RE: DENIAL OF USE BY SPECIAL REVIEW #1154 TO EXPAND AN EXISTING
LIVESTOCK CONFINEMENT OPERATION - ENGLISH FEEDLOTS, INC., do PATTY
DEPLAZES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 27th day
of August, 1997, at the hour of 10:00 a.m. for the purpose of hearing the application of English
Feedlots, inc., do Patty Deplazes, 16058 Weld County Road 96, Nunn, Colorado 80648, to
expand an existing Livestock Confinement Operation (L.C.O.) from 12,000 cattle to 20,000
cattle in the A (Agricultural) Zone District on the following described real estate:
SW% of Section 8, Township 1 North, Range 65
West of the 6th P.M., Weld County, Colorado
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards
for review of said Use by Special Review, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, has studies the request of the applicant and the recommendation
of the Weld County Planning Commission and all the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be denied for the following
reasons:
1. It is the opinion of the Board of County Commissioners that the applicant has not
shown compliance with Section 24.4.2 of the Weld County Zoning Ordinance, as
follows:
a. Section 244.2.3 -- That the USES which would be permitted will be
compatible with the existing surrounding land USES. The Board of
County Commissioners finds that the proposal is not consistent with the
existing surrounding land uses. These uses include rural residential
subdivisions which predate the original development of the feedlot.
b. Section 24.4.2.4 -- That the USES which would be permitted will be
compatible with the future DEVELOPMENT of the surrounding area as
permitted by the existing zone and with future DEVELOPMENT as
projected by the COMPREHENSIVE PLAN of the COUNTY or the
adopted MASTER PLANS of affected municipalities. The Board finds

that the applicant has not proven this proposal is compatible with future
development. Urban development has already occurred in this area and
residential development will continue, thereby making the expansion of
this existing use incompatible.
b. Section 24.4.2.7 -- That there is adequate provision for the protection of
the health, safety and welfare of the inhabitants of the NEIGHBORHOOD
and the COUNTY. The Board of County Commissioners finds the
applicant has not proven there is adequate provision for the protection of
the health, safety and welfare of the inhabitants in the terms of the
proposed Use by Special Review.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of English Feedlots, inc., c/o Patty Deplazes,
16058 Weld County Road 96, Nunn, Colorado 80648, to expand an existing Livestock
Confinement Operation (L.C.O.) from 12,000 cattle to 20,000 cattle in the A (Agricultural) Zone
District, on the hereinabove described parcel of land be, and hereby is, denied.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 27th day of August, A.D., 1997.
