HomeMy WebLinkAbout960093.tiff RESOLUTION RE: APPROVE AGREEMENT FOR HEALTH EDUCATION CONFERENCE FOR HISPANIC ELDERS BETWEEN HUMAN SERVICES AREA AGENCY ON AGING AND CATHOLIC CHARITIES NORTHERN AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement for Health Education Conference for Hispanic Elders between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Human Services Area Agency on Aging, and Catholic Charities Northern, commencing January 20, 1996, and ending December 31, 1996, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement for Health Education Conference for Hispanic Elders between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Human Services Area Agency on Aging, and Catholic Charities Northern be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Webster' 960093 ('C ; //5 : CA/ HR0067 WELD COUNTY AREA AGENCY ON AGING AGREEMENT FOR HEALTH EDUCATION CONFERENCE FOR HISPANIC ELDERS This agreement made and entered into, by and between WELD COUNTY HUMAN SERVICES' AREA AGENCY ON AGING, an agency of Weld County Government, hereinafter called "AAA" and CATHOLIC CHARITIES NORTHERN, hereinafter called "CATHOLIC CHARITIES." WITNESSETH: WHEREAS, AAA develops and administers an Area Plan for a comprehensive and coordinated system of services; and WHEREAS, AAA has responsibility under the Older Americans Act to provide health promotion and disease prevention services to elderly who are socially and economically in need; and WHEREAS,health is usually ranked as the greatest problem and fear that Hispanic elderly face; and WHEREAS, CATHOLIC CHARITIES has extensive experience delivering services to Hispanic elders in Weld County; NOW, THEREFORE, the parties do mutually agree as follows: 1. Engagement of Contractor. AAA hereby retains CATHOLIC CHARITIES and CATHOLIC CHARITIES hereby accepts engagement by AAA upon the terms and conditions hereinafter set forth. 2. Term. Subject to the provisions contained herein, the term of Agreement shall commence on January 20, 1996 and shall automatically terminate on December 31, 1996. 3. One-Time Nature of Agreement. This award is made for the period of time stated in the Agreement. This Agreement in no way implies further funding. 960093 Page Two - Healthy Lifestyles Conference 4. Scope of Work. CATHOLIC CHARITIES will provide a one (1) day conference for 120 seniors for 720 units of health promotion and their families with an emphasis on the health needs of Hispanic seniors. The conference will provide workshops, speakers, and health screenings concentrating on the health issues of diabetes, nutrition, prescritption drugs cancer, exercise and hypertension or other topics of interest. An extensive outreach program will be conducted through CATHOLIC CHARITIES' existing Outreach Unit to elders 60 years and older. 5. Reimbursement. AAA agrees to reimburse CATHOLIC CHARITIES for all eligible project costs up to but not exceeding the sum of$2,200. AAA shall pay CATHOLIC CHARITIES within thirty (30) days from receipt of the AAA Monthly Financial Report. 6. Project Income. CATHOLIC CHARITIES agrees to document and report any project income received as a result of this Agreement. 7. Reports. CATHOLIC CHARITIES agrees to keep records and make reports on the forms required by the AAA and in accordance with guidelines issued by the State of Colorado and the Aministration on Aging. 8. Monitoring. CATHOLIC CHARITIES agrees that AAA is required to conduct periodic evaluations of the activities conducted under the Agreement and to monitor on an ongoing basis the performance of CATHOLIC CHARITIES. 9. Collaboration. CATHOLIC CHARITIES agrees to utilize and coordinate with existing community services such as local senior centers, health care providers, social service agencies, churches, senior housing, meals on wheels programs, and senior information and referral services. 10. Confidentiality. CATHOLIC CHARITIES and AAA agree not to disclose any personal or privileged information to third parties without first obtaining the written consent of the senior or responsible party thereof, unless otherwise permitted or required under applicable law. 960093 Page Three - Healthy Lifestyles Conference 11. Termination. Either CATHOLIC CHARITIES or AAA may terminate this agreement with or without cause, by giving thirty (30) days written notice to the other party. Termination may also result automatically upon loss of Federal Funding to AAA. 2. Assurances. a. CATHOLIC CHARITIES agrees that it is an independent contractor and that its officers, employees, and clients do not become employees of Weld County employees as a result of the execution of the Agreement. b. Weld County,the Board of County Commissioners of Weld County, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of CATHOLIC CHARITIES,or it employees,volunteers,or agents while performing functions as described in the Agreement. CATHOLIC CHARITIES shall not be held liable for injuries or damages caused by any negligent act or omissions of Weld County, the Board of County Commissioners of Weld County, its employees, volunteers, or agents while performing the Agreement. CATHOLIC CHARITIES shall provide workers' compensation insurance for all employees of CATHOLIC CHARITIES engaged in the performance of the Agreement, as required by the Colorado Workers' Compensation Act. Likewise, AAA, by and through the Board of Weld County Commissioners, shall provide adequate liability and workers' compensation insurance for all of its employees, volunteers and agents engaged in the performance of this Agreement. c. No officer,member,or employee of Weld County and no member of their governing bodies shall have any pecuniary interest, direct or indirect, in the approved Agreement or the proceeds thereof. d. CATHOLIC CHARITIES understands that monitoring and evaluation of the performance of this Agreement shall be conducted by AAA and the results provided to the Board of County Commissioners of Weld County. 960093 Page Four - Healthy Lifestyles Conference e. CATHOLIC CHARITIES and AAA assure compliance with Title VI of the Civil Rights Act of 1986,and that no person shall, on the grounds of race, creed, color, sex or national origin,be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under the approved Agreement. Executive Director Human Services Subject: Area Agency on Aging 1996 Purchase of Service Agreements Enclosed for Board approval are eight (8) Purchase of Services Agreements with local agencies to provide services as specified in the Area Agency 1996 Annual Plan. Due to a five percent budget cut at the federal level, service provider contracts reflect the same five percent cut in comparison to contracts implemented in FY 1995. The following agreements, unless otherwise amended, will be in effect from January 2, 1996 through December 31. 1996. • Purchase of Services Agreement between the Area Agency on Aging and Meals on Wheels for $26,885 to purchase 24,650 meals for 100 homebound elderly. • Purchase of Services Agreement between the Area Agency on Aging and Catholic Charities Northern for $20,000 to purchase 1.900 units of outreach services to 140 isolated and homebound Hispanic elderly and of Weld County to help them gain access to needed services. 4!� III 0Purchase of Services Agreement between the Area agency on Aging and Catholic 11harities Northern for $2,200 to plan and implement a day long healthy lifestyles conference for Weld County Hispanic elders. • Purchase of Services Agreement between the Area Agency on Aging and Eldergarden for $13,950 to purchase 16,000 units of adult day care for 85 participants. • Purchase of Services Agreement between the Area Agency on Aging and RVNA for $21,175 for 2,377 units of home health care for 57 persons. • Purchase of Services Agreement between the Area Agency on Aging and Employment Development. Inc. (a non profit agency of the Weld Mental Health Center) for $22,550 to provide 1,473 contact units of peer counseling to 90 elders. w, • .Purchase of Services Agreement with North Colorado Medical Center Foundation Seniors are Special Program for$9,500 for 1000 units of in-home respite care for 15 elders and their families. • Purchase of Services Agreement with Charles J.
