RE: APPROVE EASEMENT - TSE INVESTMENTS, LLC, % HAROLD EVANS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Easement between the County of
Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,
and TSE Investments, LLC, `/o Harold Evans, with terms and conditions being as stated in said
easement located on property as described in Exhibit 1, and
WHEREAS, after review, the Board deems it advisable to approve said easement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Easement between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, and TSE Investments, LLC,
Harold Evans, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said easement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of March, A.D., 1999.

2 EASEMENT
THIS EASEMENT, granted this 3�� day of Maid) , 1999, between TSE
Investments, LLC, whose legal address is 2900 "F" Street, Greeley, Colorado 80631,
of the County of Weld, State of Colorado, the Grantor, and County of Weld, a body
corporate and politic of the State of Colorado, whose legal address is 915 Tenth
Street, Greeley, Colorado 80631, of the County of Weld, State of Colorado, the
Grantee.
WITNESSETH, that the Grantor, in and for good and valuable consideration, the
receipt and sufficiency of which is hereby acknowledged, does hereby grant,
bargain, sell, and convey to the Grantee an easement for the purposes of
installation, maintenance, replacement, removal and repair of one or more telephone
or utility lines, together with all necessary or desirable underground facilities
and appurtenances for Grantee's operation of the telephone or other utilities,
over and across the following described parcel of real property situate in the
County of Weld and. State of Colorado to wit:
The real property described in the attached Exhibit "1" .
This Easement is for the benefit of and appurtenant to that land, or any part
thereof, situate in the County of Weld and State of Colorado, and described as :
The ;peal property described in the attached Exhibit "2" .
This Easement shall expire upon the happening of the following event, or at
the time set forth below, whichever is earlier:
This is a permanent easement for the benefit of the Grantee.
The Grantee agrees to repair and maintain the easement granted herein at the
cost and expense of the Grantee, and that said Grantee will in no way hinder or
prevent the proper and reasonable use and enjoyment of the property through which
the easement is granted.

The easement is located as follows:
A 10 foot utility easement that runs along the boundary line on the real property described on
Exhibit "2," between H Street and the private road, such line being located at N 57 00'00" E,
698.32, as set forth on the Site Plan dated 7/01/96 and recorded at Reception No. 2507149, Book
1562, page 466 on 8/20/96.
See Easement Exhibit, attached and incorporated herein.

Exhibit "2"
A port of Tract ..0., Weld County Business Park P.U.D., a subdivision
within the City of Greeley, County of Weld, State of Colorado, more
particularly described as follows:
Commencing at the Northeast Corner Of Section 31 , Township 6 North,
Range 65 West of the 6th Principal Meridian, and considering the East
line of the Northeast Quarter (NE 1/4) to bear South 00' 00' 00 West,
with all bearings contained herein being relative thereto; thence
South 00' D0' 00" West along the East line of the Northeast Quarter
(NE 1/4), a distance of 850.00 feet to the Centerline of "M" Street;
and thence South 90' 00' 00" West along the Centerline of "M" Street,
a distance of 80.00 feet; thence along a curve to the left having a
radius of 500.00 feet, a central angle of 33' 00' 00" an arc distance
of 287.98 feet, the long chord of which bears South 73' 30' 00" West,
