This proposed minor subdivision does not interfere with any prime farmland, and itself is not considered prime farmland. The land at this time is not producing any agricultural products,therefore would not hinder any agricultural productivity in Weld County. The counties natural resources will not be affected by the proposed minor subdivision by not interfering with significant wildlife habitats,wetlands or migration corridors. No valuable commercial/mineral resource deposits exist on the land. A gas production facility exists on the property but in no way does it effect any of the surrounding land uses. The facility has an existing access road that does not conflict between mineral development and current and future surface uses. The gas production company has been notified and is fully aware of the proposed development. 2. The proposed minor subdivision,to be rezoned into the estate district,will be compatible with the surrounding land uses that consist of residential/minor agricultural properties lying to the north, east and west, and agricultural land lying to the south. 3. All the lots on this property will use individual sewage disposal systems that will be installed and maintained as per the Weld County Health Departments requirements and local and state laws. 4. Central Weld County Water District has an existing 12"water line that runs parallel to the north side of Weld County Road 44 that is able to service the proposed minor subdivision. The property falls within the LaSalle Fire District which could be supplied by the water line if the need should arise. 5. Expansive soils do exist in various areas of the property. But as stated in the Geologic and Mineral Evaluation prepared for us by Foundation and Soils Engineering, Inc.,the effects of the potentially swelling and/or collapsible soil and rock can be minimized by careful planning prior to construction at the site. 6. Weld County Road 44,which runs east-west along the north property line,will handle the main flow of traffic to and from the proposed minor subdivsion. This paved road, which is maintained by the county year-round, appears to be in good condition structurally. The private access for the proposed minor subdivision, which will adjoin Weld County Road 44, is an existing drive way that will be upgraded to County standards as stated in section 4.6.9.6 of the Weld County Subdivision Ordinance as having a minimum width of 18'and a minimum depth of 4" of gravel base. 7. Upland gravel deposits do exist in part of this site. However,as stated in the Geologic and Mineral Evaluation prepared by Foundation and Soils Engineering, Inc., these deposits do have significant amounts of calcium carbonate deposits and decomposed rock. Therefore,we(Foundation& Soils Engineering, Inc)feel that these deposits are not of economical importance as a mineral resource. 8. The proposed minor subdivision falls within Zone C per FIRM Community Panel No. 080266 0775 C dated September 28, 1982 and does not fall within any Flood Hazard Overlay District. 9. The proposed minor subdivision is not located in any Geologic Hazard Overlay Districts. 10. The proposed minor subdivision is not located in any AP(Airport)Overlay Districts. 972481 In response to comments made by the Weld County Department of Planning Services,dated April 9, 1997 and the coments included within from the Department of Public Works, and the Colorado Geological Survey. This proposal of a five(5)lot minor-subdivision should not, in anyway, encroach onto any of the surrounding agricultural land. Steps in the design process of this development have been taken so that no residences,outbuildings or construction of the new access road will hinder the agricultural operations of the surrounding land. A'Right to Farm'covenant will be incorporated on the final plat to alert potential residents about the rural way of life. The new access has been relocated to the west side of the property to give a good view of oncoming traffic from both directions. No private traffic shall use the access that leads to the gas production facility that exists on the east side of the property. Also no direct lot access will exist off of Weld County Road 44. An additional ten(10)feet of right of way will be dedicated to Weld County Road 44 to create a forty (40)foot right of way for future expansion purposes. A note will be included on the final plat to advise future residents about the access roads being used by oilfield service trucks and other related equipment. An additional note shall be included to inform future buyers about the characteristics of the soils and the precautions that should be taken before construction begins. On June 10, 1997,a meeting was held on site with the property owners,and representatives from H& S Resources to discuss the minor subdivision proposal. The reps from H& S Resources had no objections to the proposal but did show some concerns about retaining their access to their tank batteries and well sites,and also access to their underground mains and supply lines in case maintenance is needed.
