SUBJECT: Report of Enforcement Actions
12-47-110(8)C.R.S.requires the Liquor Enforcement Division to report to the legislature by January
15th of each year all enforcement actions taken during the previous year by the state and local
licensing authorities that resulted in the imposition of fines, suspensions or revocations. This statute
also requires local licensing authorities to report their actions to the state in a manner as required by
the state licensing authority. In recent years the Division has received comments from local
government that our current reporting format is overly complicated. The Division has also noticed
that some local authorities have decided not to utilize our report and have instead sent minutes of
their meetings involving enforcement actions. These minutes often require detailed and time
consuming review to determine the violations found and are, at times, unclear as to the penalty
imposed.
In order to respond to both of these issues the Liquor Division has simplified its reporting format
for reporting local administrative actions. A copy of the new reporting format is attached to this
• memo and should be used to report all administrative actions taken by a local authority to either_deny
renewal,suspend revoke or firte_aliquor licensee. Please do not send meeting minutes in lieu of the
attached reporting form. A copy of each form submitted by the local licensing authority will also
be placed in the licensee's state license file.
Please use the attached form to report to us any license actions that you have taken this year and have
not previously reported to us. All reports received after December 15, 1995 must be made on the
attached reporting format to be included with the annual legislative report.
Your assistance and cooperation in this matter is greatly appreciated and will allow our staff to be
as efficient as possible in preparing this annual legislative report.
