Approved with Conditions
The Department of Planning Services has determined through the review, that the standards of Section 11.4.2.1 through
11.4.2.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the
following conditions in accordance with information submitted in the application and the policies of the County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed according
to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.
2. Prior to recording the plat:
A. The plat shall delineate a septic system replacement envelope for lot A. (Envirionmental Health Services)
B. The existing access for Lot B from WCR 24, along the Eastern edge of lot B, shall be for ingress and
egress and shall be referenced on the plat by the Weld County Clerk and Recorders reception number. (Lot
B)
C. In accordance with Weld County Public Works Ordinance#180, Lot A shall utilize the existing residential
access point. Lot B shall use the existing access point along the Eastern edge of lot B. No circle drives or

additional accesses shall be granted. These roads will be graded and drained to provide all weather
access.
D. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld County
Public Works Department to determine if a culvert is necessary at any approved access point. If a drainage
culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a larger
culvert, please contact the Public Works Department to adequately size your culvert.
E. Both Lot A shall comply with the one (1) acre minimum lot size required by Section 11.8.5 of the Weld
County Subdivision Ordinance.
F. The applicant shall attempt to address the requirements of the Mountain View Fire Protection District as
stated in a referral response received (September 29,1999).
G. WCR 24 is designated on the Transportation Plan Map as a collector status road, which requires 80 feet
of right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld
County.
The plat shall be delineated to show 40 feet right-of-way from center line.
WCR 17 is designated on the Transportation Plan Map as a local gravel road, which requires 60 feet of
right-of-way at full build out. There is presently 60 feet of right-of-way. This road is maintained by Weld
County.
The plat shall be delineated to show 30 feet right-of-way from center line.
H. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset requirements for
the zone district in which the property is located. All proposed or existing structures will or do meet

Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as
amended), the required setback is measured from the future right-of-way line.
2) Any future structures or uses on site must obtain the appropriate zoning and building permits.
3) Prior to the release of building permits for any structure exceeding 3,600 square feet, the applicant
must comply with the requirements of Appendix III-A of the Uniform Fire Code, as recommended
by the Mountain View Fire District.
4) Future development on the property may necessitate a larger parcel than what is displayed on the
plat in order to utilize a septic system. In addition, a larger parcel would provide additional dilution
and attenuation of sewage wastes which may be beneficial to the environment.
5) The approved configuration of Lot A does not constitute justification for further land splits.
6) Prior to the issuance of a building permit on Lot B of the recorded exemption, the applicant for the
building permit shall be required to submit to the Department of Planning Services, evidence that
the lot(s) has (have) an adequate water supply of sufficient quality, quantity and dependability.
7) Prior to the release of building permits on Lot A or B, the applicant will be required to submit a
recorded deed describing the lot upon which the building permit is requested with the building permit
application. The legal description on such deed shall include the lot and recorded exemption
number.
8) Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Ordinance 169A.

9) RIGHT TO FARM COVENANT
Weld County is one of the most productive agricultural counties in the United States. The rural
areas of Weld County may be open and spacious, but they are intensively used for agriculture.
Persons moving into a rural area must recognize there are drawbacks, including conflicts with
longstanding agricultural practices and a lower level of services than in town.
Agricultural users of the land should not be expected to change their long-established agricultural
practices to accommodate the intrusions of urban users into a rural area. Well run agricultural
activities will generate off-site impacts, including noise from tractors and equipment; dust from
animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and
manure; smoke from ditch burning; flies and mosquitoes; the use of pesticides and fertilizers in the
fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved "out of
the way" of residential development without threatening the efficient delivery of irrigation to fields
which is essential to farm production.
Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware)
with more than 3,700 miles of state and county roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement is based on
responses to complaints more than on patrols of the county and the distances which must be
traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire
protection is usually provided by volunteers who must leave their jobs and families to respond to
emergencies. County gravel roads, no matter how often they are bladed, will not provide the same
kind of surface expected from a paved road. Snow removal priorities mean that roads from
subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow
removal for roads within subdivisions are of the lowest priority for public works or may be the private
responsibility of the homeowners. Services in rural areas, in many cases, will not be equivalent to
municipal services.
Children are exposed to different hazards in the county than in an urban or suburban setting. Farm
equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and
center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and
livestock present real threats to children. Controlling children's activities is important, not only for
their safety, but also for the protection of the farmer's livelihood.
10) Effective December 1, 1999, Building Permits issued on proposed Lot A and Lot B of RE-2595 will
be required to adhere to the fee structure of the Southwest Weld County Service Area Road Impact
Program (Ordinance 211)
3. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the
Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7
of the Weld County Subdivision Ordinance. The plat shall be submitted within sixty (60) days from the date of
approval by the Department of Planning Services. The applicant shall be responsible for paying the recording
fees.
4. Planning Staffs approval of this recorded exemption is based upon satisfying the above conditions. Should the
applicant be unwilling or unable to meet any one of these conditions, within 60 days of approval, this case will be
forwarded to the Board of County Commissioners with a recommendations for denial.

I spoke with you about turning in the mylar plat for RE-2595. The due date
for the plat is Feb. 21st. Since your office is not open on the 21st because
of Presidents day, I wanted to let you know I will come in on the 22nd of
February to turn in the mylar plat. Could you find out which planner has
been assigned to RE-2595? It used to be Eric Jerman, but I understand he is
no longer with the planning department. If you could reply to this with the

Eric,
This letter is in reference to Recorded Exemption #2595 for Daren and
Michelle Faye. During the land survey work a minor boundary line conflict
was discovered. We are working on a resolution with the other landowner and
would like a 30 day extension to turn in the mylar plat. I believe the
current due date for the plat is January 21, 2000. I would like to extend
this due date to February 21, 2000.
Please confirm by letter or e-mail if the due date for Recorded Exemption
#2595 can be extended to February 21, 2000.

