LITTLE THOMPSON WATER DISTRICT, a Colorado quasi-municipal corporation,
Petitioner,
vs.
WILLIAM R SAULCY, JR., ERIC A. PETERSON,PERSONAL REPRESENTATIVE OF THE
ESTATE OF WILLIAM R SAULCY, SR., DECEASED, WILLARD G. JONES as Weld County
Public Trustee, and ART WILLIS, as Treasurer of Weld County,
Respondents.
The matter comes before the Court upon Stipulation of the Petitioner("Little Thompson"),
and the Respondent,William R Saulcy,Jr.,fee owner of the subject property("Saulcy"), individually
and by his attorney, and based upon such Stipulation and the default or disclaimer of the remaining
respondents after proper service by admission of service or personal delivery, the Court enters the
following Rule and Order:
1. Little Thompson and Saulcy have entered into a"Stipulation" regarding this matter,
and the Stipulation provides for the compensation to be paid for the taking and any and all damages
arising out of the taking and damages to the remainder of the property involved in this action.
2. The Respondent Eric A.Peterson, as Personal Representative of the estate of William
R Saulcy, Sr., Deceased, as lienholder under the deed of trust dated August 1, 1981, and recorded
August 4, 1981, in Book 943 at Reception No. 185367 has disclaimed any interest in this matter since
said deed of trust and the note it secures have been paid in full. The interest of Eric A. Peterson, as
Personal Representative of the estate of William R. Saulcy, Sr., Deceased, is therefore declared
released as to the property described in this Rule and Order.
3. Little Thompson is immediately hereby granted and conveyed the following property
and is immediately vested with possession of such property: •
A Fee Simple ownership of the parcel of real property'described on Exhibit "A" attached
hereto.

described on Exhibit"B" attached to this Petition. The purposes and uses of such easements and the
rights to be acquired hereunder shall be:
The sole, exclusive and permanent right to enter,re-enter,occupy and use the hereinafter described property to
construct,reconstruct,inspect,upgrade,increase line size or capacity,operate,repair,maintain,replace,remove and operate
one or more lines for the transmission,distribution and service ouster,and all underground and service appurtenances thereto,
including metering stations,vaults,enclosures,identification signs and other fixtures,over,across,under and upon the property
described on Exhibit"B"attached hereto. The following rights are also hereby included:
(a) The permanent right of ingress and egress over and across the easement for foot,vehicular,and other traffic.
(b) The right to grade the strip of land for the full width thereof,
(c) The right to install,maintain and use gates in all fences which now cross or shall hereafter cross the strip;
(d) The right to mark the location of the strip by suitable markers set in the ground;provided that any such
markers remaining after the period of construction shall be placed in fences or other locations which will not interfere
with any reasonable use the owner shall make of the strip;
(e) All other rights necessary and incident to the full and complete use and enjoyment of the right-of-way and
easement for the purposes herein granted;
(t) The owner shall not erect or place any permanent building,structure,improvement,fence or tree on the
described easement,and the Petitioner shall not be liable for their removal if they are so placed,and the owner shall,
at the owner's sole expense remove such items.
(g) The owner shall not diminish the ground cover over the waterlines and shall not substantially add to the
ground cover over the waterlines or their appurtenances.
(h) The owner shall not grant any other easement,right-of-way,permit or license upon,under or over said
property without the written consent of the District,which consent shall not be unreasonably withheld.
C. A temporary easement during the construction period for ingress and egress over and
across th6 property described on Exhibit "C" for foot, vehicular, and other traffic.
Real Estate tax responsibility shall be apportioned as provided by law.
4. The provisions hereof shall inure to the benefit of and bind the agents, tenants,
licensees, invitees, heirs, personal representatives, successors and assigns of the respective parties
hereto, and all covenants and agreements herein contained shall apply to and run with the land.
5. Little Thompson has duly and lawfully taken and condemned said real property,
easement and right of way as herein described pursuant to the statutes and the constitution of the
State of Colorado. A certified copy of the Rule and Order may be recorded and indexed in the office
of the Clerk and Recorder, Weld County, Colorado, in like manner and effect as if it were a deed of
conveyance from the Respondent Saulcy to Little Thompson for all of the property described in this
Rule and Order. Upon recording of this Rule and Order, the Notice of Lis Pendens dated December
15, 1997, and recorded December 17, 1997, at Book 1638 at Reception Number 2584909 shall be
merged into this Rule and Order; and the Notice of Lis Pendens shall be deemed to be ended.
