COLORADO CASE NO.: USR-1191 NAME: Heinze, Stanley
Environmental Protection Services has reviewed this proposal;the following conditions are recommended
to be part of any approval:
1) All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects
against surface and groundwater contamination.
2) No permanent disposal of wastes shall be permitted at this site.
3) Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
blowing debris, and other potential nuisance condtions.
4) Fugitive dust shall be controlled on this site.
5) The maximum permissible noise level shall not exceed the residential limit of 55 db(A) as
measured according to 25-12-102, Colorado Revised Statutes.
6) The E.P.S.Division of the Weld County Health Department was unable to locate a septic permit
for the septic system serving the existing structure. The septic system shall be reviewed by a
Colorado Registered Professional Engineer. The review shall consist of observation of the system
and a technical review describing the systems ability to handle the proposed hydraulic load. The
review shall be submitted to the E.P. S. Division of the Weld County Health Department. In the
event the system is found to be inadequately sized or constructed the system shall be brought into
compliance with current Regulations.
7) No on-site disposal of produce of any type shall be permitted at anytime. Produce shall be handled
and stored at the facility in such a manner so that no nuisance is created by odor, blowing of
debris, fugitive dust, or spoiled produce on or around the facility.
• 8) All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled
in a safe manner. Reference 25-8-205.5 Colorado Water Quality Control Act and Rules and
Regulations thereof.
9) The facility shall utilize the existing public water supply.

The Weld County Public Works Department has reviewed this proposal; the following requirements are
recommended to be a part of any approval:
COMMENTS:
This application will be reviewed for a Site Specific Development Plan and a Special Review Permit to manufacture
and assemble agricultural weedburners, farm crop sprayers, and repair farm machinery.
Julie Chester from Planning Services and I, representing the Public Works Department, visited the site and we have
the following comments:
,olorado State Highway 14 will be the main access to the facility. Please contact Tess Jones or Gloria Idler of the
.;DOT Greeley office for any additional permits or comments regarding access to the property.
There appears to be adequate off-street employee and customer parking available, along with designated
equipment storage areas. The circulation appears to be workable.
REQUIREMENTS:
The applicant should designate, on the plat, a small retention area to hold any storm water runoff that may occur
from the existing metal building. The low point in the property and the drainage from the gutters appear to be in
the north central portion of the property. This small amount of water should be retained on the property and allowed
to evaporate, not damaging any adjacent crop lands.

SUBJECT: Heinze/Fabrizius Site Plan
Julie, I have reviewed the above proposal. Since it appears that appropriate right-of-way has already
been reserved, my only concern would be if traffic to the site will increase by more than 20%. If the
20% increase is to occur, then we would have the warrant to re-evaluate access.
When I scale the existing access width it appears to be 45 feet wide. Conformance with the State
Highway Access Code would allow 35 feet. To accommodate the larger vehicle types, we would allow
the radii to greater than the normal 25 feet.
These changes would only be required if the 20% increase is to occur. An access permit would need to
be obtained to authorize the change.
My comments are preliminary comments only, and are based upon the submittal received May 13, 1998.
Thank you for the opportunity to review the Heinze/Fabrizius proposal.

Dear: Ms. Chester
I am sending this letter in response to our conversation of June 22, 1998 regarding
USR-1191, Site Specific Development Plan and Special Review Permit to
manufacture and assemble agricultural weedbumers and farm crop sprayers and
repair farm machinery.
As I mentioned, Thornton is the owner of the surrounding farm and the house
directly west of the shop. The shop was at one time part of the larger farm until it
was exempted by the previous owner and sold separately. Although I do not
object to the proposed use of the property it should be reflected in the records that
the shop does not have an independent domestic water supply. The shop is on
the same water meter as the house and is the property of Thornton. Mr. Heinze
has made arrangements with the house tenant to use water, but this is not a
permanent or guaranteed solution.
I understand that the cost of a separate tap is costly and may place a financial
hardship on Mr. Heinze. At a minimum I suggest that Mr. Heinze should obtain a
contract with Thornton for use of the water and that any later transfer of ownership
of the property or business not be allowed without a new water tap being installed.
I am planning to be in attendance at the public hearing on July 7, 1998 at 1:30
p.m. If I can provide any additional information or if you have any suggestions
please let me know.

SUBJECT: Heinze/Fabrizius Site Plan
Julie, as a result of your memorandum and the re-reading of the letter I previously sent, I wanted to
attempt to explain myself better about the access width. Mr. Heinze should reduce the width of his
driveway to 35 feet and increase his radii.
My guess is that his traffic volume probably won't increase by more than the 20% necessary to justify a
change of use permit, but any reconstruction of the access will require a permit from this office.
I hope that I'm a little clearer.
