Tri-Area Planning Commission *4=v IR§ Change of Zone Administrative Recommendation PLANNER: Kerri Keithley Hearing Date: December 17, 1996 CASE NUMBER: Z-502 NAME: Del Camino South Donald Park, Park Engineering Consultants 1240 Main Street Longmont, Co. 80501 REQUEST: A Change of Zone from A (Agricultural) to PUD allowing C-4, I-1 and I-2 uses. LEGAL DESCRIPTION: Part of the N2 SW4 of Section 14, T2N, R68W of the 6th P.M. Weld County, Colorado. LOCATION: East of and adjacent to the Interstate 25 East Frontage Road, approximately 1/4 mile north of Weld County Road 20. SIZE OF PARCEL: 78 acres, more or less. THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS: 1. The submitted materials are in compliance with the application requirements of Section 28.5 of the Weld County Zoning Ordinance, as amended. 2. The submitted materials are in compliance with Section 28.7 of the Weld County Zoning Ordinance as follows: 28.7.1.2 A. The proposed change of zone is consistent with the intent of the Weld County Comprehensive Plan, as amended, including Planned Unit Development, Mixed Use Development Area, Commercial and Industrial Development Goals and Policies. 1. I.Goal 4 states: "Promote industrial development that is appropriately located in relation to surrounding land uses, and that meets necessary environment standards." This proposal for highway commercial (C-4) and 1 light industrial uses (I-1 and I-2) is compatible with surrounding land uses. Directly north of the site is proposed Del Camino East PUD Phase 2 which would allow for commercial and industrial uses, with residential to the northeast of the site. Other surrounding land uses include Del Camino Center PUD to the northwest and Flatiron PUD to the northwest. The eastern edge of the site lies within the 100 year floodplain as defined by FEMA mapping. The applicant has designated this portion of the site as open space with a maximum of 25% being developed. The applicant will need to address common open space further in the Final PUD Plan submittal. 2. C.Goal 1 states: "Encourage the expansion and diversification of the commercial economic base." This proposal includes Commercial Highway (C-4) uses which will provide economic opportunity for county residents as well as aid in diversifying the county's commercial economic base. 3. C.Goal 3 states: "Ensure that adequate public services and facilities are available to serve the commercial development or district." The development will be serviced by the St. Vrain Sanitation District for sewage disposal. Central Weld County Water District will provide an adequate water supply. The development lies within the Frederick Fire Protection District and the Mountain View Fire Protection District. 4. MUD.Goal 1 states: "To plan and to manage growth within the 1-25 Mixed Use development area and Urban Development Nodes so as to balance relevant fiscal, environmental, aesthetic, and economic components of the area." The applicant has designed this development to consist of both commercial (C-4) and industrial (I-1, 1-2) uses which is compatible with the surrounding land uses. The development will be encouraged to utilize innovative siting and design features to enhance prime visual features such as the Godding Hollow drainage way. The applicant has submitted a landscaping plan for the development which shows landscaping along the I- 25 East Frontage Road. All landscaping shall adhere to the landscaping requirements in proposed Ordinance 191. 28.7.1.3 B. 28.7.1.4 C. That the uses which would be allowed in the proposed Planned Unit Development will conform with the Performance Standards of the Planned Unit Development District contained in Section 35.5 of this Ordinance. The uses which would be permitted shall be compatible with the existing or future development of the surrounding area which include agricultural production, rural residences, commercial and industrial developments. Surrounding zone districts include Del Camino Center PUD to the northwest, Flatiron PUD to the northwest, 2 28.7.1.5 D. 28.7.1.6 E. Del Camino East Phase II PUD to the north and agricultural uses to the east. In addition, through the PUD Final Plan and Site Plan Review processes, design standards (landscaping, parking, signage, etc) will be adequately evaluated. That adequate water and sewer service will be made available to the site to serve the uses permitted within the proposed Planned Unit Development District. The development will be serviced by the St. Vrain Sanitation District for sewage disposal. The Central Weld County Water District will provide water service. That street or highway facilities providing access to the property are adequate in size to meet the requirements of the proposed zone district. The applicant will need to address street and highway facilities which provide access to the development as well as the internal roadway system in relation to the standards set forth in proposed Ordinance 191. The local road for the internal roadway system is not, at this time, consistent with the roadway requirements for a Local Employment/Regional Commercial roadway as displayed in proposed Ordinance 191. The applicant will need to address this discrepancy and submit an off -site road improvements agreement at the Final PUD Plan submittal. 