HomeMy WebLinkAbout981221.tiff RESOLUTION RE: APPROVE REVISION TO SOCIAL SERVICES OPERATIONS MANUAL, SECTION 1.004, CIVIL PROCESS POLICY AND PROCEDURES WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Department of Social Services has presented a revision to its Operations Manual, Section 1.004, Civil Process Policy and Procedures, to the Board of County Commissioners of Weld County, for consideration and approval, and WHEREAS, after review, the Board deems it advisable to approve said revision, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, ex-officio Board of Social Services, that the revision to Operations Manual, Section 1.004, Civil Process Policy and Procedures, for the Department of Social Services, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said revision. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 13th day of July, A.D., 1998. Griego, Director, Social Services.; /.' iOt,,,,,T RE: Revision to the Weld County Department of Social Services Operations Manual - Section 1.004, Civil Process Policy and Procedures Enclosed for Board approval is a revision to the Weld County Department of Social Services Operations Manual, Section 1.004, Civil Process Policy and Procedures. The purpose for the revision is to: 1. Identify the requirements for firms that will provide process service for the Department of Social Services. 2. Establish the maximum fee payments that the Department of Social Services will pay to firms that are providing process service. 3. Identify the procedures by which the Department will engage firms and law enforcement agencies to provide process service. This service will not go through a bid process. If you have any questions, please telephone me at extension 6510. 981221 1.004 Civil Process Policy and Procedures Added 6/98 1.004.1 Requirements of Process Services 1. Must be at least eighteen years of age. 2. Must show proof of a valid Colorado Driver's License. 3. Must show proof of motor vehicle insurance. 4. Must clear a CCIC criminal history check, including fingerprinting at their own expense. 5. Must not have a conflict of interest with the Weld County Department of Social Services or persons served. 6. Must maintain the confidentiality of the persons served and the nature of the papers served. The Civil Process Coordinator will advise the process servers of confidentiality requirements in writing and require that a confidentiality form be signed. 7. Must meet a minimum performance standard regarding timeliness of service. The Civil Process Coordinator will evaluate effectiveness of the process servers in conjunction with input from the units requiring service. 8. Must submit a current resume including names, dates of birth, and Social Security number of all employees that will be serving papers for the Department. 9. Must submit a monthly itemized statement to the Department for payment. 1.004.2 Fees 1. Maximum payment for a successful service within a ten mile radius of downtown Greeley shall be paid at the rate of$18.50. Maximumyment for service outside the ten mile radius shall be $22.00. A NON EST (unserved) shall be paid at a maximum rate of$8.50. 2. Maximum mileage will be paid at the current County rate of$.27 per mile. 3. In the event two or more papers are delivered to one address at one time, payment will be made at the prevailing rate for the first paper and $8.50 for each paper thereafter. 4. If two or more papers are delivered to one address at one time, mileage will be paid only once. 5. Service outside of Weld County by Sheriff's Department shall be paid at the prevailing rate as set by Colorado House Bill 96-1231 (effective September 1, 1996). 6. Service of papers outside of Colorado must be pre-paid to the appropriate Sheriff's Department. 1.004.3 Procedures Process serves are not employees of Weld County and must not refer to themselves as such when contacting the public. Four process servers (companies) will be utilized by the Civil Process Coordinator. This number was judged to be ideal in both its effectiveness and its fairness to the servers. Preference will be given to those servers who are currently active. Applications will be taken for two more servers to act in a backup role. When and if one of the original four companies drops out, a replacement will be chosen from the two backup companies. Law enforcement agencies will not be included as part of the above six servers. qgj9, c;Li Hello
