Application Form attached. 2.) Tract is in compliance with the Weld County Comprehensive Plan. Lot B of RE -1536 is only 17.5 Acres and is zoned 1-3. 3.) This subdivision lies within the Urban Growth Boundary Area of the City of Greeley. 4.) North Weld Water District is presently serving the two buildings within this subdivision. The subdivision lies within the Western Hills Fire Protection District/City of Greeley. 5.) Both lots have public sewer service through connection to the City of Greeley Wastewater System. 6.) This area does not contain any hazardous topographical conditions. The potential of a high ground water table and flooding have been recognized and addressed. 7.) The only street within this subdivision is the private access road that serves Lot 2. This lies within a 30 foot access easement and has a minimum surface width of 18 feet and has a minimum of 4 inchess of gravel and can be maintained as an all-weather access road to Lot 2. Lot I has direct access to Cherry Avenue, which is a paved County Road (WCR #43). 8.) Site access is to Cherry Avenue (WCR #43), which is a two lane paved road. Colorado State Highway 263 lies totheSouth of the site. In the Sketch Plan Review neither the County Road Department nor the State Highway Department cited any concerns with the classification, width or structural capacity of the street facilities. Other concerns of access points and sight distances are addressed later in this statement. M 9;01A�5 RE: ARC SUBDIVISION - LOT B, RE -1536 October 17, 1996 PROJECT NO. 95132 9.) The lot owners understand that the construction, maintenance, snow re- moval and other matters pertaining to or affecting the road and rights - of -way for the Minor Subdivision are the sole responsibility of the owners within the Minor Subdivision. 10.) This Minor Subdivision is not part of a Minor Subdivision previously approved by Weld County. As stated in the legal description, the prior platting of this parcel is a Recorded Exemption. II.) There will be no on -street parking permitted within the Minor Subdivision. 12.) Not additional access to a County, State or Federal Highway will be per- mitted. 13.) The existing access roads from each lot to Cherry Avenue (WCR 43) will remain in use. No new or additional access points will be permitted. 14,) Drainage and storm water management are ,adequate. See report by McRae and Short, Inc.. dated January 13, 1995, PROJECT NO. 94319. . 15.) The ARC Subdivision Plat shows Lot I to contain 13.4833 Acres and Lot 2 to contain 4.0000 Acres, both exceeding the 2.5 Acre minimum. 16.) As shown on the plat, only 2 lots are being platted. 17.) The two existing buildings in this subdivision do not appear to cause unreasonable burden on the local governments or districts to provide fire and police protection or other services. See Referals from same. I8.) Current Title Committment is attached. 19.) Property is zoned 1-3. Only uses permitted within this zoning will be requested. - 20.) Items of Concern: (Sketch Plan Review) A. Weld County Health Department: I. Fugitive Dust: Site exempted due to size and construction time. 2. Miscellaneous- Liquid and solid Wastes, storage and disposal and allowable noise levels: It appears that these iems are "conditions of approval" and best handled with Development Standards or Zoning. B. Weld County Public Works: I. Access: The State Department of Transportation has ruled out any access to Highway 263. 2. Sight Distances: The existing access roads are lo remain in place. The most Northerly access, to Lot 2 only, will be im- proved by enlarging and lengthening the culvert under this access to allow vehicles entering Cherry Avenue to slop of 90' to the road for better visibility to the North. 270175 RE: ARC SUBDIVISION - LOT B, RE -1536 October 17, 1996 PROJECT NO. 95132 C. Colorado Department of Transportation: Highway plans shows 40' from centerline of Highway 263 to exist- ing right-of-way fence and with adjoining 40' owned by the City of Greeley, this site does not lie within the requested 75 feet for future right-of-tway North of the centerline. 2. No access to Highway 263 is being requested. 3. ARC Subdivision does not adjoin the existing highway right-of- way and no landscaping is proposed within the right-of-way. 4. The proposed improvements within the subdivision will have a minimal impact on the storm drainage from the site. Any berm- ing on site may have an impact on the floodway of the Poudre River, and none is proposed. D. City of Greeley: I. Entryway conditions: This site does not directly adjoin the existing Highway right-of-way. The buildings have been set to the Northerly part of the site and landscaping is proposed along the Southerly edge of the site. 2. Annexation of the site to the City of Greeley is not being con- sidered at this time. 3. Dedication of additional right-of-way for Cherry Avenue is not Included in this subdivision. 4. The easement for the private access road to Lot 2 has been in- creased to 30 feet to accommodate the fire department needs. 21.) ARC Subdivision Plat shows 2 lots. 22.) All streets and access improvements are private: The area has two in- dustrial users. The location and use does not require any additional road improvements or parking arrangements. 23.) No open space, school or park sites are proposed within this industrial area. 24.) No public dedication of lands is included in the ARC Subdivision. 25.) Water supply was obtained from North Weld County Water District. The referral shows no concern and water service agreements are in place. 26.) Sewage disposal is furnished by the City of Greeley. The buildings are being served now under agreement with the City of Greeley. -3- 9701_75 RE: ARC SUBDIVISION - LOT B, RE -I536 October 17, 1996 PROJECT NO. 95132 27.) Buildings are existing and being served by all utilities indicating availability of services. 28.) No covenants prepared for subdivision. Zoning to govern. Necessary easements for utility services are shown on the plat. 29.) No access points are being made to state highway. 30.) No irrigation ditches are involved. 31.) ARC Subdivision is not contiguous to State Highway 263 and no right-of- way dedication is being made on this plat. ARC Subdivision adjoins Cherry Avenue (WCR 43). RE -1563 did not in- clude the County Road Right-of-way and notes County acquisition of the road in Book 86, Page 273, Weld County Records. No additional right-of- way is being dedicated by this plat. '32.) No additional improvements are proposed and an Improvements Agreement has not been prepared. 33.) No offsite road improvements are proposed. 34.) Final Drainage Report was prepared by McRae & Short, Inc. dated January 13, 1995, PROJECT NO. 94319 and is included in the subdivision applica- tion materials. 35.) Certified list of property owners and addresses within 500 feet is attached. 36.) Certified list of mineral owners with interest in subject property is attached. 37.)