28.7.1.7 F. That there has been compliance with the applicable requirements contained in Section 21.5.1.5 of the Weld County Zoning Ordinance as follows: 21.5.1.5.1 1. The proposed development lies with the flood hazard overlay district. Conditions of approval address this issue. This development also lies within the Mixed Use Development area. The applicant is aware of the update plan, Ordinance 191, to this area. The applicant may be subject to additional requirements of the plan with its adoption by the Board of County Commissioners. 21.5.1.5.2 2. The proposed development does not contain a commercial mineral deposit in a manner which would interfere with the present or future extraction of such deposit by an extractor to any greater extent than under the present zoning of the property. 21.5.1.5.3 3. Soil conditions on the site are not such that they present moderate or severe imitations to the construction of structures or facilities proposed for the site. 3 This recommendation is based, on part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The PUD Change of Zone is conditional upon the following: 1. The Change of Zone plat map shall be submitted to the Department of Planning Services for recording within 30 days of approval by the Board of County Commissioners. 2. The applicant shall submit a traffic analysis performed by a qualified engineer at the time of Final PUD Plan submittal. The traffic analysis shall identify traffic generated by the development as well as the roadway improvements needed to mitigate the increased traffic. This analysis should reflect the future arterial proposed in Ordinance 191. 3. Prior to recording the Change of Zone plat: a. The Change of Zone plat shall meet all requirements of Sections 28.5.2 and 28.5.3 of the Weld County Zoning Ordinance. b. The Change of Zone plat shall show all requirements from the Central Weld County Water District, as stated in their referral dated October 31, 1996. 4. The PUD Change of Zone is conditional upon the following and that each be placed on the Change of Zone plat as notes prior to recording: a. The PUD District allows for Commercial (C-4) and Industrial (I-1,1-2) uses and shall comply with the PUD Zone District requirements asset forth in Section 28 of the Weld County Zoning Ordinance, as amended. The PUD shall consist of a maximum of 20 lots. The PUD District shall comply with the PUD Zone District requirements as set forth in Section 28 of the Weld County Zoning Ordinance. b. The PUD shall be serviced by Central Weld County Water District and the St. Vrain Sanitation District. c. The site shall maintain compliance at all times with the requirements of Weld County Public Works, the appropriate fire protection district, Weld County Health Department, Colorado Department of Transportation, Department of the Army Corps of Engineers, Sheriffs Department, Colorado Geological Survey Department, St. Vrain Sanitation District and the Central Weld County Water District. d. The site shall maintain compliance at all times with the Flood Hazard Overlay District standards. 4 e. Installation of utilities shall comply with Section 12 of the Weld County Subdivision Ordinance. f. I have scheduled a meeting with the Weld County Planning Commission for Tuesday, December 17, 1996, at 1:30 p.m. This meeting will take place in the Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three miles of the property in question or if the property under consideration is located within the comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the submitted materials to the Tri-Area Planning Commission for its review and comments. Please call Melody Lee, at (303) 833-4905 for information regarding the date, time and place of the meeting and the review process. It is recommended that you and/or a representative be in attendance at each of the meetings described above in order to answer any questions that might arise with respect to your application. Sometime prior to December 6, 1996, a representative from the Department of Planning Services will be out to the property to post a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. In the event the property under consideration is not adjacent to a publicly maintained road right-of-way, one sign will be posted in the most prominent place on the property and post a second sign at the point at which the driveway (access drive) intersects a publicly maintained road right-of-way. The Department of Planning Services' staff will make a recommendation concerning this application to the Weld County Planning Commission. It is the responsibility of the applicant to contact the Department of Planning Services office a few days before the date of the hearing to obtain that recommendation.
