The Weld County Health Department has reviewed this proposal.
The application has satisfied PUD Ordinance No. 197 in regard to water and sewer service. Water
will be provided by the North Weld County Water District and sewer will be provided by septic
systems. The proposed lot sizes are smaller than we would prefer, however, the overall density of
septic systems per acreage (1 per 2.7 acres) complies with Ordinance No. 197 and our Departmental
policy. Additionally, the preliminary utility plan map provided in the application designates two
primary leachfield sites on each lot, as well as a secondary leachfield site that can accommodate a
replacement system.
Due to the relatively small proposed lot sizes, we recommend that the unused primary leachfield site
and the secondary leachfield site be preserved in a manner that would allow for future use as a
leachfield site. We recommend that this be stated in the developments covenants. We have
conducted a cursory review of the proposed covenants and did not find any reference to preserving
these areas. As a result, we recommend that language be placed into the covenant that restricts
activities in the unused primary leachfield site (two primary leachfield sites are designated on each
lot) as well as the secondary leachfield site. Specifically, activities such as landscaping, i.e. the
planting of shrubs and trees, and construction, i.e. auxiliary structures, dirt mounds, etc. should be
expressly prohibited in the designated leachfield sites. The covenants should encourage maintaining
these areas in grass. Additionally, the covenant does not appear to address the fact that the secondary
leachfield site for each lot is not located on the actual lot, rather they are located in the designated
open space. The covenant should clearly state that this use is allowed in the open space.
The environmental impact plan provided in the application materials and required in section 6.3.1 of
the PUD Ordinance appears to address all potential impacts described in the Ordinance.
During field observation of the site, our staff observed that in the vicinity of the proposed
development there were numerous small acreage homes in the vicinity of the site. Many of these
homes have livestock that include but may not be limited to cows and horses. It is our opinion that
any future property owner should be made aware that these agricultural uses exist and that they may
be exposed to noise, dust, flies, odors, etc. in excess of the common urban experience. As a result,
we recommend that the "Right to Farm" covenant be required to be placed on any recorded plat.
In addition to the above recommendations, we recommend that the following conditions be part of
any approval:

1) As indicated in the development guide, the east branch of the Challgren Lateral ditch shall be
enclosed in pipe and relocated as shown in the preliminary overall utility plan (approx. 200' to
the east of its present location).
2) The development shall obtain water service from the North Weld County Water District.
3) A Weld County Septic Permit is required for each proposed septic system. Each system shall be
installed according to the Weld County Individual Sewage Disposal Regulations.

Dear Mr. Ballstadt:
We have reviewed the above referenced proposal to subdivide a 64.88-acre parcel
into 24 single-family residential lots. The Water Supply Information Summary requested in
the State Engineer's memorandum of August 7, 1995 was not included and no other
information on projected water use was provided. The source of water supply is to be the
North Weld County Water District, however no letter of commitment for domestic service
was included.
Pursuant to Section 30-28-13611 )(h)Illj, C.R.S., a municipality or quasi-municipality,
upon receiving the preliminary plan designating said municipality or quasi-municipality as
the source of water for a proposed subdivision, shall file, with the board of county
commissioners and the state engineer, a statement documenting the amount of water
which can be supplied by said municipality or quasi-municipality to proposed subdivisions
without causing injury to existing water rights. A report of this nature was not included in
the submitted materials.
Based on the information provided, we cannot comment on the potential for injury
to decreed water rights or the adequacy of the proposed water supply under the provisions
of Section 30-28-136(1 )(h)(ll) C.R.S.

I recently received additional percolation test data for the subject property performed by
Foundation& Soils Engineering. Percolation tests were performed in 12 locations. Groundwater
is found to be shallow(7 ft below ground surface)over portions of the site. The two test events
were performed in January and late September,neither in what is considered the"wet" season, so
it is possible that groundwater is higher during late spring and summer. In this case, subsurface
conditions would be less amenable to standard leach fields.
There is the question of the influence of irrigation on the property. In my comments of June 2,
1998, [mentioned that it would be useful to prepare a water budget to estimate how much the
hydrologic system would be affected by the change from irrigated agriculture to residential
subdivision and septic systems. This has not been done, so an important data component is
missing. At present, it appears that most of the lots can be served by standard leach fields, but I
question the longevity of the fields,based on the shallow bedrock and the potential for shallow
groundwater. It is important that backup sites be located for every lot.
Although percolation rates of 60 mpi may barely meet State health guidelines, this rate indicates
extremely marginal conditions of low permeability. The results of perc tests at test hole location
9, as well as at locations 11, 13, 18, 22, which were tested in February, indicate that engineered
systems should be installed at these locations.
In summary, information on spring-summer groundwater elevations and the influence of
irrigation is missing for the site. The localized presence of low permeability soils, shallow
groundwater, and shallow bedrock are red flags that signal that problems with leach field
efficiency are likely to develop. Close attention must be paid to the siting of leach fields. Please
