HILLHOUSE A SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT (PUD) FINAL PLAN, S #423, FOR A FIVE -LOT SUBDIVISION (FOUR PUD ESTATE LOTS AND ONE PUD AGRICULTURAL LOT) - GANDER VALLEY / DOUGLAS MYERS, C/O JAMES S. HILLHOUSE A public hearing was conducted on June 25, 1997, at 10:00 a.m., with the following present: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall Commissioner Barbara J. Kirkmeyer - EXCUSED Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges The following business was transacted: I hereby certify that pursuant to a notice dated May 14, 1997, and duly published May 22, 1997, in the South Weld Sun, a public hearing was conducted to consider the request of Douglas Myers, c/o James S. Hillhouse, for Change of Zone #505 from A (Agricultural) to PUD (Planned Unit Development), allowing Estate and Agricultural uses and a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #423, for a five -lot subdivision (four PUD Estate lots and one PUD Agricultural lot) - Gander Valley. Chair Baxter stated only four Commissioners are present and explained, in the event of a tie vote, Commissioner Kirkmeyer will review the record and cast the deciding vote. Lee Morrison, Assistant County Attorney, made this a matter of record and clarified the Change of Zone must be approved before the PUD. Todd Hodges, Department of Planning Services representative, presented a brief summary of the proposal and stated the proposal is on a 68 -acre parcel, with the agricultural lot being 40.5 acres. He reviewed the access existing off Weld County Road 19 and stated the agricultural access is off Weld County Road 72. Mr. Hodges said the site is near Shilo Estates and Windsor Shores, and the Town of Windsor has no conflict. He reviewed the water and septic issues and then entered the favorable recommendation of the Planning Commission into the record as written. Responding to questions from the Board, Mr. Hodges confirmed the applicant agreed to identify on the plat the right-of-way necessary for the arterial/collector status of Weld County Road 19, and Don Carroll, Public Works Department, stated he is comfortable with that. Mr. Carroll stated the plat he has delineates 40 feet of right-of-way, thus 80 feet total right-of-way. James Hillhouse, applicant's representative and partner, stated he lives on Lot 1 and farms Lot 5, which is in alfalfa and grass hay. He confirmed the additional right-of-way is shown on the plat as submitted. Mr. Hillhouse stated they would like to keep the area in agricultural production and add a nice development, with a terrific view of the mountains. Howard Smith, surrounding property owner, stated he lives across the road from this proposal and has no objections. However, he voiced concern regarding visibility at the intersection of Weld County Roads 72 and 19, indicating said intersection is dangerous. Commissioner Harbert and Mr. Carroll confirmed the issue will be reviewed to see what can be resolved. Commissioner Hall moved to approve the request of Douglas Myers, do James S. Hillhouse, for Change of Zone #505 from A (Agricultural) to PUD (Planned Unit Development), allowing Estate and Agricultural uses, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Harbert, and it carried unanimously. Commissioner Hall moved to approve the request of Douglas Myers, c/o James S. Hillhouse, for a Site Specific Development Plan and Planned Unit Development (PUD) Final Plan, S #423, for a five -lot subdivision (four PUD Estate lots and one PUD Agricultural lot) - Gander Valley, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Webster, and it carried unanimously. This Certification was approved on the 30th day of June, 1997.
