• I SIGN STIPULATION TO REVERT TITLE AND FOR ENTRY OF FINAL JUDGMENT CIVIL ACTION 66-C-454 RANGE 66, TOWNSHIP 3 NORTH, SECTION 36: WHEREAS, the Board of County Commissioners of Weld County, Colorado, has been requested by the Attorney General's Office, State of Colorado, to sign a "Stipulation to Revest Title and For Entry of Final Judgment", concerning Civil Action 66-C-454, which pertains to two separate parcels of land more particularly described as follows: A strip or parcel of land thirty (30) feet wide off of the north side of the North Half (Ni) of Section Thirty -Six (36), Township Three(3) North of Range Sixty -Six (66) West of the Sixth (6th) P. S. vs. 640 acres of land in Weld County, Colorado - Civil Action No. 66-C-454 Dear Mr. Tucker: Reference is made to Civil Action No. 66-C-454 covering the condemnation of Sec. 36, Tap. 3 North, Rge. 66 West of the 6th P.M., Weld County, Colorado. As per your request, our Board has executed the original and one copy of the "Stipulation to Revest Title" in those lands covered Sy Right -of -Way No. 1345 issued for road purposes on the north and south section lines of the above section. In your letter of May 12, you indicated that a roadway had never been built on the north and south sections, whereas, roads were constructed in these areas but not on the west line of the section, even though Right -of -Way No. 1180 had been granted by our Board for road purposes on the west line. As we explained to you, we have changed Page 3 of the Stipu- lation to show the proper legal description of the roadway as it appears in the right-of-way grant. On the basis of the corrected and executed Stipulation, we hope that the condemnation action can be completed, and that the additional $6,000 due the state can now be paid. STIPULATION TO REVEST TITLE AND FOR ENTRY OF FINAL JUDGMENT WHEREAS, on the 31st day of August, 1966, a Complaint in Condemnation and Declaration of Taking were filed on 640 acres in Weld County, Colorado, described as "All of Section 36, Township 3 North, Range 66 West of the 6th P.M., Colorado," the description of said tract and the estate condmned being fully set forth in said Complaint and Declaration of Taking and Decree on Declaration filed in Book 573, Weld County, Colorado, to which reference is here made for all purposes; and WHEREAS, by reason of the filing of the Declaration of Taking and the depositing of $32,000.00 as estimated just compensation for the taking and of the title to said tract or interest therein condemned vested in the United States of America; and WHEREAS, the State Board of Land Commissioners of the State of Colorado hereinafter referred to as State of Colorado was the owner of the fee simple title to said tract of land at the time of the filing of said complaint and Declaration of Taking, subject to certain rights -of -way granted Board of County Commissioners of Weld County, Colorado, hereinafter referred to as Weld County, and an agricultural lease in favorcf Dwight Sarchet; and sr • WHEREAS, Dwight Sarchet has been paid the sum of $3,200.00 for all his interest in said tract as evidence by "Compensation in Civil Action No. 66-C-454 United States District Court for the District of Colorado - Lease S-32306" agreement attached to the Application for Withdrawal of funds and filed with this court; and WHEREAS, the Secretary of Commerce has determined that the hereinafter described portion of said tract is not necessary for the project and defendants, State of Colorado and Weld County, are desirous of revestment of title to a portion of said tract, thereby agree to revestment of title to hereinafter portion of said tract condemned in this cause of action; and WHEREAS, State of Colorado and Weld County have agreed to stipulate with plaintiff, United States of America, for the revest- ment of a portion of said tract as their interest appeared on the date of taking and for the just compensation for the taking of said tract of land being paid solely to the State of Colorado. M.,, Colorado, containing 640 acres, more. or less, situate in Weld County, State and District of Colorado, in which you have or claim an interest, for public use for an ionospheric radar research facility which will be used by the Institute for Telecommunication Sciences and Aeronomy, Environmental Science Services Administration, Department of Commerce, to investigate ionospheric transmission characteristics - and problems for systems using high power and to provide a basic ionospheric, exospheric and space research tool, and for other uses incident thereto. The authority for the taking is the Act of August 1, 1888, 25 Stat. 357 as amended, 40 U.S.C. § 257 (1964); the Act of February 26, 1931, 46 Stat. 1421 as amended an supplemented, - 2 - 40 U.S.C. §§ 258a -258f (1964); and the Act of December 30, 1963, 77 Stat. 788. You are further notified that if you have any objection or defense to the taking of your property you are required, pursuant to Rule 71A, Federal Rules of Civi]. Procedure, to serve upon the Clerk of this Court and upon plaintiff's attorney at the address herein designated within twenty days after personal service of this notice upon you, exclusive of the day of service, an answer identifying the property in which you claim to have an interest, stating the natr e and extent of the interest claimed and all your objections and defenses to the taking.
