HomeMy WebLinkAbout660010.tiffRESOLUTION A RESOLUTION ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE, 1964 EDITION, THE TECHNICAL PLUMBING CODE OF THE COLORADO STATE DEPARTMENT OF PUBLIC HEALTH, AND THE NATIONAL ELECTRICAL CODE, 1965 EDITION; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; DECLARING AND ESTABLISHING FIRE ZONES; RE-ESTABLISHING THE BUILDING INSPECTION DEPARTMENT OF AND FOR THE COUNTY OF WELD; REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, CONVERSION, DEMOLITION, OCCUPANCY, EQUIPMENT, USE, HEIGHT, AREA, PLUMBING, ELECTRICAL WIRING AND MAINTENANCE OF BUILDINGS OR STRUCTURES WITHIN A DESIGNATED PART OF THE UNINCORPORATED AREA OF WELD COUNTY, COLORADO; AND REPEALING ALL RESOLUTIONS IN CONFLICT THEREWITH. BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO, pursuant to the powers given it by 36 - 15 - 1 to 36 - 15 9, inclusive, of the 1963 Colorado Revised Statutes: SECTION I. SHORT TITLE. This resolution shall be known and may be designated as "The Building Code Resolution of Weld County, Colorado". SECTION II. BUILDING INSPECTION DEPARTMENT. (A) There is hereby established, re-established and continued in full force and effect in and for the County of Weld, the Building Inspection Department. The Board of County Commissioners shall budget and appropriate such County funds to the Building Inspection Department as it may deem necessary for the operation of the department. (B) The head of the Building Inspection Department shall be designated the Chief Building Inspector. He shall supervise and be responsible for all inspection work, including building, plumbing and electrical. (C) The Chief Building Inspector is hereby authorized and directed to enforce and administer all of the provisions of this resolution, all of the provisions of the Codes adopted hereunder, the provisions of the County Zoning Resolution, and any other regulations he is directed to enforce by The Board of County -1- 660010 / L. 12 Xi Commissioners and the law. For such purposes he shall have the power of a police officer. (D) It shall be the duty of the Chief Building Inspector to have a permanent record kept of all the pertinent transactions of his office and render a monthly report to the Board of County Commissioners of all permits issued and fees collected. All fees collected shall be turned over to the County Treasurer for deposit in the General Fund of the County of Weld. SECTION III. SCOPE OF RESOLUTION. (A) The provisions of this Resolution shall apply to all the area in the County of Boulder now covered by the Weld County Zoning Resolution and not embraced within the limits of any incorporated city or town, except that it shall not apply to any area not subdivided for building purposes by a plat duly recorded in the office of the County Clerk and Recorder of the County of Weld without a petition to the County Commissioners requesting a Code signed and duly acknowledged by the owner or owners of any such unsubdivided area. (B) Owners of land in the area not covered by this resolution where construction is contemplated may obtain the inspection services of the Building Inspection Department provided that they apply for permits and pay the fees prescribed therefor. (C) Buildings or structures used for the sole purpose of providing shelter for agricultural implements, farm products, livestock or poultry where permitted under the existing zoning regulations shall be exempt from the provisions of this resolution. (D) No structure, dwelling or building in said designated area shall be erected, constructed, reconstructed, altered or remodeled except in compliance with the provisions of this resolution. Where compliance with the building code is required by this resolution -2- the total fee for such building permit shall be as prescribed herein. (E) Drainage structures. Suitable drainage structures such as paved gutters, drain inlets and subsurface drain lines shall be installed where determined necessary by the Chief Build- ing Inspector to protect against dampness, flooding, erosion, or other damage by surface water or ground water. Drainage structures shall be properly connected to adequate outlets which are protected where necessary by recorded easements. SECTION IV. CODES ADOPTED BY REFERENCE. For the purpose of establishing proper regulations for building construction and for the installation of plumbing and electrical systems, the Codes, or portions thereof, hereinafter set forth, are hereby adopted and made a part of this resolution by this reference. Certified copies of each of the Codes listed herein shall be and are now on file for use and examination by the public in the Office of the Board of County Commissioners and of the Chief Building Inspector of the County of Weld. Copies of said Codes shall