R. golly, County Attorney The minutes of the meeting of February 25th were read and there being no objections or corrections thereto, on motion they were ordered approved. /1 IN THE MATTER OF APPOINTMENT COUNTY TREASURER. /6s- RESOLVED, W. C. Levis' is hereby appointed County Treasurer of Weld -County, to fill %�2 the vacancy in the unexpired term, caused by the resignation of T. C. Phillips, the duly elected County Treasurer, and this resolution shall ratify the former resolution of the Board adopted February 23, 1922. And thereupon the Bond of said W. C. Levis in the sum of $100,000.00 with National -Surety Company as surety thereon, was presented t•o the Board, and the Board having examined same , and finding it sufficient and regular as to form, on motion it was ordered that said Bond be and it hereby is approved and ordered recorded. IN THE MATTER OF PAYMENT OF TAXES IN LIEU OF PAUPER RENT. CO, There was presented to the Board a petition signed by nu erous residents and tax payers of the town of Windsor, asking that the taxes upon lot 11, Block 15, of the Town of Windsor, amounting to $18.77, tie paid by Weld 'County. And it appearing to the Board that said lot is the property of Margaret and Jacob Burbach and t t the said Burbaohs have no other property or source of income and have been supported Weld County through i;auper aid. And the Board deeming it to the best interests of Weld aunty, it was on motion ordered that said taxes be paid in lieu of pauper rent and th9t warts t be draw therefor. RESIGNATION OF R. A. DIX AS ASSISTANT OVERSEER- R. D. 3- APPOINTMENT OF J. D. COOPER. On motion duly made, seconded and carried, it was ordered that J. D. Cooper be appointed Assistant Road Overseer in Road District #3, to fill the •iaoancy oeused by the resignation of R. A. Dix. Said appointment to be effective upon the approval of his bond in the sum of $2000.00, and 'to continue at the pleasure of the Board. Bids will he based on delivering material to crusher, ha ling and spreading on road. The County of Weld will furnish crushing plant and operate th same at the pit. The right is reserved to reject any or all bids and waiv such defects or informalities as mai occur in any bid should it be deemed to the interest the County to do so. M. , a territory not exceeding 36 square miles, stating their desir to oreate and fore said territory into a pest district for protection against prairie ©gs and ground squirrels, under the provisions of Chapter 95 of the Session laws of Colo ado, 1915. Said petition being verified by Osoar Barnes, and Emil Petterson, two of t signers thereto. On motion said petition was ordered filed. The Board hawing carefully considered the report of the viewers herein, as well as the objections made thereto, and finding the report correct as to form, and believing the • public good requires the laying out of the road as recommended by the viewers, it was on motion ordered that the report be approved and adopted, and the road therein desoribed and reoommended by the viewers be and is hereby declared a public highway. The Clerk is directed to record the report, plat the road, draw warrants in favor of parties for damages awarded, and cause notices to be posted of opening of said road, and notify the Road Overseer of proper District to open the same to travel in sixty days as required by law. IN THE MATTER OF UNPAID EXPENSE- PEST DISTRICT # 1 ' WELD COUNrY, COLORADO. Pest District No. 1. Resolution of Board of County Commissioners concerning Expense Bill and Assessment on Lands. Member Straight moved adoption of the following Resolution! WHEREAS, C. P. Gillette, State Entomologist , & Mason E. Knapp, County Pest Inspeotor of Weld County, Colorado, have oertified to this Board, and the Board of County Commissioners have duly found: That within Weld County, Colorado, the territory designated as Pest District No. One of Weld County is infested with a pest, to wit , prairie dogs, and the County Pest Inspect- or having made investigation of said premises and found the same so infested, and the County Pest Inspector having notified in writing the owners or persons in charge or control of the premises hereinafter particularly described, of the nature, extent , and location of the infestation, and having demanded that within a specified time certain specified work be done on the said infested premises for the extermination of such pests; And the occupants of the land hereinafter particularly described in Exhibit A having failed to do effective work on the premises in accordance with he instructions of the offioer in charge, and the County Peat Inspector having taken p seession of such infested premises. and having done the work necessary in 1921 for the ex erminat ion, of such pest, as provided by statute; AND WHEREAS, a proper petition, duly verified, has been tiled with the Board of County Commissioners at its meeting on the 9th day of May, 1921, by the requisite number of land owners within Township 9 North of Range 65, West of the 6 P. M. in Weld County, Colorado, asking for the formation of said township into a pest district , and no order having been made declaring such district not legally formed; And the County Pest Inspector having certified that he has oompleted said work for the year 1921 throughout said district, and