WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board of County Commissioners held a public hearing on the 28th day of June, 1995, at the hour of 10:00 a.m. in the Chambers of the Board, on behalf of River Bend Investments, LLC, 2555 Weld County Road 42, Berthoud, Colorado 80513, for the purpose of considering whether or not there has been a substantial change in the facts and circumstances regarding the application for RE#1716, which was denied by the Board of County Commissioners by Resolution dated April 17, 1995, and WHEREAS, said action was taken concerning property described as: Part of the WA, SE% of Section 21, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant was represented by Jacqueline Johnson, Attorney, and WHEREAS, said hearing was conducted pursuant to the Board's policy concerning applications for land use for property previously denied, as set forth in the Weld County Administrative Manual, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and, having been fully informed, finds that said request to apply for a recorded exemption shall be approved for the following reasons: 1. It is the opinion of the Board of County Commissioners that the applicant has demonstrated that a substantial change in facts and circumstances has occurred. a. The Board originally understood the reason for the requested recorded exemption was to split the parcel so that the applicant may sell Lot A and thereby enable him to capitalize his farming operation. Upon new explanation by the applicant, the true reason for the requested recorded exemption is to split the parcel so that he may sell Lot A to provide for the construction of a home on Lot B by a direct family member or farm worker. The Board of County Commissioners denied the Recorded Exemption request on April 17, 1995. Concerns raised during the review of the Recorded Exemption included that the request would result in sprawl row type development which is in conflict with orderly and efficient development and that the applicants reason for the request, financing purposes, was not consistent with the Comprehensive Plans Agricultural Policy #7. The Board of County Commissioners resolution is attached to this recommendation. The applicant's original application stated that the reason for the Recorded Exemption is to sell the smaller lot with the home in order to raise capitol for their farming operations. The applicant has demonstrated no changes in his request for a Substantial Change Hearing that is different than the original Recorded Exemption request. The applicants intent is still to sell the smaller lot to help finance his farming operations. (Divide a recognized 36 acre parcel which has a home on it into one undeveloped 35 acre parcel and a one acre lot with the home into a second lot). The request was denied unless,the applicant would forfeit an existing recorded exemption(Recorded Exemption No. 1016-21-4-RE 87 dated May, 1977 by a previous owner,L.Biddle) on a separate and unrelated adjoining parcel and then merge the entire balance of land into one 70 acre parcel with the home and one acre as a second lot. We disagree with the county commissioners decision to deny this request as applied for in its original form based on the following reasons. The present 35 acre tract was divided and has a recorded exemption dated in 1977. It was a asset when we purchased it and should remain so. It contiguous on two sides with a commercial dog kennel which received a variance from the County of Weld for the purposes of raising,boarding,and,training dogs. Further it lies in between the kennel and the 36 acres of which is the subject of this letter.Our attorney Bruce Fickle, is on record with the county as opposing this zoning during the kennel zoning application process. Additionally there are several complaints on record concerning the kennel not fulfilling the prerequisite in the one year provided by the county. To date the requirements have not been met! The stipulation suggested by the County Commissioners,would severely reduce the value of our property in it's entirety. This is evident by the sales or other properties boarding the kennels in recent. We believe that it is an unfair and inconsistent stipulation for the County Commissioners to impose upon an individual that in order to divide off a piece of land that all the remaining property he may own be redefined into a single piece, subsequently it adversely effects the land values to which it pertains, particularly in this case by stipulating that all the land we own be influenced in value and desirability by a neighboring dog kennel. ,Wan CONY KMNING E�C_Eir11 g5135 For further clarification we would like to mention that when contemplating the purchase of the farm which is in question we recognized the circumstances which exist pertaining to the existence of the dog kennel, namely that it was not desirable as a building site. We felt that by having a preexisting recorded exemption on the 35 acre lot adjoining the kennels that we would be able to insulate the value of the 36 acres which we are now requesting the home and one acre be divided off of Below is the criteria recorded exemptions arc evaluated on, A. Enable the property owner who is retiring an opportunity to live or sell the existing farm improvements. B. Enable the property owner to sell off agricultural land that is nonproductive for one single family dwelling home site. C. Enable the property owner to provide a residence for direct members of the farm family and also for workers employed at the farm. It would appear that in essence the criteria used promotes keeping our lands in Weld county in agricultural use,which is exactly our intent! However,the decision by the County Commissioners is in direct contrast to that goal in this spu.ific case. When considering the values of land on the front range such as ours,it is obvious that we left the point where land was valued on production return capability a number of years ago. Current values are in excess by 700 to 800%in relation to production dollars when justifying the ability of the land to produce crops and pay for itself. There by when farmers such as the one writing this letter contemplate purchasing land in this area, he must consider many other aspects other that just how many bushels of corn could be sold per acre. Yes that means that the future or under lying value of the property must be considered and evaluated when considering purchasing farm land in this region. In short that means how much might it be worth to some one for purposes other than agriculture. Economic facts in farming indicates that you can't justify the cost of ground on the front range with crop returns. That's why 500 acres out of 550 acres of the ground we farm is rented. Incidentally most of that rented ground is