QUENTINE AVENUE AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Quit Claim Deed and Second Amendment to the Intergovernmental Agreement for the Improvement of Weld County Road 21, a.k.a. Quentine Avenue, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Public Works Department, and the Town of Milliken, with terms and conditions being as stated in said deed and amendment, and WHEREAS, after review, the Board deems it advisable to approve said deed and amendment, copies of which are attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Quit Claim Deed and Second Amendment to the Intergovernmental Agreement for the Improvement of Weld County Road 21, a.k.a. Quentine Avenue, between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Public Works Department, and the Town of Milliken be, and hereby are, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said deed and amendment. Box 290, Milliken, Colorado 80543, and the County of Weld. Colorado, by and through the Board of County Commissioners of the County of Weld ("County"), whose address is 915 10th Street, P.O. Box 758, Greeley, Colorado 80632. WITNESSETH: WHEREAS, on December 18, 1996, the parties hereto entered into an Intergovernmental Agreement for the Improvement of Weld County Road 21, a.k.a., Quentine Avenue ("the Agreement"), for the purpose of agreeing to various improvements and the sharing of the costs of said improvements, to Weld County Road 21, a.k.a., Quentine Avenue, between Broad and Green Streets, and WHEREAS, on March 4, 1998, the parties amended the Agreement to include increased costs of paving Quentine Avenue, between Broad and Green Streets, and WHEREAS, there is the need for a second amendment to the Agreement to reflect the fact that Town has decided to pave Quentine Avenue, from Broad Street south to the south east corner of Section 10, Township 4 North, Range 67 West of the 6th P.M., Weld County, Colorado. NOW, THEREFORE, in consideration of the mutual promises and covenants stated herein, the parties hereto agree to amend the Agreement as follows: Delete paragraph 2.d. of the Agreement, and add the following: 2. TOWN AGREES: d. To annex the west one-half('/z)of Quentine Avenue,from Broad Street south to the south east corner of Section 10, Township 4 North, Range 67 West of the 6th P.M., Weld County, Colorado, as shown on the plat which is attached hereto as Exhibit"A." Also enclosed is a copy of a letter which I sent to you dated September 3, 1998, regarding this Second Amendment, and a copy of a resolution approved and signed by the Board of County Commissioners of Weld County on September 21, 1998. As you can see, the Board approved and signed the Second Amendment. I am not quite certain where our systems broke down in terms of completing the Second Amendment, but I believe we are still waiting for the Town of Milliken to sign. I have brought your request to the attention of the Board of County Commissioners of Weld County. The Board expressed no objection to executing the quit claim deed, but suggested that I provide an amendment to the original Intergovernmental Agreement for the Improvement of Weld County Road 21, a.k.a., Quentine Avenue. Two originals of the proposed amendment are enclosed. Please review the proposed amendment and let me know if it is acceptable or if you have any suggested changes. DATE: September 2, 1998 RE: Deed for Quentine Avenue (WCR 21) to Town of COLORADO Milliken Attached are copies of a letter from Bruce Fickel, attorney for the Town of Milliken, Colorado; a Quit Claim Deed; and a plat entitled"Quentine Avenue (County Road 21) Annexation." As Mr. Fickel's letter explains, the Town desires to have Weld County deed to it the north half of Quentine Avenue,between Broad Street and the south east corner for Section 10-4-67. You may recall that Quentine Avenue,between Broad Street and Green Street, is the subject of an Agreement for paving and annexation, and an Amendment thereto. Copies of the Agreement and Amendment are attached. Pursuant to the Agreement, Milliken must annex Quentine between Broad and Green Streets. Part of the paving costs has been paid by the County. Apparently, Milliken has decided to extend the paving from Green Street south to the south east corner. That paving work is almost, if not entirely, completed. Milliken now desires to make certain that it owns that portion of the roadway which it has paved. I have no problem with the Board approving and executing the Quit Claim Deed for Milliken. The concern I have is that we should make certain that Milliken completes the annexation and maintains the newly paved Quentine Avenue as promised. Therefore, I recommend that we ask Milliken to sign a second amendment to the Agreement, whereby the additional stretch of roadway from Green Street to the section line is added for annexation and maintenance. A copy of the proposed amendment is attached. If it looks acceptable, I suggest that we send it to Milliken with the attached letter. j BieXn �T.
