RE: APPROVE THREE INTERGOVERNMENTAL AGREEMENTS FOR 1995 HOUSING
REHABILITATION PROGRAM WITH VARIOUS ENTITIES AND AUTHORIZE CHAIRMAN
TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with three Intergovernmental Agreements for
the 1995 Housing Rehabilitation Program between the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Weld County
Housing Authority, and the following entities:
1. Town of Hudson
2. City of LaSalle
3. Town of Windsor
WHEREAS, after review, the Board deems it advisable to approve said agreements subject
to the terms and conditions as stated in the copies which are attached hereto and incorporated
herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, ex-officio Housing Authority Board,that the three Intergovernmental Agreements
for the 1995 Housing Rehabilitation Program between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, on behalf of the Weld County
Housing Authority, and the above mentioned entities be, and hereby are, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said agreements.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 23rd day of January, A.D., 1995.

INTERGOVERNMENTAL AGREEMENT
This agreement, entered into this/V , day of f7irUQ-w<6 t , 1994, by and between the
BOARD OF COMMISSIONERS OF WELD COUNTY, a body politic of the STATE OF
COLORADO, hereinafter called"the county"and the TOWN OF HUDSON, a body politic,
hereinafter called "the town".
WITNESSETH:
WHEREAS, pursuant to the Housing and Community Development Act of 1977, as
amended, hereinafter called "the act" the UNITED STATES, ACTING BY AND through
the Secretary of the Department of Housing and Urban Development, hereinafter called
"HUD" is making available to the State certain funds for community development activities
as set forth in the Act; and
WHEREAS, the State of Colorado, through the Department of Local Affairs, has the
legal authority to provide funds to counties for community development activities; and
WHEREAS, the Town has expressed interest in allowing the County to operate a
Housing Rehabilitation Program within its jurisdiction; and
WHEREAS, the County has indicated a willingness to submit a program proposal to
the State to carry out the Housing Rehabilitation Program within their jurisdiction; and
WHEREAS, the parties hereto desire to provide assurances and delineate the areas
of cooperation between the County and the Town, with respect to housing rehabilitation
activities.
NOW, THEREFORE, in furtherance of said resolution, and in consideration of the
mutual conditions, covenants and agreements herein contained, it is agreed by and between
the parties as follows:
1. PLANNING THE HOUSING REHABILITATION PROGRAM: the parties,
through their executives and staff, shall cooperate which each other in developing the
Housing Rehabilitation Program proposal, with all parties giving due consideration to the
needs of its citizens and goals, objectives, rules, and regulations of the Act;
2. TERM OF AGREEMENT: this agreement shall remain in full force and effect
until the program proposal is approved by the State and a contract is executed by all parties.
In the event the program proposal is approved by the State, this Agreement shall remain
in effect through the completion of program activities;

3. AUTHORIZATION TO SUBMIT PROPOSAL: the County is authorized to
submit a proposal to the State on behalf of the Town, to apply for funds under the
Community Development Block Grant/HOME Program and to act on behalf of the Town,
with regard to any subsequent negotiations,presentations or information in conjunction with
the grant application;
4. The Town shall have no obligations or responsibilities, financial or otherwise,
concerning the administration of Community Development Block Grant/HOME Housing
Rehabilitation Programs and the County agrees to indemnify the Town from any and all
liability, loss of damage the City may suffer in connection the administration of the project
upon approval of the proposal.
IN WITNESS WHEREOF; THE PARTIES HERETO HAVE HEREUNDER SET
THEIR HANDS AND SEALS ON THE DAY AND YEAR WRITTEN.

Staff recommends the approval by the Board for the following Intergovernmental Agreements:
A. Town of Hudson
B. City of La Salle
C. Town of Windsor
These agreements cover the 1995 Housing Rehab Program and permit the towns and cities to be
included in our target area. The program will be administered by the Weld County Housing Authority.
