No. 7061Mary Ann Feuerstein, Recorder / -/ ACCEPT RECOMMENDATIONS OF PLANNING COMMISSION - ZONING IN FORT LUPTON AREA PETITION OF RALPH BRENNING WHEREAS, a special hearing was held by the Board of County Commissioners, in the office of the County Commissioners, Weld County Courthouse on Wednesday, October 9, 1963 at 2:00 P. M., for the purpose of hearing protestants, if any, regarding the zoning of the Fort Lupton area more particularly described as follows: and PARCEL I WEE- of Section 30, Township 1 North, Range 66 West of the 6th P. M. in Weld County, Colorado, and which is east of the highway PARCEL II E2* Section 30, Township 1 North, Range 66 West of the 6th P. M., in Weld County, Colorado WHEREAS, there appeared no protestants at the above hearing. NOW, THEREFORE, BE IT RESOLVED, that the Board of County Commissioners, Weld County, Colorado, does hereby unanimously agree to uphold the recommendation of the Weld County Planning Commission by granting the approval for zoning in Parcel I and by denying the approval for zoning in Parcel II as described above. M. in Weld County, Colorado, and which is east of the Highway. The above motion was made by Millard Ewing and Seconded by John Watson. Unanimously carried. It was moved by Millard Ewing and seconded by John Watson that the Planning Commission recommends and certifies that the Board of County Commissioners, Weld County, Colorado, deny the Petition of Ralph Brenning for change of Zone in the Fort Lup- ton Area from "A" Agricultural District to "I" Industrial Dis- trict, more particularly described as follows: -East One Half (E- -) of the West One Half (Wi-) of Section 30, Township 1 North, Range 66 West of the 6th P. M. in Weld County, Colorado. The above motion was unanimously carried. M. A special meeting of the Board of County Commissioners, Weld County, Colorado was held on October 9, 1963 at 2:00 P. M., for the purpose of hearing protests if any, on the proposed change of zone in the Fort Lupton area, as recommended by the Weld County Planning Commission. Present were: Millard H. Ewing, Chairman, Board of County Commissioners Elmer L. Shultz, Chairman Pro Tem Tom V. Reed, Member Four residents in favor of the change Mr. Ewing opened the meeting and the public notice regarding the change in zone was read. Pursuant to the zoning laws of the State of Colorado, the Weld County Planning Commission recommends and certifies to the Board of County Commissioners, Weld, County, Colorado the acceptance of the Petition of Ralph Brenning, 815 South Second Avenue, Brighton, Colorado, for Change of Zone in the Fort Lupton Area from "A" Agricultural District to "I" Industrial District, more particularly described as follows: West One Half (W-) of the East One Half (E) of Section 30, Township 1 North, Range 66 West of the 6th P. M. in Weld County, Colorado and which is east of the Highway. The Weld County Planning Commission further recommends and certifies to the Board of County Commissioners, Weld County, Colorado to deny the petition of Ralph Brenning for Chage of Zone in the Fort Lupton Area from "A" Agricultural to "I" Industrial District, more particularly described as follows: East One Half of the West One Half (EilWil of Section 30, Township 1 North, Range 66 West of the 6th P. M., in Weld County, Colorado Mr. Reed stated that Mr. Mancini,was absent due to illness in the family, had expressed, in a phone conversation to Mr. Reed, that he was in favor of the change. Mr. Ewing asked the group if there was anyone present in opposition to the change. There was no opposition. Mr. Ewing asked those in favor of the change of zone to express their feelings. Those people present had no objection to the change as long as it did not effect their taxes. The Board of County Commissioners explained to the group that a change of zone has no effect on taxes. Taxes are governed by the type of structure not the change in zone. Change in Zone October 9, 1963 Ralph Brenning Mr. Brenning asked for the change of zone so that he could construct and operate a commercial business in the area. There being no objection to the change, on a motion by Mr. Shultz the Board approved the change in zone as recommended by the Weld County Planning Commission. The motion was seconded and carried.