be available for sale to the public through said offices at a price not to exceed the cost thereof to the County. (A) BUILDING CODE. The Building Code fait he County of Weld shall be the 1964 Edition of the Uniform Building Code, as published by the International Conference of Building Officials, with the following exceptions: (1) Delete Sections 201, 202(a), and 204. (2) Delete all chapters, except Chapter 51, Heat Producing Appliances, from the Appendix. (3) Delete Section 1601(a) and substitute therefor as follows: FIRE ZONES DEFINED. For the purpose of this Code there shall be established, within said unincorpor- ated areas of the County, fire zones in those -3- land use districts as heretofore established under the Weld County Zoning Resolution, in accordance with the following table: Fire Zone District 2 Transitional (T); Economic Development (ED); Business (B); Commercial (C); Light Industrial (LI); and General Industrial (GI). 3 Estate Residential (ER); Suburban Residential (SR); Rural Residen- tial (RR); Forestry (F); Agricultural (A); and Multiple - Family (MF). (B) PLUMBING CODE. The plumbing Code of Weld County shall be the Technical Plumbing Code of the Colorado State Depart- ment of Public Health. (1) No plumbing system installed in a building or structure shall be used for the purpose intended until the required certificate of inspection and approval has been issued by the Building Inspection Department. No work shall be concealed until said work shall have been inspected and written approval to proceed shall have been given. (2) Sanitary inspections of septic tanks, leaching fields, well, etc., shall be made by the Greeley City - County Health Department. (C) ELECTRICAL CODE. The Electrical Code of Weld County shall be the National Electrical Code of the National Fire Protective Association International, 1965 Edition. (1) No electrical wiring system shall be used or current supplied for light, heat or power in a building or structure until the required certificate of inspection and approval has been issued by the Building Inspection Department, except for temporary -4- current for a partial installation or for testing purposes. No work shall be concealed until said work shall have been inspected and written approval to proceed shall have been given. SECTION V. ADMINISTRATIVE PROCEDURES. (A) All references in the aforesaid Codes to "city" shall mean the County of Weld; to "city council, mayor, or appointing authority" shall mean the Board of County Commissioners of the County of Weld; to "building official, administrative authority or fire chief" shall mean the Chief Building Inspector of the County of Weld. (B) Plumbing and electrical inspections shall be as pre- scribed by the Chief Building Inspector and shall, in general, follow the procedures outlined in Section 304 of the Uniform Building Code, 1964 Edition. (C) Building permit fees and plan -checking fees for building, plumbing and electrical inspections shall be as prescribed in Section 303 of the Uniform Building Code, 1964 Edition, except that the permit fee for non- residential farm and garden buildings shall be one- fourth (1) the amount as prescribed by said Uniform Building Code. SECTION VI. PENALTY AND ENFORCEMENT. Any person, firm or corporation, whether as principal, agent, employee or otherwise, violating any of the provisions of this resolution, or of the Codes adopted herein, shall be fined any amount not to exceed One Hundred Dollars ($100.00) for each such violation, such fine to inure to the County of Weld shall be deemed a shall be erected, used in violation . If any building or structure constructed, reconstructed, altered, maintained or of any of the provisions of this resolution, or of -5- the Codes adopted herein, or amendments thereto, the Board of County Commissioners by the County Attorney or Assistant County Attorney, or the District Attorney of Weld County, in addition to other remedies provided by law, may institute injunction, mandamus, abatement or other appropriate action or proceeding to prevent, enjoin, abate or remove such unlawful erection, construction, reconstruction, alteration, maintenance or use; and the fine hereinabove provided for may be recovered in that same civil action wherein such injunction, mandamus and/or abatement is sought, or separate and distinct proceedings may be instituted seeking varying forms of relief, as the law may allow. SECTION VII. LIABILITY. This resolution shall not be construed as imposing upon the County of Weld any liability or responsibility for damage resulting from defective building, plumb- ing or electric work; nor shall the County of Weld, or any official or employee thereof, be held as assuming any such liability or responsibility by reason of the inspection SECTION VIII.
