WHEREAS, Ehrlich Feedlot, Inc., Milliken, Colorado, has
requested permission for expansion of a feedlot operation on the follow-
ing described property, to -wit:
A parcel of land located in the Southeast Quarter of
the Northeast Quarter (SE1NE4) of Section Twelve (12),
Township Four (4) North, Range Sixty-seven (67) West of
the 6th P.M., Weld County, Colorado, containing 18 acres,
more or less, and
WHEREAS, the said requested expansion of an existing feedlot
operation is located in an Agricultural Zone, as set forth by the Weld
County Zoning Resolution, and
WHEREAS, according to Section 3. 3 (3) (c) of the Zoning Resolu-
tion of Weld County, said feedlot operation or any expansion thereof may
be authorized on the approval of the Board of County Commissioners of
Weld County, and
WHEREAS, the Weld County Planning Commission by Resolution
dated September 16, 1969, has recommended that expansion of this
feedlot operation be approved;
NOW, THEREFORE, BE IT RESOLVED that Ehrlich Feedlot,
Inc., Milliken, Colorado, is hereby authorized to expand an existing
feedlot operation on the following described property, to -wit:
A parcel of land located in the Southeast Quarter of
the Northeast Quarter (SEgNE') of Section Twelve (12),
Township Four (4) North, Range Sixty-seven (67) West of
the 6th P.M., Weld County, Colorado, containing 18 acres,
more or less, and
as provided by Section 3. 3 (3) (c) of the Zoning Resolution of Weld County,
Colorado.

APPEARANCE AGAINST: Joe Simmonds, Glen Anderson, Harry Ashley, Wayne Miller.
DISCUSSION: John Chilson presented the application, also pictures of the area
and the survey. This area has had gravel removed at various times.
A site plan is being drawn up, also a reclamation plan is being done
by N H P & Q. Mr. Fancher stated they estimated a minimum of 3 acre
per year for gravel consumption. Mr. Joe Simmonds, planner for
Windsor, stated they were were opposed to the zone change for the
Gump property, this is a similar situation and they are opposed to
industrial zoning to the west of the town. Mr. Chilson stated they
have the gravel and it is going to be needdln the expansion of the
Windsor area. If industrial zoning is only to the east of Windsor,
the gravel to the west is going to have to be transported to the
ready -mix -plant. The trucking is going to have to go through the
town of :.indsor. When you have the ready -mix plant at the site,
there is no requirement for the trucks to go through the town. If
there is a need for concrete to the west of Windsor, there is no
need for any trucking to go through the town. Any that would go to
Eastman Kodak could go on the by-pass to the south. One benefit thi
would have is economics. If you have to truck gravel to a plant to
the east, you already have built in extra cost to that gravel that
will be passed on to the consumer. If the plant is at the site of
the gravel, the only trucking cost is to the site it is to be used.
We have not been able to locate any gravel deposits to the east.
Mr. Frank stated where they are planning to excavate the gravel is
a flood area and Mr. Francher said he would clean out the river whic
they have been trying to get done for 20 years.
MOTION: By Mr. Heitman to table the matter. Mr. Bartels stated they recom-
mended the one to the north of this be denied because this was to
be a residential area, I would think we Would have to stand on the
same recrrnnendation for this one, until the Commissioners give us
their ruling on that, therefore he seconded the motion. A enanimous
vote of "Aye". Moticn carried.

APPEARANCE: Ron Ehrlich, Stow Witwer
DISCUSSION: Mr. Witwer explained the proposed operation — expansion would
be to the north. It is about 3/4 mile east of Milliken. Lease ex—
pired on the lot they were using to the south. Are feeding 10 to
12 thousand -cattle.
RESOLUTION:
Be it therefore recommended to the Board of County Commissioners
the request be approved. Motion by Leonard Bartels, second by Ronald
Heitman. A unanimous vote of "Aye". Motion carried.
APPLICANT ---Earl Bentley
DISCUSSION: Mr. Bentley inquired about building on a lot in back of another
with an access road with a 20' frontage on a dedicated road. Access
road will be owned by the property owner in the rear. Will be a
private road.
MOTION: By Mr. Bartels to approve the right of access to the property. For
the record, a private road will be allowed if it is 20' wide and has
access to a dedicated Right -of -Way. Second by Mr. Watson. A unan-
imous vote of "Aye". Motion carried.

DISCUSSION: Mr. Shaw presented his plans for a commercial feed lot. The
area will be machine leveled and all drainage into a proposed
lagoon which will be 2 or 3 acres. Will start with 1500 head.
Will be custom feeding. Itis about l- to the nearest house.
MOTION: By Mr. Heitman to take the matter under advisement until approval
from the Weld County Health Department is received. Second by Mr.
LePore. A unanimous vote of "Aye". Motion carried.

APPEARANCE: Mr. Peterson, Clyde Davis
DISCUSSION: Mr. Peterson asked ip a variance could be granted on lot 29
this is 150' frontage. A building permit was issued in 1968 for
this property. Survey showed 150' and 2 acres. Peterson owned
this property to the south. Permit was issued showing 1801 front—
age and department was assured this would be taken care of.
MOTION: By Mr. Heitman that before preliminary plat and first filing are
approved, this requirement will have to be met. Second by Mr.
Watson. A unanimous vote of "Aye". Motion carried.
SUBJECT: December regular meeting
MOTION: By Mr. Watson to hold the regular meeting for December on Tuesday,
December 9, 1969. Second by Mr. Heitman. A unanimous vote of "Aye"
Motion carried.

This letter is addressed to you through the office of the Weld County Planning
Commission in behalf of Ehrlich Feedlot, Inc. , a Colorado Corporatio,now
operating a commercial feedlot in and near Milliken, Colorado.
Ehrlich Feedlot, Inc. is the owner, among other lands, of the Southeast Quar-
ter (SE') of the Northeast Quarter (NE+) of Section Twelve (12), Township
Four (4) North, Range Sixty-seven (67) West, of the 6th P.M. , Weld County,
Colorado. There is located on this land a feedlot, as is shown on the map at-
tached hereto.
The Corporation had a lease on a feedlot near Milliken, Colorado known as the
"Eaton Lot," which unfortunately was not renewed as of September 1st, 1969,
thereby necessitating an expansion on an emergency basis of their current
facilities. It is contemplated that that portion of the SE* of the N4 of 12-4-67
lying north of the Beeline and Big Thompson Ditch, as shown on the attached
plat, and containing 18 acres more or less, will be expanded to provide for
approximately 4,000 head of cattle.
It is recognized that these matters are taken care of on a regular agenda basis,
but in view of the fact that the company has committed itself to receive approx-
imately 4,000 head of cattle and now presently find themselves _without facil-
ities to house these cattle in view of the cancellation of the above described

lease it is respectfully requested that special consideration be granted to per-
mit expansion of the lots at the earliest possible moment.
