RE: APPROVE VACATION OF SPECIAL REVIEW PERMIT#524 - MARTIN
EXPLORATION MANAGEMENT COMPANY/ B.F.Y., LLC, DBA KANGAROO
EXPRESS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated October 6, 1982, the Board did approve Special
Review Permit#524 for an oil field service business for the storage of completion rigs, tubing,
rods, valves, fittings, small equipment and equipment trailers for Martin Exploration
Management Company on the following described real estate, to-wit:
Part of the NW% of Section 5, Township 1 North, Range 67 West
of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from L. D. Swisher and R. L. Heil, on
behalf of B.F.Y., LLC, dba Kangaroo Express, 5770 Weld County Road 15, Dacono, Colorado
80514, to vacate said Special Review Permit#524, to meet Condition of Approval #2C for
Special Review Permit #1130, which was approved by the Board of County Commissioners on
November 13, 1996, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Special Review Permit #524 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 12th day of February, A.D., 1997.

SUBJECT: Vacation of USR-524, Martin Exploration
On October 15, 1996, the Board of County Commissioners approved Special Use Permit USR-
1130 from B.F.Y., LLC. This permit allowed for the operation of a delivery company (Kangaroo
Express) with warehousing for customers and recreational vehicle storage, located east of and
adjacent to WCR 15, approximately 1/4 mile south of State Highway 52 in Section 5, TIN, R67W
of the 6th P.M., Weld County. In USR-1130, Condition of Approval#2C stated that the applicants
shall vacate the underlying special use permit, USR-524, from Martin Exploration. USR-524 was
approved on this site in 1982 for an oil field service business for the storage of completion rigs,
tubing, rods, valves, fittings, small equipment and equipment trailers.
The applicants, B.F.Y., LLC, have submitted a letter requesting the vacation of USR-524. This
letter is enclosed in your packets. Also enclosed is the resolution from USR-1130.
