NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption#1811 submitted by Frank Barnes be, and hereby is, approved conditional upon the following: 1. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The parcel of land on which this request is being made is described as Lot B of RE-1295, located in the SW4 of Section 24, T3N, R68W of the 6th P.M., Weld County, Colorado. The property is located north of and adjacent to State Highway 66 and approximately 1/2 mile west of Weld County Road 13. The request is divide a 159 acre parcel, into two lots of 1 acre and 158 acres, more or less. The property lies within the urban growth boundary area of the Town of Mead. The property under consideration is Lot B of RE-1295, which was approved by the Department of Planning Services' staff on September 12, 1990. RE-1295 divided a 160 acre parcel into two lots of 159 acres and 1.5 acres, more or less. On February 1, 1994, the Department of Planning Services' staff approved subdivision exemption 486, on Lot B of RE-1295, for the purposes of financing. The applicant is now requesting to separate the subdivision exemption parcel through the proposed recorded exemption. The applicant stated in the application that the reason for the recorded exemption is to continue to use the smaller lot for residential purposes and continue to use the larger lot for agriculture. Access to both Lots A and B is existing onto State Highway 66. A cistern is currently being used as the domestic water source for Lot A. Sewage disposal to proposed Lot A is through a septic system, and is proposed for Lot B. The Town of Mead has reviewed this request states that this request is within the Towns Comprehensive Planning area for large lot residential development with agricultural open space. The Department of Transportation and the Mountain View Fire Protection District have both reviewed this request. The Weld County Health Department also reviewed this request and recommends that the cistern currently located on proposed Lot A be abandoned. The Health Department has recently acquired information from the Little Thompson Water District and the Division of Natural Resources that indicates that both a community water source and a well are available. The Health Department has also stated that in accordance with Ordinance 172, the current cistern permit will not be renewed when it comes up for renewal in February of 1996. The Department of Planning Services' staff has concerns that the requested division will remove prime agricultural ground from production. All of proposed Lot B, which is farmed, is identified as prime farmland of national importance by the United Stated Department of Agricultural Soil Conservation Services. The proposal, if granted, would allow for the addition of a residence on Lot B, reducing the area for farm production. The Weld County Comprehensive Plan promotes preserving the agricultural use of prime agricultural ground. The Department of Planning Services' staff requests that the Board of County Commissioners consider this request and determine if the criteria for approval of the recorded exemption as stated in sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been satisfied. A 1500 gallon cistern was installed at the aforementioned location. Final approval was never obtained from the Division and a bacterial sample from the system was never analyzed for potability of the water supply. Weld County cistern permits must be renewed each year. The Moore's permit renewal is due February of 1996. In order to determine whether a renewal would be appropriate for the Moore's cistern I contacted Mr. Michael Cook, Little Thompson Water District and Mr. Bill McIntire, Division of Water Resources to determine if water was available or a wall permit could be obtained for this location. Receipt of information from these agencies indicate that both a well permit and Little Thompson water is available to this residence. Therefore, this cistern permit will not be renewed in February. A permanent water supply must be obtained by the applicant. We offer the following comments : RIGHT-OF-WAY Eighty feet of total right-of-way (ROW) has been identified on the proposal . Projected traffic on State Highway (SH) 66 indicates the need for a 150 foot total ROW, 75 feet each side of the highway centerline . Additional width to meet the projected need should be protected by reservation or, preferably, dedication as permitted by County regulations . ACCESS We have not conducted a site visit . The plans indicate that a 30 foot access easement currently exists on the west property boundary. This access is identified as Weld County ROW. It appears that a second access easement is being requested approximately 2625 feet from the existing access . No other accesses have been identified. As a change of use is being proposed by the construction of a single family dwelling on Lot A, the Department has the warrant and obligation to re-evaluate access . This portion of SH 66 is identified as a Category 3 highway which allows a single private direct access to the state highway provided no other reasonable access exists . Additional accesses may be granted provided 1/2 mile spacing can be achieved. If, in fact, no accesses other than the access located on the west property boundary exist, the Department would consider an access on the east property boundary provided it meets State Highway Access Code (SHACode) criteria. TYPES OF EXEMPT WELL PERMITS THAT MAY BE AVAILABLE Household use well - Used for ordinary household purposes inside one single family dwelling. NO OUTSIDE USES ARE ALLOWED. Specifically, irrigation of lawn or gardens or the watering of domestic animals or any other outside uses are NOT allowed. Domestic type use - Used for ordinary household purposes, lire protection, the watering of poultry, domestic animals and livestock on farms and ranches and for the irrigation of not over one acre of home gardens and lawns but not used for more than three single family dwellings. Limited Exempt Commercial Use - Used for drinldng.and saniJa ' nutposes inside au individual commercial business (Emphasis Added). No watering of'lawns or landscaping or any other outside uses ate allowed. Annual diversion is limited to 1/3 acre fool (106,800 gallons). A continuous recording flow meter is required on this type of well. Where a well, either registered or unregistered in this office was constructed and put to use prior to May 8, 1972, and that well serves one or two single family dwellings on an intact pre 1972 lot, a new well permit that allows the expansion of use to serve one (1) additional inhousc use may be available. This expansion of use is not dependent on lot size. PARCELS THAT MAY QUALIFY FOR A WELL PERMIT ISSUED UNDER SECTION 37-92-602, C.R.S. (1990 & 1994 SUPP.) - in over appropriated stream area (Includes all of the east slope and most of the west slope) 1. Any tract of land less than 35 acres in size, which was recorded with the county prior to June 1, 1972, where the original tract is to be split into two lots by exemption, may be eligible for a household use or a limited use exempt commercial well permit. 2. Any tract of land comprising 35 acres or more, may be eligible for a limited use exempt commercial well permit or domestic type use well permit. __-7 3. Any taut of land created by an exemption to the subdivision laws by the county commissioners after June 1, 1972, where a water supply from a well is needed, may be eligible for a household use well permit or an exempt commercial well permit, if the proposed use meets the definitions for these types of wells as described above. Special Land Use or Zoning Changes will normally result in a change in use for existing wells that were originally permitted for household use only or domestic uses.