Recorded Exemption Questionnaire
Water Supply:
Domestic:
The current residence is serviced by a well. Water service for the proposed lot would come from
the Central Weld County Water District as evidenced by the attached letter from CWCWD.
Irrigation:
The current well has been irrigating the smaller one acre lot. The 31 acre lot receives irrigation
water from 15 shares of the New Coal Ridge Ditch Company. No irrigation water has been
removed from the property.
Sewage Disposal:
Attached is a copy of the current septic system and its inspection from the Weld County Health
Department. The second proposed lot would also utilize a septic system.
Current Land Use:
The property is currently being used for agricultural and residential purposes. Approximately 30 acres of
the 32 acre parcel would be considered prime farmland. The principal residence is situated on
approximately one acre with a garage/barn,workshop,machine shed,and small livestock barn. The
proposed 31 acre site has a 30' X 60' hay storage barn. Current livestock include three horses and one
heifer. Crops grown on the property are grass and alfalfa hay. The irrigation ditch system delivers water to
two locations on the property. All permanent irrigation structures are located in neighboring parcels.
Purpose of Recorded Exemption:
We would like to use a recorded exemption to provide growing room for our family while allowing us to
remain on our property. The existing homesite,our current home,would continue as our primary
residence. The larger 31 acre proposed lot would be used in the future to provide us a homesite for a
single-family residence. Agricultural use of the prime farmland will continue.
Proposed Lot Description:
The location of the proposed new lot would be the northern 31 acres of the parcel. The smaller lot would
have an east/west property line even with the adjoiners to the east. The present use of the proposed lot area
is agricultural. There are alfalfa and grass hay fields located there. The new use would take one acre out
of the 31 acre parcel for a home site and the remaining 30 acres would continue to be agricultural.
Building Envelope:
A building envelope will be designated on the proposed new lot.
Surrounding Land Use:
The proposed lots are compatible with surrounding land usage. Neighboring parcels range from a one acre
residential site to a 38 acre agricultural site. The current agricultural and residential use of the proposed
lots would continue.
Consistency of Proposal:
The proposed exemption is consistent with efficient and orderly development by preserving current
agricultural land use and retaining the associated irrigation water to promote prime farmland.

WCR 24 is designated on the Weld County Transportation Plan Map as a collector status road which requires 80
feet of right-of-way at full build out. This road is maintained by Weld County. Pursuant to the definition of
SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured
from the future right-of-way line.
WCR 17 is designated on the Weld County Transportation Plan Map as a local gravel road which requires 60 feet
of right-of-way at full build out. This road is maintained by Weld County. Pursuant to the definition of SETBACK
in the Weld County Zoning Ordinance (Ordinance 89, as amended), the required setback is measured from the
future right-of-way line.
REQUIREMENTS:
The access shall be placed in such a location to have adequate sight distance in both directions and not below the
crest of a hill or where physical obstructions are present. (Lot B)
If a drainage culvert is required, a 15-inch CMP is the County minimum size. If the applicant chooses to place a
larger culvert, please contact the Public Works Department to adequately size your culvert. (Lot B)
The applicant shall utilize the existing access to this parcel as no additional accesses shall be granted. (Lot A)
Pursuant to Ordinance 169A, if noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds.

Dear Mr. Jerman:
I have reviewed the submitted material pertaining to recorded exemption for the Faye property
(Case Number: RE-2595). The District does not object to the recorded exemption, but does
have the following comments and requirements for the construction of any new residences.
• All construction shall be in accordance with the provisions of the Uniform Fire Code, as
ratified by the Weld County Commissioners, and all other applicable codes and ordinances,
as enforced by Weld County.
• n
Water supply for fire protection is required for single family residences that are more than
3,600 gross square feet or are placed on a lot that is less than 2.5 acres. A minimum fire
flow of 1,000 gallons of water per minute, measured at a residual pressure of 20 pounds per
square inch (p.s.i.), is required for one- and two-family dwellings not exceeding 3,600 gross
square feet. All other buildings (including larger one- and two-family dwellings) require a
minimum fire flow of 1,500 gallons of water per minute, measured at a residual pressure of
20 pounds per square inch (p.s.i.) and may require more depending on the building size and
type of construction as per Appendix III-A of the Uniform Fire Code.
• Water supply for fire protection will be adequate provided the required fire flow is available
from fire hydrants in the area and a fire hydrant is located so that the most remote portion of
the exterior wall of the residence is within 600 feet of the hydrant as measured along the fire
apparatus access road and around the exterior of the residence. A letter must be provided to
the Fire District, by the water supplier,that the required fire flow is available to the property.
• Before construction may begin on a new residence, fire department apparatus access must be
provided for all structures in excess of 150 feet from a public access road. Fire apparatus
roads shall be extended so fire apparatus may reach to within 150 feet of all portions of the
building. Apparatus access roads shall be a minimum of 20 feet in width and be designed
and maintained to support the imposed loads of fire apparatus (60,000 pounds). Roads must
have a surface that provides all-weather driving capabilities. Roads in excess of 150 feet in
length must be provided with approved provisions for the turning around of fire apparatus.

Central Weld County Water District, Northern Colorado Water Conservancy District and the U. S.

and the Bureau. Central Weld cannot issue a tap until all requirements are satisfied.