owned by a developer. Yet evidently no consideration was giving to the value of a existing building site when this case was reviewed by the county commissioners. Make no assumption concerning us addressing these facts,we are not planning to build any other homes other than the one we have proposed, nor do we intend to sell one of the parcel's or for that matter be developers in any way.Our goal is simple! Subdivide off a house with one acre of nonproductive farm ground which is expensive and burdensome to the farm to maintain(certainly within the guide lines)and build a more economical home elsewhere on the farm,and in doing so be allowed to maintain the value in the remaining property. It would be far from pendent for us to ignore how future development would effect our land values and concede to the stipulation the County Commissioners suggested in forfeiting an existing recorded exemption(which represents an asset in itself)and merge all of our land into one parcel before the Weld County commissioners would allow the proposed recorded exemption. 95135“ Consider the two followir garios: Imagine,our 71 acres owned today by a developer. Would he have difficulties accomplishing what we tried?First he sells the 35 acre tract which has a recorded exemption. Then he applies to the department of planning for a recorded exemption on the remaining 36 acres under the outlined criteria"B" (dividing the home and one acre off under the non-productive clause). With little doubt the recorded exemption would be granted without ever going in front of the commissioners. What are the results?Two 35 acre parcels(most likely sold and used as home sites and removed from agricultural production),and one home on an acre. This is not the intent but never less that's the way it would work! What if a farmer buys a small 10 acre parcel adjoining his home place?No doubt he will pay in excess of what it will produce in crop revenues,even so he feels it will be a good investment in the future, he uses future development economics to arrive at this decision. Mean while he can farm it and in that way help pay for the investment in part. Lets just say he has a 100 acre home place and he picks up a non developed 10 acre lot which has had a recorded exemption granted before his purchasing it. Then ten years later he wishes to divide off a small piece of property from his 100 acre home place for any of the three acceptable reasons.He soon discovers that the only way the Weld County commissioners will allow the current division is if he agrees to merge the two properties and forfeit the recorded exemption which existed on the smaller 10 acre parcel he purchased earlier for investment reasons. All of a sudden he discovers that his investment that he has considered an asset is all of a sudden a liability,and it has depreciated substantially. Due to the fact that a larger acreage is less desirable thus less valuable per acre than a smaller one. His only sin, he owns land which is contiguous to the building site. On the premise of the Weld County commissioners decision concerning our case,an argument could be made concerning the above scenario that the 10 acre property would be more valuable to an outside party in search of a building site instead of the farmer. Therefore making it quite a undesirable investment for the farmer and preventing continued use in agricultural. The result is in some cases discriminating against the farmer and discouraging the land to remain in agriculture use. Undeniable,a recorded exemption is viewed as an asset when purchasing land. An asset which the recipient must purchase from the county in the form of the$990.00 fee and other expenses incurred in the process. Should that asset be a unconditional tool of power at the county's disposal for undefined circumstances? I would be interested to know as a matter of record how many recorded exemptions have been granted upon the stipulation that was suggested to us in our case?One thing for certain,there is no way that stipulation could be administrated consistently and fairly time after time! A person might also ask if the Weld County Commissioners restricts this stipulation to only those parcel's that are contiguous?Perhaps it could be a condition of applicants for recorded exemptions who own multiple parcel's within the County,but that are not contiguous and do have previously granted recorded exemptions,which would have to be forfeited before being successful with a current application. 951356 • In summary a farmer wishing to divide off an undesirable home and provide a better one for him and his family may find himself restricted in doing so, should he own multiple parcel's. This is due to the conflict or contrast between agriculture and developmental issues, regardless of the intent of the criteria surrounding recorded exemptions.? Unfortunately as in my case the effects arc just the opposite of the intent. The farmer goes out of business and looses his land at below market values and the ground goes out of agriculture use. The parcel of land on which this request is located in part of the W2, SE4 of Section 21, T4N, R68W of the 6th P.M., Weld County, Colorado. The property is located north of and adjacent to Weld County Road 42 and approximately 1/2 mile west of Weld County Road 7. The applicant is requesting to divide a 36 acre parcel into 1 acre and 35 acres, more or less. Proposed Lot A contains one home. Proposed Lot B is in agricultural production. Little Thompson Water District provides proposed Lot A with water and is proposed for Lot B. A septic system provides Lot A with sewage disposal and is proposed for Lot B. The Weld County Public Works and Health Department responded with no objections to this request. The Department of Planning Services' staff recommends denial of this proposal based on noncompliance with the Weld County Comprehensive Plan's agricultural goals and policies as well as lack of efficient and orderly development. The applicant has stated in the application materials that the reason for the recorded exemption is to sell the smaller lot with the home in order to raise capitol for their farming operations. The applicant further stated that a less expensive residence will be constructed for the farm manager. Page 2 zone district to be divided into two separate parcels if the intent of the recorded exemption is met. This applicant however, is not able to satisfy any of the three established criterion. This request would allow for an additional building site, thus creating a sprawl row type development. The three criteria for dividing a lot in the A (Agricultural) Zone district as stated in the Comprehensive Plan Agricultural Policy #7 is to: A. Enable the property owner who is retiring an opportunity to live on or sell the existing farm improvements. B.
