As you are aware, Mr. and Mrs. Connelly live next door to Mr. Born and have seen him develop a large commercial junk yard business over the past few years. We will summarize Mr. and Mrs. Connelly's opposition as follows: 1. As you may be aware, the City of Windsor Planning Commission has already denied Mr. Born a Special Use Permit for operation of his commercial junk yard. A copy of the Notice of Denial from the Windsor Planning Commission dated October 31, 1997 is enclosed for your reference. 2. The proposed use is not compatible with the developing neighborhood and existing County zoning (Agricultural) and the City of Windsor's existing zoned planned residential development (PD-R) which surrounds the property. 3. The proposed usage creates a potential of several hazards and dangers for the adjacent neighborhood. The junk cars and parts create a haven for rats, snakes, skunks and other wild animals while at the same time creating several environmental concerns. 4. There has been a marked increase in vehicular traffic including tractors and trailers used to haul the junked cars and parts in and out of the premises. Commercial customers of the junk yard have knocked at the Connellys' door at all times of the day and night looking for the business office for the junk yard operation. The proposed non-conforming use of the property as a junk yard has already caused Mr. and Mrs. Connelly's property value to depreciate, and has the potential for causing the future surrounding residential property values to depreciate as well. A copy of a letter from Mr. and Mrs. Connelly's realtor is attached for your information. 6. Mr. Born has for years apparently misrepresented his operation of the junk yard as a "hobby". There is no question that Mr. Born has for years operated the junk yard as a commercial business. Copies of commercial ads placed by Mr. Born in magazines of wide circulation are enclosed for your reference. 7. Dozens of neighbors have signed a petition opposing the proposed Special Use Permit for the junk yard. A copy of the petition is enclosed for your reference. 8. As you are aware, the County required Mr. Born to erect fences to conceal the junked cars and car parts at a time when Mr. Born was misrepresenting the vehicles as vehicles used in his"hobby". As can be seen by the pictures which have been enclosed with this letter, the cars and parts are now stacked higher than the fence, are located outside the fenced area, and are easily visible from the road and from neighboring residences. Neighbors have complained for years, but Mr. Born has apparently been able to continue his non-conforming use by misrepresenting it as a"hobby". 9. We've included photographs from 1992 through the present showing the outrageous condition of Mr. Born's property and his continuing violation of County ordinances. 10. There is no question that Mr. Born's usage of the property is not in compliance with Sections 31.2, 31.3, 31.3.9, 31.4 and 31.4.18 of the Weld County Building Ordinances. This is a commercial salvage yard located on property which is zoned agricultural. The property has been inspected by yourself and your assistant, Julie Chester, and other representatives of Weld County over the past few years. Accordingly, we join our clients and their neighbors in requesting that you, your staff and the Weld County Planning and Zoning Board deny Mr. Born's request for a Special Use Permit for the operation of a commercial junk yard. I had your property listed for the market value it would normally bring during this time period. We had numerous showings on the property during this time period Without exception,the comment from potential buyers was that this was a very nice property,but they did not want to live next door to a"junk yard". In some cases,we would drive to your property and want to show it to a potential customer,but they would not even go into the home because of the Born property located adjacent to you to the east. I definitely feel that this large number of old cars is far and away above and beyond what is considered reasonable in this type of zoning. As time has gone by, more and more vehicles have accumulated. I personally consider this a real eye sore and am upset knowing his property has decreased my own home value and chance of resale. It is my belief that because Mr. Born has"gotten by" with running a junk yard for quite a while, the neighbor directly across the road now thinks he can do the same. His wrecked vehicles are even parked in the ditch on County Road 74!! So, now we have two junk yards, one directly across the road from the other! While the operation of a commercial entity does not raise a concern,this specific type of business does for a number of reasons. First,based on the way Mr. Born has operated an unauthorized"junk yard"for the nine(9)months we have lived nearby, this business will prove to be a serious eyesore for all the neighbors and for the county. Since we moved in to our home,this residence has collected"cars"in various stages of rust and deterioration. All of these"cars"have been stored on his property in plain view of all their neighbors and any passerby's. Weld County Road 76 is used by most of the residents as an option to Harmony(WCR 74) due to the amount of traffic on WCR 74. Recently,Mr.Born has started leaving these"cars" in the ditches in front of his home and across