RE: APPROVE CANCER PREVENTION CONTRACT AMENDMENT #1 BETWEEN THE
WELD COUNTY HEALTH DEPARTMENT AND THE COLORADO DEPARTMENT OF
PUBLIC HEALTH AND ENVIRONMENT AND AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with the Cancer Prevention Contract
Amendment #1 between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Weld County Health Department, and
the Colorado Department of Public Health and Environment, commencing July 16, 1997, and
ending August 15, 1997, with further terms and conditions being as stated in said amendment,
and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Cancer Prevention Contract Amendment #1 between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Weld County Health Department, and the Colorado Department
of Public Health and Environment be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 18th day of June, A.D., 1997.

CON fRACT AMENDMENT #1
THIS AMENDMENT, made this 13th day of May, 1997, by and between the State of Colorado for the
use and benefit of the Department of Public Health and Environment, 4300 Cherry Creek Drive South,
Denver, Colorado 80222-1530, hereinafter referred to as the State, and Weld County Department of
Health, 1517-16 Avenue Court, Greeley, CO 80631, hereinafter referred to as the contractor.
WHEREAS, authority exists in the Law and Funds have been budgeted, appropriated, and otherwise
made availabl nd a sufficient unencumbered balance thereof remains available for payment in Fund
Number 100, Appropriation Code 773, Contract Encumbrance Number PPG9705295, and
WHEREAS, required approval, clearance, and coordination has been accomplished from and with
appropriate agencies; and
WHEREAS, the parties entered into a contract dated July 16, 1996, contract number PPG9705295,
routing number 9705295 ("Original Contract"), whereby contractor was to provide certain services to the
State; and
WHEREAS, the Original Contract is funded from a cooperative agreement between the state and the
Centers for Disease Control & Prevention (CDC) and the CDC has extended the end date of the
cooperative agreement from July 15, 1997, to August 14, 1997; and
WHEREAS, the State and the contractor have mutually determined that due to the extension of the
cooperative agreement term by the CDC a one (I) month extension in the Original Contract is necessary
so that there is no lapse in screening services provided by contractor; and
WHEREAS, this extension is for the continuation of services and, therefore, it is the State's intent to
grant additional funding to contractor pursuant to the terms of the Original Contract.
NOW THEREFORE, it is hereby agreed that:
1. Consideration for this Amendment to the Original Contract, contract encumbrance number
PPG9705295, Contract Routing Number 9705295, dated July 16, 1996, consists of payments which shall
be made pursuant to the original contract and the parties' promises and agreements herein set forth.
2. It is expressly agreed by the parties that this Amendment is supplemental to the Original
Contract, contract number PPG9705295, dated July 16, 1996, which is, by this reference, incorporated
herein and made a part hereof, and is attached hereto as Exhibit ONE. All terms, conditions, and
provisions of the Original Contract, unless specifically modified herein, are to apply to this Amendment
as though they were expressly rewritten, incorporated, and included herein.
3. It is agreed the Original Contract is and shall be modified, altered, and changed in the following
respects only:

a. The term of the contract, stated on page 3 in paragraph 10, and on page 6, in paragraph
14, is hereby modified and extended to August 14, 1997. No additional compensation
will be granted by the State to contractor for services rendered by contractor during this
extension period.
b. Pursuant to the terms of the Original Contract, the State agrees to pay contractor for all
services rendered by contractor in compliance with the Original Contract, subject to the
funding limitations contained in paragraph 10, on page 3. The terms of the Original
Contract are hereby modified accordingly.
4. The effective date of this Amendment is July 15, 1997.
5. Except for the "General Provisions" and "Special Provisions", in the event of any conflict,
inconsistency, yariance, or contradiction between the provisions of this Amendment or any of its
attachments orixhibits, and any of the provisions of the Original Contract, the provisions of this
Amendment shall in all respects supersede, govern, and control. The "Special Provisions" shall always
be controlling:over other provisions in the contract or amendments. The factual representations in the
Special Provisions concerning the absence of bribery or corrupt influences and personal interest of State
employees are presently reaffirmed.
6. FINANCIAL OBLIGATIONS OF THE STATE PAYABLE AFTER THE CURRENT FISCAL
YEAR ARE CONTINGENT UPON FUNDS FOR THAT PURPOSE BEING APPROPRIATED,
BUDGETED, AND OTHERWISE MADE AVAILABLE.
7. THIS AMENDMENT SHALL NOT BE DEEMED VALID UNTIL IT SHALL HAVE BEEN
APPROVED BY THE CONTROLLER OF THE STATE OF COLORADO OR SUCH ASSISTANT AS
HE MAY DESIGNATE.
IN WITNESS WHEREOF, the parties hereto have executed this Amendment on the day first above
written.

Amendment to Cancer Prevention Contract
Enclosed for Board approval is Amendment #1 to the Breast and Cervical Cancer
Prevention Contract between the Weld County Health Department and the Colorado
Department of Public Health and Environment.
Last year, the Board of County Commissioners approved the Breast and Cervical Cancer
Prevention Contract for the time period July 16, 1996 through July 15, 1997. The
purpose of this amendment is to extend the terms of the contract an additional 30 days
through August 15, 1997 and eliminate a gap in services prior to the Colorado Women's
Cancer Control Initiative receiving the next award for breast and cervical cancer
screening services for the next five years.
There is no dollar amount involved with this amendment as the State Health Department
has had excess funds for these screenings for the past few years. Therefore, there is no
limit to the number of screenings the Health Department may perform and be reimbursed
for.
Health Department staff recommends your approval of this amendment.
