I have two concerns with the enlargement of the current facilities The first is the possible detrimental effects on local property values . The second would be the health hazards it could create. The facts of feedlots are this . The produce unpopular/ unhealthy smells , create prime insect reproduction sites , and can cause health hazards with groundwater contamination. This feedlot has always been close to the township of Hudson , but enlargement of the current facilities poses a risk to the entire population of Hudson while producing a profit for few. I belive in the rights of the owners to maintain the currently existing facilities but not to infrings on the rights of residents to maintain their current lifestyle. I am here to explain my objection to the expansion of the English Feedlot which is located within 500 feet of our property. I moved my family to this address July 4th weekend in 1968. I would like to point out what was at the site of the present feedlot when I first looked at the land and then built my home. We looked at the area closely and the small feeding operation at that time as well. There were approximately 500 head of cattle there. Only these pens marked in blue were here in 1968. We considered for a long time whether or not to buy the land from the old Scott place, but decided since we were born and raised on a farm a few head of cattle wouldn't bother us that much. So we proceeded and built our home. The few cattle were managed and cared for by the Gordon Farms. Then in 1970, Gordon Farms sold the property to Mr. Anschutz and in 1971 he applied for a permit to increase the number of head of cattle on the feedlot site to cap at 10,000. At that time a large group of surrounding property owners objected to the expansion, so the Weld County Commissioners voted to put a cap of ten thousand head at this site. There were several years in the '70's and early '80's that it was without any cattle at all. In approximately 1985 Mr. English began leasing the feedlot site from Mr. Anschutz. The operation has deteriorated as far as responsible management is concerned. We have seen drainage problems where cows were standing up to their knees in waste water in two large pens month after month, year after year. Instead of addressing the problem the stagnant waste water was fenced off and now this same area is called "containment ponds". There was one large ineffective containment pond built but has been allowed to deteriorate. The flies have been a constant plague and become more and more of them all the time. We finally went to the expense of screening in our back patio so that we could light our barbecue and cook hamburgers without being covered with flies all of the time. Our water supply is a shallow well which has almost double the suggested limit of nitrates. I am concerned about the preservation of good agricultural land and I appreciate the farming industry and would like to be a part of it but have never had that opportunity. However, I believe that ALL of us have a responsibility as good citizens to try to take care of our property and not to harm our neighbor with our operation. Doesn't agriculture have a responsibility to make sure our water is not contaminated? When Mr. English bought this feedlot he knew how many cows were allowed there with the existing permit. Our objectives are to provide education and information to residents , property owners , and government entities regarding growth-related changes , either proposed or in effect. that will impact our area of concern; and to protect and preserve the rural , agricultural , and small-community character currently representative of the area, while meeting the area' s needs for residential , commercial and agricultural growth. Within a two mile radius of the feedlot is some 350 to 400 residence, mostly to the south, southwest, and west . The residents presented a petition , containing more than 250 signatures, opposing the expansion of the feedlot to the Weld County Department of Planning Services. The department' s comment was something to the effect , "there is sizable opposition to the expansion of the feedlot but it has no bearing in this case. " Delivered to you were more than 80 letters from individual households opposing the expansion. Several residents were in the area prior to the creation of the feedlot and had no objection to its presence as it fit into the area. Many more moved into the area knowing of the existence of the feedlot and accepted its presence as fitting with area. These residents , working with the county commissioners in 1971 , established a cap of 10, 000 head of cattle as the maximum operating capacity of a feedlot for this area. The area has continued to grow, each residence accepting the 10 , 000 head cap. The area is made up of 2 1 /2 to 10 acre family homes sites , most with outbuildings, some with horses or a couple head of cattle or both , most well maintained. There are family farms , from 60 to 600 acres, mostly in hay or corn, some sugar beets, onions , pumpkins. etc . There are two small family dairies, and two nurseries. The area is not poor , but a long ways from being rich. It is very stable made up of hard working families who enjoy the unique character of this rural residential and agricultural area. What these families are concerned about is that this stability will be altered if the feedlot is permitted to double in size. particularly given its history of poor management. Residents directly across the street from the lot experience offensive odor many days a year , dust, flies, noise, and a road in