RE: APPROVE INTERGOVERNMENTAL AGREEMENT FOR USE OF SPACE AT
CENTENNIAL PARK LIBRARY AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Intergovernmental Agreement for
Use of Space at Centennial Park Library between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, on behalf of the Health
Department, and the Weld Library District, commencing upon full execution of said agreement,
and ending one year from date of signing, with further terms and conditions being as stated in
said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Intergovernmental Agreement for Use of Space at Centennial
Park Library between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Health Department, and the Weld
Library District be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 24th day of November, A.D., 1997.

INTERGOVERNMENTAL AGREEMENT
FOR USE OF SPACE
AT CENTENNIAL PARK LIBRARY
THIS AGREEMENT is made and entered into this a 4 day of November, 1997, by and
between the Weld Library District, with offices located at 2227 23rd Avenue, Greeley, Colorado
80631, hereinafter referred to as "District," and the County of Weld, a political subdivision of the
State of Colorado, on behalf of the Weld County Health Department's Colorado Health
Information Dataset Grant Project, with office's located at P.O. Box 758, 915 10th Street,
Greeley, Colorado 80632, hereinafter referred to as "CoHID."
WITNESSETH:
WHEREAS, CoHID is in need of office space for the location of computer equipment for
use in the administration of its program, and
WHEREAS, District's Centennial Park Library has such space now available, and
WHEREAS, the parties hereto now desire to enter into this Intergovernmental Agreement
("IGA") for the purpose of enabling CoHID to use the available space at the Centennial Library
and to define the requirements of such use.
NOW, THEREFORE, in consideration of mutual promises and covenants contained
herein, the parties hereto agree to the following:
1. TERM: This Agreement shall be in force for a period of one year from the date
setforth above and shall be renewed automatically for successive one year terms
unless sooner terminated by either party by providing to the other party written
notice of such intent to terminate, which notice must be received at least 20 days
prior to the intended date of termination.
2. DISTRICT AGREES:
a. To provide, at no cost to CoHID during the term of this IGA, the use of
office space in the computer room of the District's Centennial Park Library
for the locating of the computer equipment owned the Weld County Health
Department and operated by CoHID.
b. To provide the following at no cost to CoHID during the term of this IGA:
1) One (1) port link in the existing computer hub.
2) One (1) unique IP address.

3) One (1) electrical outlet.
c. To prohibit the use of the CoHID computer equipment by persons other
than CoHID authorized personnel.
3. CoHID AGREES:
a. To set up and maintain the computer equipment at no cost to District.
b. To pay to District the sum of $50 per month during the term of this IGA.
c. To keep the office space clean and free from debry.
5. NON -ASSIGNMENT: This IGA shall not be assignable.
6. MODIFICATION AND BREACH This IGA containS the entire agreement and
understanding between the parties hereto and supersede any other IGA' s
concerning the subject matter of this transaction, whether oral or written.
Modifications, amendments, novations, renewals, or other alterations of or to this
IGA shall only be deemed valid or of any force or effect whatsoever if mutually
agreed upon in writing by the undersigned parties. No breach of any term,
provision, or clause of this IGA shall be deemed waived or excused, unless such
waiver or consent shall be in writing and signed by the party claimed to have
waived or consented. Any consent by any party hereto or waiver of, a breach by
any other party, either expressed or implied, shall not constitute a consent to,
waiver of or excess of any other different or subsequent breach.
7. SEVERABILITY: If any term or condition of this IGA shall be held to be invalid,
illegal, or unenforceable, this IGA shall be construed and enforced without such
provision, to the extent that this IGA is then capable of execution within the
original intent of the parties.
8. NO WAIVER OF IMMUNITY: No portion of this IGA shall be deemed to
constitute a waiver of any immunities the parties or their officers or employees
may poses, nor shall any portion of this IGA be deemed to have created a duty of
care which did not previously exist with respect to any person not a party to this
IGA.

WHEREFORE, parties have hereunto set their hands and seals the date and year first
written above.

Agreement for Use of Space at Centennial Park Library
Enclosed for Board approval is an intergovernmental agreement between the Weld Library
District and the County of Weld on behalf of Weld County Health Department's Colorado Health
Information Dataset Grant Project.
In 1995, the Weld County Health Department applied for and received a Preventive Health and
Health Services (Federal) Block Grant through the Colorado Department of Public Health and
Environment for the purpose of developing a standard collection of health status indicators.
These indicators were to be collected, compiled and distributed to each public health agency in
Colorado. This data would then be used by those health agencies for program planing and
evaluation.
Towards that end, the Colorado Health Information Dataset (CoHID) has developed a
computerized searchable version of the Health Information Dataset. This program, on CDROM,
is currently being tested at public health agencies throughout the state, and a web based system
will be implemented in the near future. This brings to CoHID the possibility of serving not only
the State and local health departments, but the broader medical community and the general
public as well.
CoHID is now in need of office space for the location of computer equipment to be used in the
implementation of this program, and the Centennial Park Library has such space available.
Therefore, the two agencies are entering into this agreement which defines the requirements for
use of this office space.
The term of this agreement is for one year from the date of signing and will be renewed
automatically for successive one year terms unless it is terminated sooner by either party. For
use of the office space, CoHID will pay the Weld Library District $50 per month during the term
of the agreement.
This agreement will be funded by the aforementioned grant and no county funds will be
expended. I recommend your approval.
