A public hearing was conducted on May 14, 1997, at 10:00 a.m., with the following present:

Commissioner W. H. Webster

The following business was transacted:
I hereby certify that pursuant to a notice dated April 28, 1997, and duly published May 1, 1997, in
the South Weld Sun, a public hearing was conducted to consider the request of Richard Podtburg
for a Site Specific Development Plan and Special Review Permit #1144 for a 2000 -head dairy in
the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of
record. Todd Hodges, Department of Planning Services representative, presented a brief summary
of the proposal and entered the favorable recommendation of the Planning Commission into the
record as written. He stated the dairy currently operates with 700 head and approval of this Permit
will allow 2000 head. Mr. Hodges confirmed for Commissioner Kirkmeyer that the additional
conditions #3 and #4 as requested by the City of Greeley in a letter dated April 11, 1997, were
discussed but not added. Chair Baxter explained to the applicant that in the event of a tie vote,
since only four commissioners are present, Commissioner Harbert would review the record and
cast the deciding vote. G. M. Kennedy, full-time employee of the dairy, represented the applicant
and stated he understands the requirements and is prepared to comply. Responding to questions
from the Board, Mr. Kennedy stated they harrow the corrals daily and have a contract with a
commercial chemical applicator which sprays for fly control. He also stated there are six
residences adjacent to the perimeter of the property, three of which are farm residences and three
are not. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved
to approve the request of Richard Podtburg for a Site Specific Development Plan and Special
Review Permit #1144 for a 2000 -head dairy in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Hall, and it carried unanimously.