having furnished a list , oopy of whioh is • hereto attached as Exhibit A, stating the names of the land owners whose lands are included in said district , their addresses so far as known, and a description of the lands owned by each, and the lands the owner of which is unknown; And the said County Pest Inspeotor having filed with the County Commissioners his certificate showing the necessity for suoh work, the reasonable costs and expenses thereof, and a description of the land or property upon which the work was done, to—wit, the lands hereinafter described in Exhibit A, and the amount of expenses due from each for such work of extermination of pests from said several lands, excousive of the amount paid the County Pest Inspeotor. IT IS THEREFORE RESOLVED That the Board of County Commissioners do now approve said expense bill and the assessment of the same against the several lands and owners as set forth in Exhibit A hereto attached, to which reference is made, and the county having paid the said expenses. IT IS RESOLVED Said list and certificate shall be, and is now certified to the County Treasurer of Weld County, Colorado, with direction that, pursuant to statutes in suoh cases made and provided, he shall mail a notice of the amount of suoh expense and assess ant to each land owner whose name and adiress is known. and he shall within thirty days after said notices are mailed, enter the amount of such assessments as are not paid.at the proper places on his tax rolls, and suoh amounts shall thereupon beoome a lien upon said respe^Live lands and shall be collected by the Treasurer in the same manner as taxes levied thereon. Said sum shall be increased by five per cent. if not paid on mailing suoh notice and shall bear interest at one per cent per month from the date of entry upon the tax rolls. Whereupon, said resolution was duly declared adopted and this certified copy thereof shall be authority and direction to the County Treasurer of Weld County_ Colorado, to proceed to collect such expenses and assessments and to enter the same upon his tax rolls. 4 v) 8 IN THE MATTER OF UNPAID y EXPENSE- PEST DISTRICT # 2 WELD COUNTY, COLORADO. Pest District No. 2. X01 i Resolution of Board of County Commissioners concerning Expense Bill and Assessment on Lands. Member Straight moved adoption of the following Resolution; WHEREAS, C. P. Gillette, State Entomologist , & Mason E. Knapp , County Pest Inspector of Weld County. M. in Weld County, Colorado. asking for the formation of said township into a pest district , and no order having been made declaring such district not legally formed; And the County Pest Inspector having certified that he has completed said work for the year 1921 throughout said district , and having furnished a list , Dopy of which is hereto attached as Exhibit A, stating the names of the land owners whose lands are included in said district , their addressee so far as known, and a description of the lands owned by each, and the lands the owner of whioh is unknown; And the said County Pest Inspector having filed with the County Commissioners his oerti- fioate showing the necessity for such work, the reasonable costs and expenses thereof, and a description of the land or property upon whioh the work was done, to wit , the lands herein— after described in Exhibit A, and the amount of expenses due from each for such work of extermination of pests from said several lands, exclusive of the amount paid the County Pest Inspector. IT IS THEREFORE RESOLVED That the Board of County Commissioners do now approve said expense bill and the assessment of the same against the several lands and owners as set forth in Exhibit A hereto attached, to which reference is made, and the county having paid the said expenses, IT IS RESOLVED Said list and certificate shall be, and is now certified to the County Treasurer of Weld County, Colorado. with direction that , pursuant to statutes in such oases made and provided, he shall mail a notice of the amount of such expense and assessment to each land owner whose name and address is known, and he shall within thirty days after said notices are mailed, enter the amount of such assessments as are not paid, at the proper places on his tax rolls, and such amounts shall thereupon become a lien upon said respective lands and shall be collected by the Treasurer in the same manner as taxes levied thereon. Tew and numerour others, praying for the laying P g p y n& h y n6 out of a public road described as follows, to-wit: Commencing at a point on the north line of Section 2€ , Township 1, North Range 63. which is 100 feet West of the high water line of the Olds Reservoir as tie same is filed in the office of the State Engineer of Colorado, which point is about 1000 feet due west from the northeast corner of said Section 2e3, and extending thence south along and 100 feet from and above the high water line of slid reservoir about 1000 feet , to a point 100 feet south of the southernmost part of said reservoir; thence due east to a point in NW4 of 1114 Section 27 , Township 1, North Range 63, which is 100 feet east of the southeast extremity of said reservoir; thence northerly along and 100 feet east of the high water line of said reservoir to the southeast extremity of the dam of said reservoir as shown on