In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current I.S.D.S. regulations. RE-1779 was originally applied for on July 27, 1995. After its approval on September 6, 1995, it was found through surveying the property that one of the pre-existing lots (the property owned by Mary Love at the time of the application) had a residence sitting on the western lot line of this parcel. Staff determined that recording the RE would substantiate the residence on two separate parcels and therefore could not record the RE as it was approved. Staff offered the following options to the applicant to correct the problem: A. The home could be physically removed, thus correcting the problem. Prior to recording the plat, the applicant would have to apply for a demolition permit for the residence. B. Any physical structures to be located on Lot A of the recorded exemption had to be shown in their entirety as residing on Lot A. Otherwise, the residence had to be shown as being a part of the pre-existing lot. This could be done by completing a subdivision exemption for lot line adjustment, and followed by a recorded exemption. The applicant later decided to pursue more along the lines of option B. On July 17, 1996, the applicant applied for a recorded exemption in conjunction with three subdivision exemptions (all submitted under one application), two SE's for property line adjustment, and on SE in conjunction with an RE, for the purpose of removing two habitable structures on their own lots.
