RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION #2300 -VUE AND LO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, pursuant to its authority under Section 30-28-101(10)(d), C.R.S., as amended, did determine at a public meeting held in the Chambers of the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as Recorded Exemption #2300, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land", and WHEREAS, the request for Recorded Exemption #2300 was submitted by Yongge and Shoua Vue, 1428 West 102nd Ave, Northglenn, Colorado 80221, and Yia and Ying Lo, 3603 West 90th Place, Westminster, Colorado 80030, for property which is located in part of the SE% of Section 24, Township 1 North, Range 68 West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and WHEREAS, this request is to divide the property into parcels estimated to be approximately 84.38 acres and 34.9 acres. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land". BE IT FURTHER RESOLVED by the Board that Recorded Exemption #2300 submitted by Yongge and Shoua Vue and Yia and Ying Lo, be, and hereby is, approved conditional upon the following: 1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.) Regulations. 2. Prior to recording the plat: A. The applicant shall submit one proposed building envelope for both Lots A and B to the Department of Planning Services for review. Upon approval by the Department of Planning Services, the building envelopes shall be delineated on the plat. B. A 30-foot wide joint access easement extending across the parcel on the south side of Bull Canal and Lot B from Weld County Road 6, for the benefit of both Lots A and B, shall be clearly shown on the plat. The joint access easement shall be dedicated for the use as shown utilizing the language set forth in Section 11.7.1.12.5 of the Weld County Subdivision Ordinance. 981980 nkJ RE2300 RE #2300 -VUE AND LO PAGE 2 C. The applicant shall submit evidence to the Department of Planning Services that the lot has an adequate water supply of sufficient quality, quantity and dependability. D. The access will be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. These roads will be graded and drained to provide all weather access. E. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County Public Works Department to determine if a culvert is necessary at any approved access point. If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger culvert, contact shall be made with the Public Works Department to adequately size the culvert. F. The applicant shall attempt to address the requirements of the Mountain View Fire Protection District as stated in a referral response received September 22, 1998. G. Lot A shall comply with the less than thirty-five (35) acre maximum lot size required by Section 11.1.2 of the Weld County Subdivision Ordinance. H. The following notes shall be placed on the plat: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. 2) Any future structures or uses on site must obtain the appropriate zoning and building permits. 3) All construction or improvements occurring in the Geologic Hazard Area as designated in the Geologic Hazard Area map prepared by the Colorado Geological Survey, dated May 10, 1978, shall comply with the Geologic Hazard Overlay District requirements of Section 27 of the Weld County Zoning Ordinance. 4) Staff supports this application for Recorded Exemption; however, subsequent Recorded Exemptions on adjacent properties will raise the issue of compliance with the intent of the Recorded Exemption process. Approval of this Recorded Exemption does not guarantee approval of future applications on adjacent properties. 3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of approval by the Department of Planning Services. The 119 acre parcel is adjacent to Docono on the north, within one mile of Northglenn and Broomfield on the south and within a mile and a half of Erie on the West. The parcel of land under consideration is not the total contiguous land holdings of the applicants. Because of the many concerns Planning Staff has regarding this recorded exemption, we are requesting the case be reviewed by the Board of County Commissioners. The parcel of land in question is designated as "prime if irrigated"with a small portion designated as "other"by United States Department of Agriculture. Staff has the following concerns: The applicant has not demonstrated that this application is consistent with efficient and orderly development. The proposed lot is isolated with access over an irrigation ditch and across Lot B. A.Goal 1. Of the Weld County Comprehensive Plan states "preserve prime farmland for agricultural purposes which foster the economic health and continuance of agriculture". The Planning Staff does not feel a 34.9 acre Lot A adheres to this goal. The A(Agricultural)zone district was established to promote and maintain agriculture as a vital support element for Weld County Citizens. Mr. Lo paid for a quarter interest in the southeast quarter of the section and is using this fact to justify a 34.9 acre lot. This justification is irrelevant and not substantiated in any ordinance. exam 981980 Section 11.4.3 of the Subdivision Ordinance states "The approval by the Department of Planning Services staff may be conditioned or restricted to carry out the intent of Section 1.3 of this Ordinance including, but not limited to, designation of building envelopes, creation of conservation easements or other legal mechanisms to encourage agricultural uses of the parcels". It has been suggested Mr. Lo wishes to place his home near the middle of Lot A with no consideration for preserving the farm ground. The land the applicants purchased in the southeast quarter is 2 legal parcels. Because of a right-of-way along Bull Canal two homes can be built.If the true intent is to build two homes and farm the land, this recorded exemption is unnecessary. The applicant has chosen to subdivide the land without regard to the long term impacts of the divisions. The Department of Planning Services' staff is concerned with this lack of consistency with the Comprehensive Plan and Subdivision Ordinance. The Department of Planning Services' staff concerns are based upon: inconsistency with efficient and orderly development, conflict with the Comprehensive Plan, and Subdivision Ordinance, and incompatibility with the A(Agricultural) zone district. The Department of Planning Services' staff requests that the Board of County Commissioners consider the application and determine if the standards of Sections 11.2 through 11.8 of the Weld County Subdivision Ordinance have been met and adhere to the goals and policies of the Weld County Comprehensive Plan. All other buildings(including larger one- and two-family dwellings) require a minimum fire flow of 1,500 gallons of water per minute, measured at a residual pressure of 20 pounds per square inch (p.s.i.) and may require more depending on the building size and type of construction as per Appendix III-A of the Uniform Fire Code. If the required fire flow is not available, the installation of a residential fire sprinkler system will be accepted as an alternative to meeting the required fire flow. • If a residential fire sprinkler system is proposed, the plans for the fire sprinkler system must be submitted to the Fire District for review and approval prior to installation.
