Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert - EXCUSED Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Gloria Dunn Court Reporter, Barbara Billings The following business was transacted: I hereby certify that pursuant to a notice dated April 10, 1995, and duly published April 13, 1995, in the Windsor Beacon, a public hearing was conducted to consider the request of Continental View Ponds, Go Jack Olberding, Bill Bedell, John C. Widerquist, and Terry A. Henze, for a Site Specific Development Plan and Planned Unit Development Plan. Lee Morrison, Assistant County Attorney, made this a matter of record. Gloria Dunn, Planning Department representative, gave a brief overview of the proposal for five residential lots on 12.5 acres, each being approximately 2.6 acres in size. She stated Outlot A would be a 23 -acre lake, Outlot B would be one acre reserved for future corridor, and Outlot C would be for a culdesac and access. Ms. Dunn reviewed the portions of the lots within the 100 -year floodplain, indicating the property will be serviced by Left Hand Water District, Mountain View Fire Protection District, and engineered septic systems, with 10 percent maximum building coverage. She discussed the home owners' association, the wildlife enhancement plan, and the subdivision improvements agreement including collateral. Ms. Dunn noted 15 referrals were received and all concems were addressed. She also noted the Shaw family voiced opposition and submitted photos at the Planning Commission hearing which are included in the file. Ms. Dunn then entered the favorable recommendation of the Planning Commission into the record as written and reviewed the Conditions of Approval, some of which have already been satisfied. John Widerquist represented the applicant and stated he intends to build his own house on site and noted 70 percent of the wildlife enhancement plan is completed. He stated over 1,000 plants have been planted and bids have been taken on water and gas lines. Mr. Widerquist reviewed the Landscape Plan Map and stated the flood application and study are in the final stages and further commented on the 100 -year floodplain. Virginia Shaw, surrounding property owner, read a prepared statement, Exhibit G, into the record and reviewed the attachments. Ms. Dunn confirmed the applicants have tried to make the proposal compatible with the surrounding area including buffers, minimum of 100 -foot set backs, numerous plantings, limited number of pets, restricting large animals, lighting restrictions, etc. She noted the floodplain process for construction on Lot 1 must be followed and reiterated the plantings and landscaping on the west side. Ms. Shaw voiced further concerns and answered questions from the Board. During his rebuttal, Mr. Widerquist reiterated the floodplain issue has been addressed and noted the site is not in the floodway and will not affect the surrounding properties. He also reiterated the wildlife plan is in conjunction with the Forest Service and the Extension Office and the area will actually be improved by the additional vegetation. Mr. Widerquist noted the fact that the site is in an agricultural community will be recorded in the covenants; therefore, all owners will be aware and have no objections to agricultural surroundings. He confirmed only 5,000 square feet will be raised one foot and landscaping will be part of the PUD; however, no actual berms will be constructed. Mr. Widerquist answered questions from the Board, and Mr. Morrison clarified the applicants' first 951032 PL0966 Deputy Cle to the Board RE: HEARING CERTIFICATION - CONTINENTAL VIEW PONDS PAGE 2 application was for E (Estate) Zoning and a conventional subdivision, which was actually withdrawn by the applicant before coming to the Board. Ms. Dunn confirmed the Tri-Area and Weld County Planning Commissions both support this proposal. Mr. Widerquist agreed with all Conditions of Approval and stated the proposal will benefit the area and include 75 percent open space, and possibly 90 percent open since there will be building envelopes. He also noted there are provisions in the home owners' association for assessment and wildlife protection and reiterated the agricultural area will be protected. Commissioner Kirkmeyer moved to approve the request of Continental View Ponds, do Jack Olberding, Bill Bedell, John C. Widerquist, and Terry A. Henze, for a Site Specific Development Plan and Planned Unit Development Plan, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record. The motion was seconded by Commissioner Webster, and it carried unanimously. This Certification was approved on the 22nd day of May, 1995.
