work on
an intergovernmental agreement and we stand ready to do so. However, Erie's
proposed annexations are not conducive to constructive and positive
intergovernmental relations.
As shown on Enclosure #1, one of Erie's proposed annexations involves
annexing south along Weld County Road 7, and then easterly. We would
request that Weld County object to this annexation of County Road 7 because
the annexation does not involve any immediately contiguous property and serves
as the basis for what we believe is an awkward and ill-conceived annexation.
The Erie town board will hold a public hearing on the proposed annexations on
July 23, 1998. We respectfully request that at the public hearing, Weld County
formally object to Erie's proposed annexation of Weld County Road 7 for the
reasons previously noted.