the map there- of as filed; and thence along and over the line of said dam to the Public Highway on the west line of Section 22, Township 1, North Range 65. There was presented to the Board the written request of H. G. Winters and Company. R heretofore awarded the contract for Pauper Burials for the year 1922, for the annulment of said contract. And it appearing to the Board that said H. G. Winters and Company are located at Fort Lupton ard that a majority of the pauper burials occur 1.n Greeley and that ,) burials are required in Linn Grove Cemetery at Greeley, and that the inconrenienoe occasioned to the contractor, as well es to the public, on account of the place of business of said contractor being located away from Greeley, and the Board having thoroughly disoussod and considered said ratter, on motion it was ordered that the request of said H. RESOLUTION OF ACCEPTANCE. 156 WHEREAS, the UNION PACIFIC RAILROAD COMPANY has tendered to the COUNTY OF WELD, ,((\ D STATE OF COLORADO, a lease of a portion of the right of way of said Union Pacific Railroad Company in Weld County, Colorado, which lease is in words and figures as follows, to-wit: "THIS AGREEMENT. made and entered into, in duplicate, this 14th day of April, 1922, by and between the UNION PACIFIC RAILROAD COMPANY, a corporation of the State of Utah, (hereinafter called "Lessor") , party of the first part , and the COUNTY OF WELD, STATE OF COLORADO, ( hereinafter called "Lessee") , party of the second part . WITNESSETH: RECITALS: The Lessee maintains three public highway crossings over the right of way and ,.track of the Railroad Company in the North Half of Section Eight , Township Four North. As a consideration for this lease , the Lessee is (a) to pay in advance Lo the Lessor five dollars ($5.00) per annum; (b) to move those portions of the five ditches which extend across the leased premises in the looation shown by broken red lines on said Exhibit A, to the new locations shown by yellow lines thereon, including the construction of the necessary culverts or bridges, to conduct the same across the highway which is to be located on the leased premises ( the Lessee to thereafter maintain such culverts or bridges) ; (c) to undertake and do all necessary grading in a manner satisfactory to the Railroad Company; (d) to assume all taxes and assessments levied upon the leased premises during the continuance of this lease, not including taxes or assessments levied against the leased premises as a component part of the Railroad property of the Lessor in the state as a whole; (e) to keep the leased premises free from combustible material; (f) to plant no trees or shrubbery, and to erect no structures thereon except such os may be necessary for highway purposes; (g) to put nothing upon the leased premises which might obstruct or interfere with the view; (h) to provide such culverts and bridges as may be necessary to properly care for the drainage from said premises and the adjoining right of way of the Lessor: ( i) to hold the Lessor harmless from any and all damages to any bridges or culverts on said leased premises arising from fire caused directly or indirectly by sparks or fire emitted from the engines or trains of the Lessor; and ( j) to further hold the Lessor harmless from any damages to the highway upon the leased premises which may result from the oonstruotion or maintenance of drainage ditches or waterways by the Lessor. The Lessor reserves the right to take temporary or permanent possession of all or any portion of the leased premises whenever their use may become necessary or expedient , in the judgment of the Lessor, for railroad purposes, including the location of public or private warehouses, elevators or other structures with the design to facilitate and promote traffic; PROVIDED, however, that in the event the Lessor elects to take permanent possession of all or any portion of the leased premises in accordance with this reservation, it shall first serve upon the Lessee ninety (90) days' written notice of such election. Nonuser by the Lessee of the leased premises for highway purposes continuing at any time during the term hereof for a period of eighteen (18) months shall, at the option of the Lessor, work a termination of this lease and of all rights of the Lessee hereunder, and nonuser by the Lessee of a portion of said leased premises continuing for a like period shall, at the option of the Lessor, work a terminationof all rights and interests of the Lessee with respect to such portion. This lease is subject to all. outstanding superior rights, including those in favor of telegraph and telephone companies, and the right of renewals and extensions of same. If, by reason of a line change, or otherwise, the title of the Lessor shall cease before the expiration of the term above provided, or if the lease of the above described premises is held to be, or should become inoonsistent with the law of the land, this lease shall thereupon terminate. This lease is to become null and void upon\he failure of the Lessee to keep any of the conditions hereof and is not to be assigned, nor is any portion of the leased premises to be sublet, without the written consent of the Lessor. The Lessee will surrender peaceable possession of said premises at the expiration of this lease.