the road from his home. Some of them blocking part of the lane of travel on this road,especially during the recent storm when WCR 74 was inaccessible. Next,this type of operation will most obviously cause contamination of the soil and potentially the ground water,which is very shallow in this area as proven by the soil tests the new residents have had done recently. Regardless of the requirements the county should place on this type of an entity, it is very difficult to assure and monitor the amount of oil, gas, antifreeze and other fluids that will surely be dumped into the ground. Whether this is an intentional act or by ignorance it will occur and could potentially cause pollution of the areas groundwater. The irrigation water that runs in nearby ditches and holding ponds should be another concern. Especially given the way Mr.Born has demonstrated his handling and disposal of these vehicles already. Finally, this area is growing rapidly with new home construction. It is only a matter of time before the area immediately adjacent to the proposed property will be developed. With a junk yard next door to it the overall land values will be sharply lower, if they are even able to develop it. Those of us who already own homes in the area are very disappointed that this has even be considered and in addition to the eyesore it will create, the de-valuation of our investments is a concern. This should also be the case for the county that relies on these valuations for taxes. Look at the junk yard on State Highway 34 coming in to Weld EXHIBIT 980172 County from I-25. This area is a common joke for out of town visitors as they enter our County. It would be a shame to add another such area to a very attractive residential neighborhood in county. Please consider not granting this Special Use Permit to Mr. Born. If not for the effect it will have on the county's image but by what it will do to their immediate neighbors and those of us within view of the junk that will be stored. Dear Commissioners: My wife and I are opposed to the issuing of a special use permit in the above mentioned case because of the following reasons and or circumstances. A. If Weld County planning had immediate or long range plans for zoning for this type of business in this area then a special use permit would not be required. Lets stay focused on the big picture for this area and not destroy it for future generations because of certain individuals. Once it has been given it may never be returned. A point to clarify this is the mass transportation systems that were in place in most of the major cities in our country. Now we struggle to reestablish them. B. This area has plans for residential and agricultural use. Alexander Estates being the most current development. The homes going in there are conducive to what good planning is all about. I'm sure the new home owners are thrilled at the thought of seeing junk automobiles, and whatever comes along with that activity, being put within walking distance of their new expensive home. C. The county(Weld)maintains WCR 76 now to wash board status,most of the time. This road is a secondary road, the junk that is allowed to be parked and or stored along side the road now is a good example of what the future holds for the area if the permit is issued. I suggest that the planning services take a drive out here and see what it looks like now ! I further suggest that someone or party he held accountable to clean up the present mess. If you want a peek at what the future has in store for the residents that live, work and share this area, I highly recommend that the parties responsible for voting on this issue continue to drive West on WCR 76 into Larimer Co. Continue West across the Tinmath road going West and look on the right side(North)just before the road curves and heads North. D. From my point of view the area in question has been well preserved. The growth spilling over from Windsor and Ft. Collins brings people to this particular section of land for its preserved natural beauty and wildlife. The permit allowing a junk yard can do no good. It can only destroy. There may be a need for this type of business, and the planning services people can plainly see this, but the proposed location is not the place for it. I was one of the fiat homeowners of Northwest Estates,Windsor, CO. We took pride in our neighborhood twenty years ago and continue to care for our homes and neighborhood today. Older homes, such as mine,have been maintained and updated, blending well with the newer homes appraised over $250,000. Our subdivision is presently growing,with 6 new homes built during the past year. There are two roads to access Northwest Estates. One of these roads, County Road 76, runs directly in front of Doug Born's residence and junk yard. At the beginning,Mr. Born indicated he was only going to have a couple of antique cars. As lime has gone by, more and more vehicles have accumulated. I personally consider this a real eye sore and am upset knowing his property has decreased my own home value and chance of resale. It is my belief that because Mr.Born has"gotten by"with running a junk yard for quite a while,the neighbor directly across the road now thinks he can do the same. His wrecked vehicles are even parked in the ditch on County Road 76!! So, now we have two junk yards,one directly across the mad from the other!