continual disrepair due to cattle and feed trucks . The problem diminishes as you move out from the lot and the direction of the wind that day. The level of these conditions are presently acceptable as part of a residential agricultural area. Expansion however , will diminish this acceptability. Those with shallow wells express concern that the feedlot is a source of around water contamination and are fearful that their wells will become unusable if the lot is permitted to expand . In general , we believe that the proposed expansion is incompatible with the desires and life style of the neighboring properties and will adversely affect the stability of the area. This will also be my only opprotunity to ask questions , so I will be asking as many questions as came to mind after studing the development standards suggested for approval . T have given each of you a copy of my presentation as well as the applicant to make it easy to check off each question as it is answered. I would ask that each question he answered as fully as possible as I will not have the opprotunity to ask more questions later is this hearing. My first question is: What is the definition of Livestock Confinement Operation and how does it differ from Animal Feeding Operation? Why doesn 't this expansion come under the State Regulation 4^ 8^ 6 Best Management Practices "necessary for the reduction of impacts from the animal feeding operation"? Question on development standards: Number 3 - What is the approved dust abatement plan , when will it be put into effect , how often will the feedlot be checked and who will do the checking? Number 4 - How often will the liqued and solid waste be removed for final disposal , how will it be determined if the surface and groundwater has been contaminated and who will do the checking? Number 5 - How does the reguulation define permanent disposal , how will it be determined if there is permanent disposal , at this site , and who will do the checking? Number 6 - How often will compliance be checked and by whom? Number 7 - Where will the noise level be checked , who will do the checking and at what time of the day or night will someone answer the call of a noise complaint? Number 8 - What are NPDES permits and are any required for this application? Number 9 ' What discharge of run-off or other waste waters to surface or groundwater is acceptable by the Confined Animal Feeding Operations Control Regulations, who will be checking this, what method will be used and how often will it be done? Number 10 - We would like to have added the sentence: Any dead animals must be removed from the pens and hauled off with-in 24 hours of death, 1 972184 Number 11 ' Is the present stockpile of manure on a surface which is protective of State waters? If not will it be? And if the expansion is granted how long will it be before the State waters will be protected? How will this be checked , how often and who will do the checking? Number 12 - How will this be check , how often will it be checked and who will do the checking? Number 13 - How often will the records be inspected and who will do the inspecting? Number 15 - How will it be determined if flies are associated with the facility, who will do the determining and how often will it be determined? Number 16 - Are there septic system (s) on the property at present that are not in compliance? If so, will it/they be brought into compliance and when? Number 18 ' Who approves the manure and waste water management plan , how will it be checked , how often and who will do the checking? Number 19 - We would like to have added: The required permits shall be posted at the Main entrance on road 10. Number 20 - Who will check to see if they are in compliance with the Design Standards and how often will it be checked? Number 21 - Who will check to see if they are in compliance with the Operation Standards and how often will it be checked? Number 22 - Who will check to see if they are in compliance with the Supplementary Regulations for Livestock Confinement Operations and how often will it be checked? Number 23 - How often will this happen , with an appointment or without prior knowledge? Number 24 - Is this whole operation now a part of this Special Review, or are we only talking about the additional pens being planned in the expansion? Number 27 - The property owner or operator shall comply with all new regulations, that may be inac+ed , effecting Livestock Confinement Operations" Number 28 - The Weld County Health Department shall make at least one unannounced visit to the English Feedlot annually and the Department of Planning Services shall make at least one unannounced visit once every two years to determine if any violations exist. My reason for Number 26 : Road 10 will see about twice the traffic it does now if the expansion is granted. The county will not be able to send a grader out and the condition of the road will suffer along with those who have to use the road to get to and from their homes. I think the feedlot should be required to control the dust and grade the road. Number 27 and 28 : My fear is, as you will hear when many of the questions raised are answered , the control of this feedlot and other feeding operations is "complaint driven" " Many of these sstandards can not be checked by flying over the facility or standing at the edge of the road" If some of these standards are not checked , from time to time, damage can be done to the State waters that could go undetected for years" If it is discovered will the Public get the time tested explanation "They have been grandfathered in"?
